such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Financing Energy Efficient Manufacturing Program at the Department of Energy to provide financial assistance to promote energy efficiency and onsite renewable technologies in manufacturing facilities, and for other purposes.</official-title></form><legis-body id="H2097DF3786C34339931822BA30BFF1FC" style="OLC"><section section-type="section-one" id="H9CBFC63D472E49B0AF6582D048749EAA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Job Creation through Energy Efficient Manufacturing Act</short-title></quote>.</text></section><section id="H94E5B84D47E24FC493B8BE0CECDF3C5D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H2EFD1712D014496B96C2BDA98570C15C"><enum>(1)</enum><header>Energy management plan</header><text>The term <term>energy management plan</term> means a plan established under section 3(c)(5).</text></paragraph><paragraph id="H8FB88E107380409890384829ACF10E5B"><enum>(2)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HB6CC0B8E8DE84CF5A7DE6143EAA30625"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the Financing Energy Efficient Manufacturing Program established under section 3(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE28F22CC316840218E60EE35AFA44E18"><enum>(4)</enum><header>Program manager</header><text>The term <term>program manager</term> means a qualified entity that receives a grant under section 3(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF7DE91C3F882434BB34B09EAE9F3495E"><enum>(5)</enum><header>Project</header><text>The term <term>project</term> means an energy efficiency improvement project carried out by a small- or medium-sized manufacturer using grant funds distributed by a program manager.</text></paragraph><paragraph id="HBB7A877DB9D4483C80A5EFCE339ECF3A"><enum>(6)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means—</text><subparagraph id="H74C0995D9FC2455E99CD97F0C5E92659"><enum>(A)</enum><text>a State energy office;</text></subparagraph><subparagraph id="H0D3C849FD21D442B82194BE518989B81"><enum>(B)</enum><text>an Indian tribe;</text></subparagraph><subparagraph id="H37E56DA8704542AFB38337E53F4359C1"><enum>(C)</enum><text>a nonprofit organization that—</text><clause id="HC566358352DA40E2BA0F71C46FE52F2E"><enum>(i)</enum><text>is focused on providing energy efficiency or renewable energy services; and</text></clause><clause id="H632F96BC59B843D2ABF416AC8FDBFEDD"><enum>(ii)</enum><text>receives funding from a State, Indian tribe, or utility;</text></clause></subparagraph><subparagraph id="H7B23A425CED549F6B0AC26CFF13A9E37"><enum>(D)</enum><text>an electric cooperative group; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2A865249AEB54D71B8BE4C5574E921FD"><enum>(E)</enum><text>an entity with a public-private partnership under the Hollings Manufacturing Extension Partnership established under section 25(b) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k(b)</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C871978E2CE49A6914B72E6757E1FAB"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF87A9F0357634EE59958BAAB440DA578"><enum>(8)</enum><header>Small- or medium-sized manufacturer</header><text>The term <term>small- or medium-sized manufacturer</term> means a manufacturing establishment—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3D9B1D6032AE465E8846E4432A1673D9"><enum>(A)</enum><text>classified in Sector 31, 32, or 33 in the North American Industry Classification System; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE868DE03EC2C4253949B49D5F7F6CF00"><enum>(B)</enum><text>that employs not more than 750 employees.</text></subparagraph></paragraph></section><section id="HA5399F8BDF0048F8BCD809239EF23352"><enum>3.</enum><header>Financing Energy Efficient Manufacturing Program</header><subsection id="H6A9A00D0586844D49DC960125CFB5BC2"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a program, to be known as the <quote>Financing Energy Efficient Manufacturing Program</quote> to provide grants to qualified entities to fund energy efficiency improvement projects in the manufacturing sector.