Russell National School Lunch Act to improve the child and adult care food program, and for other purposes.</official-title></form><legis-body id="H0F9CC0FC541542A594379F430C678BF5" style="OLC"><section id="HEFB46C70290F4EB380710090BFC4EA51" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Childhood Nutrition Improvement Act</short-title></quote>.</text></section><section id="H020440CE696A48D5A0E74C85448C1859"><enum>2.</enum><header>Eligibility certification criteria for proprietary child care centers</header><text display-inline="no-display-inline"> Section 17(a)(6) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(a)(6)</external-xref>) is amended—</text><paragraph id="HDBA9C5C3E6EC4A119CD76C3053732419"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>criteria:</quote> and inserting <quote>criteria—</quote>; </text></paragraph><paragraph id="H359A08DADC3F45E9B936D4310774F082"><enum>(2)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H1DD11132922D4CA1867117387001CDBB"><enum>(3)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H6AB10F01CE334993A9D3D052BA5DD62A"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE5C0EC4EC9084FC59DD0DAB43B1C8F00"><subparagraph id="H4FB211EE3D4941B8AFAAEAA8AA96FC13" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">in the case of an institution described in paragraph (2)(B), the eligibility of such institution shall be determined on an annual basis in accordance with this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HF66AE90943A84CDCBFE3575771AC32A6"><enum>3.</enum><header>Review of serious deficiency process</header><text display-inline="no-display-inline">Section 17(d)(5) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(d)(5)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDB7D096F668C4E5F97E50E9A581C6D38"><subparagraph id="H32BC0596245141CCA0AE06B311E9D6A7"><enum>(F)</enum><header>Serious deficiency process</header><clause id="H5E5A6216BA3C4DD397CAC1F29992B874"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this subparagraph, the Secretary shall review and issue guidance and, as appropriate, regulations regarding the serious deficiency process for the program under this section.</text></clause><clause id="H4B46BE3C5F564BDB8640197A0551BDBD"><enum>(ii)</enum><header>Review</header><text>In carrying out clause (i), the Secretary shall review, at a minimum, the processes for, and those involved in—</text><subclause id="H0F6E01671A1E4C4C9C7F847A73198ACA"><enum>(I)</enum><text>determining when there is a serious deficiency with respect to an institution or a family or group day care home, including—</text><item id="H3D35012A5B9A49ABBDB3A518EE648EA4"><enum>(aa)</enum><text>what measures automatically result in a finding of serious deficiency; and</text></item><item id="H45997C2282564B7AB4BE6B58405F992F"><enum>(bb)</enum><text>how to differentiate between—</text><subitem id="H900AB7A22CD741B1B195BFCD6F5067BF"><enum>(AA)</enum><text>a reasonable margin of human error and systematic or intentional noncompliance; and</text></subitem><subitem id="HA066272326B34E0481A668FFF990C3C4"><enum>(BB)</enum><text>State-specific requirements and Federal regulations;</text></subitem></item></subclause><subclause id="H2006653A77D44735B2773F88095B7F78"><enum>(II)</enum><text>appealing and mediating a finding of serious deficiency with respect to an institution or a family or group day care home, including—</text><item id="HB281EECD2C6F41C089777066E4942F82"><enum>(aa)</enum><text>findings related to State-specific requirements; and</text></item><item id="HF6C29A52635F408B9A02170AFFBA9616"><enum>(bb)</enum><text>processes for ensuring officials involved in appeals and mediation are fair and impartial;</text></item></subclause><subclause id="H4216B7EBD3494C24AAC1130D61D3E0F6"><enum>(III)</enum><text>determining the circumstances under which a corrective action plan is acceptable;</text></subclause><subclause id="HE90B00A1A5D94AEE8A98090DA8418036"><enum>(IV)</enum><text>termination and disqualification, including maintenance of the list under subparagraph (E); and</text></subclause><subclause id="HABAE869B12B74C0BB39942047F31DA6F"><enum>(V)</enum><text display-inline="yes-display-inline">determining opportunities for strengthening the processes intended to reduce additional State agency requirements on institutions or family or group day care homes that are in addition to those required under Federal law, including—</text><item id="H04822D83A7E44738B33D46FF46AF6823"><enum>(aa)</enum><text>State evaluation of practices used at the time of review;</text></item><item id="H58D6152E570D4760B4CBFDE16F6F0449"><enum>(bb)</enum><text>regional approval of such additional State agency requirements; and</text></item><item id="HA6874378E87B41A6902EAD86DE366AD7"><enum>(cc)</enum><text>oversight through the management evaluation process.