<section id="H9943F19F36F94EE1AB6D089B58C02833" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Filipino Veterans Fairness Act of 2023</short-title></quote>.</text></section> <section id="H434F8309EA39492EBB3E6B8796CCE2DC"><enum>2.</enum><header>Improvement of veterans benefits furnished to certain individuals who served in the forces of the Philippines and the Philippine Scouts</header> <subsection id="H36B5C8B728F84211B65B84B17E7F2FFF"><enum>(a)</enum><header>Expansion of benefits</header><text>Section 107 of title 38, United States Code, is amended—</text> 
<paragraph id="H4EE48E820CFE47E290C25FF5081A16BE"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HEB0868F2BBBC4998A65A3E5D4A95B6BB"><enum>(A)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph> 
<subparagraph id="HC16E2B7B85EE4F3AA394B99985926508"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="HE64A4D830792458A8E46FA3C2EBC789D"><enum>(C)</enum><text>by inserting after paragraph (3) the following new paragraph:</text>

<paragraph id="H010BD7F3174E48A5BC9149469E367ADD"><enum>(4)</enum><text display-inline="yes-display-inline">sections 1541 and 1542 of this title.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H1DF12CBBD0CD4070A39D108589346AA4"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H95A71554B12A4252BDF0B1E8322E854C"><enum>(A)</enum><text>in paragraph (1), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph> <subparagraph id="HE9418AD169D1488E8D27490D79C2A24B"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HE6DFC193803B44F497A5B57DD0479DC8"><enum>(C)</enum><text>by inserting after paragraph (2) the following new paragraph:</text> <quoted-block style="USC" id="H877D7D7EE02B4421A9E8128079B32B10" display-inline="no-display-inline"> <paragraph id="H11A66923A4F1408DA24FC519BBB46506"><enum>(3)</enum><text display-inline="yes-display-inline">sections 1541 and 1542 of this title.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H47C989812E1A4ADDAA1D9D9432A6E01C"><enum>(b)</enum><header>Eligibility</header><text>Such section is further amended by adding at the end the following new subsections:</text> <quoted-block display-inline="no-display-inline" id="HDFBD3EB8627D402D9F94F5847E8B402B" style="USC"> <subsection id="HBCF693B8F2344ADFBADE05D3E293DC63"><enum>(e)</enum><header>Determination of eligibility</header> <paragraph commented="no" display-inline="yes-display-inline" id="HDD4DA58CB9F8447998734487DECCE5B9"><enum>(1)</enum><text display-inline="yes-display-inline">In determining the eligibility of the service of an individual under this section, the Secretary shall take into account any alternative documentation regarding such service, including documentation other than the recognized guerrilla rosters stored at the National Personnel Records Center, that the Secretary determines relevant.</text></paragraph> 
<paragraph id="HF31C76F66D574DDF85C6A44ECF8C34F6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than March 1 of each year, the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report that includes—</text> <subparagraph id="H9FBD66E9B7F14F2F8B2AF934E612D919"><enum>(A)</enum><text>the number of individuals applying for benefits pursuant to this section during the previous year; and</text></subparagraph> 
<subparagraph id="H201F12435F384ED7918874F25AE2BEAD"><enum>(B)</enum><text>the number of such individuals that the Secretary approved for benefits.</text></subparagraph></paragraph></subsection> <subsection id="H5A7F2348421D49748A429F916AEB6245"><enum>(f)</enum><header>Relation to Filipino Veterans Equity Compensation Fund</header><text display-inline="yes-display-inline">Section 1002(h) of the American Recovery and Reinvestment Act of 2009 (title X of division A of <external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>; 123 Stat. 200; <external-xref legal-doc="usc" parsable-cite="usc/38/107">38 U.S.C. 107</external-xref> note) shall not apply to an individual described in subsection (a) or (b) of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1A34F7726B714962B7AC405BE4D9C9F7"><enum>(c)</enum><header>Effective date</header> 
<paragraph id="HAC83A95342F84568A6E7C506EEC7288A"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall take effect on the date that is 270 days after the date of the enactment of this Act.</text></paragraph> <paragraph id="H33C59701318D4C468A6B277426653111"><enum>(2)</enum><header>Applicability</header><text>No benefits shall accrue to any person for any period before the effective date of this Act by reason of the amendments made by this section.</text></paragraph></subsection></section>