</text></subsection><subsection id="H9F442931507D4C17B25311E7E7E09CFB"><enum>(b)</enum><header>Grant applications; selection of grant recipients</header><paragraph id="HC820FBF6A47B4FCEA2CCE1F31C273B51"><enum>(1)</enum><header>Grant applications</header><subparagraph id="H47FBD4A55F4641128E42800413117BDB"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, qualified entities desiring a grant under subsection (a) shall submit to the Secretary an application in such manner and containing such information as the Secretary may require, including a description of—</text><clause id="H71B0BC3482DE4676A00F2ADB460366AB"><enum>(i)</enum><text>how the qualified entity will work with small- and medium-sized manufacturers to assess the most promising opportunities for energy efficiency improvements;</text></clause><clause id="H5C6E1ECE3CB34193A9D8647354A7673F"><enum>(ii)</enum><text>how the qualified entity will work with small- and medium-sized manufacturers and, if appropriate, licensed engineers to establish an energy management plan for the small- or medium-sized manufacturer to carry out a project;</text></clause><clause id="H9FCB9AE421CD4EAA815F2B83D66BABF8"><enum>(iii)</enum><text>the methods and cost-sharing plans the qualified entity will use to distribute funds to small- and medium-sized manufacturers to subsidize the costs of carrying out a project;</text></clause><clause id="H862FBAD068004DF18EE1DC556F93AEA8"><enum>(iv)</enum><text>the standards by which the qualified entity will set energy efficiency goals for a project that will result in meaningful reductions in electricity or natural gas use by the small- or medium-sized manufacturer carrying out the project;</text></clause><clause id="HB283423195A940A2B71E0FB5EB4AC042"><enum>(v)</enum><text>how the qualified entity will provide support to the small- or medium-sized manufacturer carrying out a project during the implementation of the energy management plan;</text></clause><clause id="HC3923E81E2464D0787A3548CFB3A3F4E"><enum>(vi)</enum><subclause commented="no" display-inline="yes-display-inline" id="HA65BA3A15293443BB64F6E06698D97ED"><enum>(I)</enum><text>any history of the qualified entity of working collaboratively with the regional technical assistance programs of the Department of Energy; and</text></subclause><subclause id="H9CDB8DA3178F49F884CD854C7752C3BB" indent="up1"><enum>(II)</enum><text>how the qualified entity plans to involve the regional technical assistance programs in the activities to be funded by a grant; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H842292F1E99E4AEE96FF2F8171B2833B"><enum>(vii)</enum><text>how the qualified entity will collect measurements throughout the implementation of the energy management plan—</text><subclause commented="no" display-inline="no-display-inline" id="H26661B9A13464C358AA63CF3D8875CDD"><enum>(I)</enum><text>to demonstrate how energy efficiency improvements are being achieved; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF4D1B0E0C1CD4F4CA7BE35E9DFCD6FD0"><enum>(II)</enum><text>to maximize opportunities for project success.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7E9F5540790943E5A2E4F26020536E9F"><enum>(B)</enum><header>Partnerships</header><text>Two or more qualified entities may form a partnership to apply, and act as program manager, for a grant under this subsection.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3BAE7D0C6FD540369AF8B43CD6BF5978"><enum>(2)</enum><header>Selection of grant recipients</header><subparagraph commented="no" display-inline="no-display-inline" id="H2FCEFE3D0F6846C1AA3598361C41DC65"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date on which the Secretary receives an application under paragraph (1), the Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="H3556DC30AC72469CAD8DA5B802EDE341"><enum>(i)</enum><text>review the application;</text></clause><clause commented="no" display-inline="no-display-inline" id="HDB013793646E44E5AAAEB1FB349A5B70"><enum>(ii)</enum><text>provide the applicant with an opportunity to respond to any questions of the Secretary regarding the application; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H58754393A7B44B6F86753D94B1CF508D"><enum>(iii)</enum><text>select or deny the applicant based on the criteria described in subparagraph (B).</text></clause></subparagraph><subparagraph id="H332961A073394082A48141DEFC867536"><enum>(B)</enum><header>Selection criteria</header><clause id="H1C6B1F8B79BF4B8088C188EEF2B6FDB1"><enum>(i)</enum><header>In general</header><text>The Secretary shall select for grants under this subsection qualified entities that demonstrate a history of successfully implementing energy efficiency improvement programs for small- and medium-sized manufacturers.