which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Flood Insurance Act of 1968 to establish a pilot program to increase the allowable amounts of advance payments under the National Flood Insurance Program, and for other purposes.</official-title></form><legis-body id="HD561692A2A974584BA6CE9BC0B6B88E4" style="OLC"><section section-type="section-one" id="HBFBC306E90E04CE48BF0F638EED4337E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Advance Payments Modernization Act</short-title></quote>.</text></section><section id="H80C2BF92EBD74CD285579EAED98E63C4"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H9C60F2E6E2FE4BC8A1540356BEF01D36"><enum>(1)</enum><text>advance payments made by the Federal Emergency Management Agency (referred to in this section as <quote>FEMA</quote>) have proven to be beneficial to those impacted by disasters;</text></paragraph><paragraph id="H09898322945641248C46812AB1FFD846"><enum>(2)</enum><text display-inline="yes-display-inline">FEMA has provided millions of dollars in advance payments to policyholders under the National Flood Insurance Program who have started the claims process under that Program; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC9C39C2E6F1D4D1F919AA5B896803905"><enum>(3)</enum><text display-inline="yes-display-inline">the payments described in paragraph (2) are critical in helping policyholders as they begin to clean up and repair homes that have been devastated by natural disasters;</text></paragraph><paragraph id="H585AB4963BA249AB832C5953AB5F7E97"><enum>(4)</enum><text>while advance payments have proven to be beneficial to those impacted by disasters, there are still significant limitations to the process; and</text></paragraph><paragraph id="H722752AEF39E4E42837C97F94CA2B8F5"><enum>(5)</enum><text>there are technological advances that can enhance the advance payments program, and FEMA should harness those advances to improve the customer experience and streamline FEMA’s payments program with the overall goal of easing burdens on those whose lives have been shattered by natural disasters.</text></paragraph></section><section id="HAB5829B4B07747DFB0FB741F650EEDAA"><enum>3.</enum><header>Pilot program for remote National Flood Insurance Program claims</header><text display-inline="no-display-inline">Part C of chapter II of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4081">42 U.S.C. 4081 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H65BC7FBDA33643A6BFA1EA2849C878CE"><section id="HC1F9232F599C4E9B9B6F50D331C7511E"><enum>1349.</enum><header>Advance payments pilot program</header><subsection commented="no" display-inline="no-display-inline" id="H5D7D9AE05E3945E4A11DFD868E623845"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section: </text><paragraph commented="no" display-inline="no-display-inline" id="H78E18E70D75E4D1486CCF9B9530944EB"><enum>(1)</enum><header>Covered data</header><text>The term <term>covered data</term> means real-time, rapid monitoring data, including data obtained through remote sensing technology.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H087F3E96A91F4BF6B1D9D043B708604E"><enum>(2)</enum><header display-inline="yes-display-inline">Covered property</header><text>The term <term>covered property</term> means a property for which the Administrator has received covered data indicating that flooding has occurred. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40340D35DBC748328F3B1C75135240F2"><enum>(3)</enum><header>Eligible policyholder</header><text display-inline="yes-display-inline">The term <term>eligible policyholder</term> means a person holding coverage made available under the national flood insurance program, where the property that is the subject of that coverage is a covered property.</text></paragraph></subsection><subsection id="HD84D6B5B9A58468B8AF039FE38D61F55"><enum>(b)</enum><header>Pilot program</header><paragraph commented="no" display-inline="no-display-inline" id="H6F7845D6F7834DADAC2BCF7912DCD770"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Administrator shall establish a pilot program that uses covered data to—</text><subparagraph id="H5246BD6651F0424E84219A30ACA0B9C0"><enum>(A)</enum><text>increase the speed with which claims payments under the national flood insurance program are delivered to eligible policyholders;</text></subparagraph><subparagraph id="HA3D0F38D42E94B01B4CC6453E902EB28"><enum>(B)</enum><text display-inline="yes-display-inline">increase the amount, and enhance the delivery, of advance claims payments under the national flood insurance program made to eligible policyholders; and</text></subparagraph><subparagraph id="HD5136DCF2FED4B0B8D1E36E27E66D8BD"><enum>(C)</enum><text>further explore how covered data can be used to enhance customer service and efficiency with respect to the claims process under the national flood insurance program.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF33C412E7A16455B9A42CD3AE75D857C"><enum>(2)</enum><header>Termination</header><text>The pilot program established under paragraph (1) shall terminate on the date that is 1 year after the date on which the Administrator establishes the pilot program.</text></paragraph></subsection><subsection id="HEE000DB5F68F4CCE9F12A3000364E8E9"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the pilot program established under subsection (b) terminates, the Administrator shall submit to Congress a report that describes any measurable changes that such pilot program has had on— </text><paragraph commented="no" display-inline="no-display-inline" id="HD3F6237AF9034A40855594C2C7CDC6FF"><enum>(1)</enum><text display-inline="yes-display-inline">administrative costs with respect to the national flood insurance program; or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBDA0DEBE956C4A628D314D0DF714862E"><enum>(2)</enum><text display-inline="yes-display-inline">the timeliness with which the Administrator pays claims under the national flood insurance program.</text></paragraph></subsection><subsection id="HDADEF7FAE1C54CBDB7ED43979A44A72B"><enum>(d)</enum><header>Overpayment forgiveness</header><text display-inline="yes-display-inline">Notwithstanding any provision of section 1310, the Administrator may use amounts in the National Flood Insurance Fund to forgive any amounts overpaid to an eligible policyholder as a result of a pre-inspection advance payment provided under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