</text></clause><clause id="H05A031B6FBE84421971E07E0E3D53101"><enum>(ii)</enum><header>Priority</header><text>In making selections under clause (i), the Secretary shall give priority to qualified entities that demonstrate—</text><subclause id="HC03F4D42EB4A46BEA6C7BF342955D8E5"><enum>(I)</enum><text>effective methods for reducing barriers to entry that might otherwise prevent small- and medium-sized manufacturers from participating in the subgrant program under subsection (c);</text></subclause><subclause id="HFAFD9D28D3AE41A3BF6EA0D72BC9D007"><enum>(II)</enum><text>flexibility in addressing the needs of different small- and medium-sized manufacturers; and</text></subclause><subclause id="HF966BA731F75408EAE02E07A0119D8FE"><enum>(III)</enum><text>a commitment to hiring for projects contractors that comply with the labor requirements described in subsection (d)(2).</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="HC0F2D5F7DE0743EB8E76392F5B2FB151"><enum>(c)</enum><header>Subgrants for energy efficiency improvements</header><paragraph id="H840CB83C14EF4B8296B1DC364E495EAE"><enum>(1)</enum><header>In general</header><text>A qualified entity (including a partnership of one or more qualified entities under subsection (b)(1)(B)) that receives a grant under subsection (a) shall act as a program manager to distribute subgrants to small- and medium-sized manufacturers located in the State in which the program manager is located to carry out projects—</text><subparagraph id="H7D851E739D504B6BB1F949C0D60FC8AF"><enum>(A)</enum><text>to improve the energy efficiency of the small- or medium-sized manufacturer; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H55457FB9AF9C4032BF45773E888033B9"><enum>(B)</enum><text>to develop technologies to reduce electricity or natural gas use by the small- or medium-sized manufacturer.</text></subparagraph></paragraph><paragraph id="HA24352079ECB4E69B1E6171E7D901EAA"><enum>(2)</enum><header>Applications</header><text>A small- or medium-sized manufacturer desiring a subgrant under paragraph (1) shall submit to the program manager an application at such time, in such manner, and containing such information as the program manager may require, including a proposal describing the project to be carried out using the subgrant funds.</text></paragraph><paragraph id="HC4B5291B1CEC45AEA81807C4B517FD98"><enum>(3)</enum><header>Priority</header><text>In selecting small- or medium-sized manufacturers for subgrants under this subsection, the program manager shall give priority to small- or medium-sized manufacturers that commit to hiring for projects contractors that comply with the labor requirements described in subsection (d)(2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCCAE1690798D44C2B14BCBCF063C71C4"><enum>(4)</enum><header>Eligibility requirements</header><text>To be eligible to receive a subgrant under paragraph (1), a small- or medium-sized manufacturer shall be a private, nongovernmental entity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCDB19A4E3E1B4A3299A45794713EAC04"><enum>(5)</enum><header>Energy management plans</header><text>Each small- or medium-sized manufacturer receiving a subgrant under paragraph (1), in consultation with the program manager and, if appropriate, one or more licensed engineers, shall establish an energy management plan for the small- or medium-sized manufacturer to carry out the project.</text></paragraph><paragraph id="H06ADDD7B68A147B6AD2D661E6133E538"><enum>(6)</enum><header>Effect on title to property</header><text>The receipt of Federal funds under this subsection shall not prohibit an entity that purchased equipment or other property using those funds from owning sole, permanent title to the equipment or other property.</text></paragraph></subsection><subsection id="H0AD566CF63E2457EBCD4839358B7E606"><enum>(d)</enum><header>Contractors</header><paragraph id="H90B4148FDA0E4390A33C2A6A1A7FCCB6"><enum>(1)</enum><header>In general</header><text>Program managers and small- or medium-sized manufacturers may hire, if necessary, contractors to perform work relating to the installation, repair, or maintenance of equipment used under a project.</text></paragraph><paragraph id="H0DB7D63924F34A00AC573533EC6A4C75"><enum>(2)</enum><header>Labor requirements</header><text>In an application for a grant or subgrant under this section, a program manager or a small- or medium-sized manufacturer, respectively, may commit to hiring contractors that represent to the best of the knowledge and belief of the contractor, whether, during the 3-year period preceding the date of application, any administrative merits determination, arbitral award or decision, or civil judgment (as defined in guidance issued by the Secretary of Labor) was rendered against the contractor for violations of—</text><subparagraph id="H2CAA3DD87E4348D4BB74AA579E047A26"><enum>(A)</enum><text>the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>);</text></subparagraph><subparagraph id="H1C0F5635EBE8421E8669A3394BECE68D"><enum>(B)</enum><text>the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>);</text></subparagraph><subparagraph id="H5C7F4954BECB43F38E1DF43E8F964415"><enum>(C)</enum><text>the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/621">29 U.S.C. 621 et seq.</external-xref>);</text></subparagraph><subparagraph id="H3E99F7BC952C47E9B7629AD788666208"><enum>(D)</enum><text>the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>);</text></subparagraph><subparagraph id="H0B9A178C0175445E8779148E05816DAE"><enum>(E)</enum><text>the Migrant and Seasonal Agricultural Worker Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1801">29 U.S.C. 1801 et seq.</external-xref>);</text></subparagraph><subparagraph id="H8CBEBFE9529A4C7CA5407DCFC0FBEC83"><enum>(F)</enum><text>the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611 et seq.</external-xref>);</text></subparagraph><subparagraph id="H1EEF241E4EA640BD8FE2E53648F40CA0"><enum>(G)</enum><text>subchapter IV of chapter 31 of part A of subtitle II of title 40, United States Code (commonly referred to as the <quote>Davis-Bacon Act</quote>);</text></subparagraph><subparagraph id="HBCFF9AFA4E084CC1A14E8D3A3401B499"><enum>(H)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/67">chapter 67</external-xref> of title 41, United States Code;</text></subparagraph><subparagraph id="HCB380A35564B4235B1EFAD64479EFC1B"><enum>(I)</enum><text>title VII of the <act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB52776747C5C4336A34637619DA6B0C0"><enum>(J)</enum><text>the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>);</text></subparagraph><subparagraph id="H8F76BE13E2344A1E9328172634E1CB79"><enum>(K)</enum><text>Executive Order 11246 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> note) (relating to equal employment opportunity);</text></subparagraph><subparagraph id="H5BE156D30DB443CAB8B8735DDFDFF418"><enum>(L)</enum><text>Executive Order 13658 (79 Fed. Reg. 9851 (February 20, 2014)) (relating to establishing a minimum wage for contractors); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2EB577E963174241926ED9B0FE8BD878"><enum>(M)</enum><text>equivalent State laws.</text></subparagraph></paragraph><paragraph id="H3BF5B8E2E66A444A97BDCD2FE89F1EE2"><enum>(3)</enum><header>Additional labor requirements</header><text>A program manager or small- or medium-sized manufacturer receiving a grant or subgrant, respectively, under this section that has committed to complying with the labor requirements described in paragraph (2)—</text><subparagraph id="H36CD84BB3FCB41E89476CF300426DC9D"><enum>(A)</enum><text>shall provide each contractor an opportunity to disclose any steps taken to correct a violation of, or improve compliance with, a law or Executive order described in any of subparagraphs (A) through (M) of paragraph (2), including any agreements entered into with an enforcement agency;</text></subparagraph><subparagraph id="H68FA3116619D43859B2B22D4ACAC9624"><enum>(B)</enum><text>shall give preference to contractors that have the fewest number of violations (particularly serious, repeated, willful, or pervasive violations) of the laws and Executive orders described in subparagraphs (A) through (M) of paragraph (2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H596F8BB2390D42B4A38D8EE0CDC04F17"><enum>(C)</enum><text>shall not hire contractors that fail to take steps to correct violations of, or improve compliance with, a law or Executive order described in any of subparagraphs (A) through (M) of paragraph (2).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB8F90E85FA0943B88A790763F9931777"><enum>(e)</enum><header>American iron, steel, and manufactured products</header><paragraph id="HDE60CC93589543419A9AF0F2C1CCBDC5"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HD3C292D0E2D84CA581B0A9E6EB0AA029"><enum>(A)</enum><header>Iron or steel manufactured product</header><text>The term <term>iron or steel manufactured product</term> includes any construction material or end product (as those terms are defined in subpart 25.003 of the Federal Acquisition Regulation) that does not otherwise qualify as an iron or steel product, including—</text><clause id="H05C3C28880994A9EB98A9F88D83E6ABC"><enum>(i)</enum><text>an electrical component;</text></clause><clause id="HC1BCC0AEB60F4DC68B6DC357888D8F23"><enum>(ii)</enum><text>a non-ferrous building material, including—</text><subclause id="HB798DC2FC30E4631B1784915A77E14E9"><enum>(I)</enum><text>aluminum and polyvinyl chloride;</text></subclause><subclause id="HF654E76BD17C422CBC9A87E8E01BB832"><enum>(II)</enum><text>glass;</text></subclause><subclause id="H43CEA07299D84C6A9B8DC82F7434D276"><enum>(III)</enum><text>fiber optics;</text></subclause><subclause id="H8936E40359224E6BA20AF924F41CD81B"><enum>(IV)</enum><text>plastic;</text></subclause><subclause id="H5F8B2C5EE87C4C40A40CCAFFCAB63FD8"><enum>(V)</enum><text>wood;</text></subclause><subclause id="H1E0EDF09A0AE4C128313D7462FD5B974"><enum>(VI)</enum><text>masonry;</text></subclause><subclause id="HD6A36535D8CD4A89A34601121A496AB1"><enum>(VII)</enum><text>rubber;</text></subclause><subclause id="H025345B3F439421DBCC7A259F7DB75AC"><enum>(VIII)</enum><text>manufactured stone; and</text></subclause><subclause id="HE6BE866DE82849DC93759FE102887872"><enum>(IX)</enum><text>any other non-ferrous building materials; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H66DD94C94ECC41E1AA82C39343681A4B"><enum>(iii)</enum><text>any unmanufactured construction material.</text></clause></subparagraph><subparagraph id="HB38A76AEED044FBDA9E8E148D8FC5DDF"><enum>(B)</enum><header>Produced in the United States</header><clause id="HCE6E06C61C374281B8DAE0E60301330F"><enum>(i)</enum><header>In general</header><text>The term <term>produced in the United States</term>—</text><subclause id="H4D3BF2E39FFD4EB0AF81796F7505616C"><enum>(I)</enum><text>with respect to an iron or steel product or an iron or steel manufactured product, means that all manufacturing processes for, and materials and components of, the iron or steel product or iron or steel manufactured product, from the initial melting stage through the application of coatings, occurred in the United States; and</text></subclause><subclause id="HC4CF061057DD47F78A15BF4A14C2B129"><enum>(II)</enum><text>with respect to an iron or steel manufactured product, means that—</text><item id="H09782820108A456CA0E5B4B038A40466"><enum>(aa)</enum><text>the iron or steel manufactured product was manufactured in the United States; and</text></item><item id="H253B04E13B2E48E1A582A0A10D1B0E42"><enum>(bb)</enum><text>the cost of the components of the iron or steel manufactured product that were mined, produced, or manufactured in the United States is greater than 60 percent of the total cost of the components of the iron or steel manufactured product.</text></item></subclause></clause><clause id="HC9B54B71F8344A678D6EAA1EEC8DEF34"><enum>(ii)</enum><header>Exclusions</header><text>The term <term>produced in the United States</term>, with respect to an iron or steel product or an iron or steel manufactured product, does not include an iron or steel product or an iron or steel manufactured product that was manufactured—</text><subclause id="H127F91529BE04039B1C0AC900106D370"><enum>(I)</enum><text>abroad from semi-finished steel or iron from the United States; or</text></subclause><subclause id="H6E21EB93608849F487E96442D886EA9D"><enum>(II)</enum><text>in the United States from semi-finished steel or iron of foreign origin.</text></subclause></clause></subparagraph></paragraph><paragraph id="HF5FD8183D1B543FB89ADF046CD43B983"><enum>(2)</enum><header>Requirement</header><text>Funds made available under the program may not be used for a project unless all of the iron and steel products and iron and steel manufactured products used in the project are produced in the United States.</text></paragraph><paragraph id="HE20A0AC1BA8343B2929E317BED1D2A57"><enum>(3)</enum><header>Waiver</header><subparagraph id="HBBA01B4249DD4CFEB4FBFA113A6913E1"><enum>(A)</enum><header>In general</header><text>On request of the recipient of a grant under the program, the Secretary may grant for the project of the recipient of the grant a waiver of the requirement described in paragraph (2) if the Secretary finds that—</text><clause id="HF0DFAFB19A4A4C698EA3E4770FF5DA30"><enum>(i)</enum><text>the application of paragraph (2) would be inconsistent with the public interest;</text></clause><clause id="H656E2F6849D94500BB33E49963532EC4"><enum>(ii)</enum><text>iron or steel products or iron or steel manufactured products are not produced in the United States—</text><subclause id="H1E68321847CF4D50AE84251FC16050F5"><enum>(I)</enum><text>in sufficient and reasonably available quantities; or</text></subclause><subclause id="HCE3CD2BD8FBD414E86C06E261F090F57"><enum>(II)</enum><text>of a satisfactory quality; or</text></subclause></clause><clause id="HB023DAF5B01A43A6BFABB575B47E9160"><enum>(iii)</enum><text>the inclusion of iron or steel products or iron or steel manufactured products produced in the United States would increase the cost of the overall project by greater than 25 percent.</text></clause></subparagraph><subparagraph id="HAEB686741E334AFEAE43BFDEF04C7B7D"><enum>(B)</enum><header>Public notice</header><text>On receipt of a request for a waiver under subparagraph (A), the Secretary shall—</text><clause id="H3221C4AEBEE3479881666090C71E534A"><enum>(i)</enum><text>make available to the public, including by electronic means, including on the official public website of the Department of Energy, on an informal basis, a copy of the request and all information available to the Secretary relating to the request; and</text></clause><clause id="HD66D029B4F8E40DB8A433228E5F9D13B"><enum>(ii)</enum><text>provide for informal public input on the request for a period of not fewer than 15 days before making with respect to the request the finding described in subparagraph (A).</text></clause></subparagraph></paragraph></subsection><subsection id="H3D18D148C7974C8AB9C0976AA4C40B97"><enum>(f)</enum><header>Reporting requirements</header><paragraph id="HEC045723251144FBBB009CB20AF2F56F"><enum>(1)</enum><header>In general</header><text>Each program manager shall—</text><subparagraph id="HAE5D79E7224A4D51A9EF8E718C74D1E5"><enum>(A)</enum><text>determine what data shall be required—</text><clause id="H3237446393924BF9AD91AFA7640B6B04"><enum>(i)</enum><text>to be collected by or from each small- or medium-sized manufacturer receiving a subgrant under subsection (c); and</text></clause><clause id="HE717AB4C247F44748D61875E7AC640BF"><enum>(ii)</enum><text>to be submitted to the program manager to permit analysis of the subgrant program under subsection (c); and</text></clause></subparagraph><subparagraph id="H299DDF096831434A81F1C4B481FFCD0C"><enum>(B)</enum><text>develop metrics to determine the success of the subgrant program under subsection (c).</text></subparagraph></paragraph><paragraph id="HCC267A011BA04B02BCFE2E7EE046FD63"><enum>(2)</enum><header>Provision of data</header><text>As a condition of receiving a subgrant under subsection (c), a small- or medium-sized manufacturer shall provide to the program manager relevant data, as determined by the program manager under paragraph (1)(A).</text></paragraph><paragraph id="H85C43656B67E459CAA6FDB59A3CBD96C"><enum>(3)</enum><header>Proprietary information</header><text>In carrying out this subsection, each program manager, as appropriate, shall provide for the protection of proprietary information and intellectual property rights.</text></paragraph></subsection><subsection id="H393511DD1C08430F99C7CC9CF0FBA11B"><enum>(g)</enum><header>Funding</header><paragraph id="HA99436B551114FC9814F11BBB654EDE1"><enum>(1)</enum><header>In general</header><text>Out of amounts made available to the Secretary and not otherwise obligated, the Secretary shall use to carry out this section not more than $600,000,000.</text></paragraph><paragraph id="H3ED018315D5A43D0B00ED20425B989C1"><enum>(2)</enum><header>Requirements for program managers</header><text>A program manager shall use not greater than 7 percent of the grant funds received by the program manager, at the discretion of the program manager—</text><subparagraph id="HE84A5344B1A14F798EC5D18AD5DDD2E8"><enum>(A)</enum><text>to hire and train staff to assist the program manager in administering the sub­grant program of the program manager; and</text></subparagraph><subparagraph id="HE1366192CB12444E918B91444B7E0C97"><enum>(B)</enum><text>to market the subgrant program to small- and medium-sized manufacturers.</text></subparagraph></paragraph><paragraph id="H6EB5EC4CF9F14698AEF3748B67259BDF"><enum>(3)</enum><header>Management and oversight</header><text>The Secretary may use not greater than 0.25 percent of the funds made available under paragraph (1) to carry out subsection (e).</text></paragraph></subsection></section></legis-body></bill>