</text></item></subclause></clause><clause id="HA1773733660E47AA80AFC4FA2ED7E4C2"><enum>(iii)</enum><header>State-specific requirements</header><text display-inline="yes-display-inline">The Secretary may not consider State-specific requirements in determining non-compliance or serious deficiency.</text></clause><clause id="H1BCECE87D30C42D89544A362C9221DDF"><enum>(iv)</enum><header>Guidance and regulations</header><subclause id="H4DEAD6B93F164E8B98E1E56CF8EDB47C"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">After conducting the review under clause (ii), the Secretary shall make findings from the information collected and issue guidance and, as appropriate, regulations from such findings that will—</text><item id="H7BBCD39AA4CF405BBD830211ACB4EA25"><enum>(aa)</enum><text>streamline and modernize the program;</text></item><item id="H574725735C624706B04896EA8BB22E4B"><enum>(bb)</enum><text>reduce the paperwork burden on parents; and</text></item><item id="H3B5D85A671BB4D17BF4AED46C640BB19"><enum>(cc)</enum><text>assist sponsoring organizations, State agencies, and the Food and Nutrition Service in ensuring a fair, uniform, and effective administration of the serious deficiency process, while retaining program integrity.</text></item></subclause><subclause id="H3A260BD1998A49E69338E720EFA12419"><enum>(II)</enum><header>Scope</header><text>The guidance or, as appropriate, regulations made or issued under subclause (I) shall include—</text><item id="H82EF899BED3540CDBAF1F336FE0B0B0C"><enum>(aa)</enum><text display-inline="yes-display-inline">clarity on the required measures for noncompliance, including—</text><subitem id="H1869AD9536B54E97AD2A336150F11331"><enum>(AA)</enum><text display-inline="yes-display-inline">an allowance for a reasonable margin of human error; and</text></subitem><subitem id="HDE64BEEA6D074B4C8101D86D86DF3199"><enum>(BB)</enum><text>a distinction between a reasonable margin of human error and systematic or intentional noncompliance;</text></subitem></item><item id="H1BC54998B10641C598A9A047A0F66E89"><enum>(bb)</enum><text display-inline="yes-display-inline">a formal appeals and mediation process that—</text><subitem id="HFA5656B05D8E40D78C2D4FB0374DCC7B"><enum>(AA)</enum><text>is conducted by a trained official who is independent from and not affiliated with any person or agency involved in the determination being appealed or mediated; </text></subitem><subitem id="H52E2ED2DA3E846E980F4CFA4B232C7D2"><enum>(BB)</enum><text>provides an opportunity for a fair hearing for any institution or family or group day care home determined to have a serious deficiency finding or inadequate corrective action plan; and</text></subitem><subitem id="H5878DCD96C7A49F88B3F0F761186E1B3"><enum>(CC)</enum><text>provides for the evaluation and resolution of disputes over State agency requirements on institutions or family or group day care homes that are in addition to those required under Federal law;</text></subitem></item><item id="HC3C020DBF6D34389A878883910805E87"><enum>(cc)</enum><text>timeframes for acceptable corrective action plans for group or family day care homes that are consistent with corrective action timeframes for child care centers; and</text></item><item id="H8124B8573220465EB463C6B5C7722D32"><enum>(dd)</enum><text>a process to dismiss a serious deficiency upon correction of such deficiency.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HE6D00221D0974B7FB1849AF1E821E7B2"><enum>4.</enum><header>Authorization of reimbursements for additional meal or snack</header><text display-inline="no-display-inline">Section 17(f)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(f)(2)</external-xref>) is amended—</text><paragraph id="H5E6EA24DEDC745E880711A8874C56FE3"><enum>(1)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC"><enum-in-header>(2)(A)</enum-in-header></header-in-text> Subject to subparagraph (B) of this paragraph</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H52DAF2964AA948E9A721FFF3899E68F8"><paragraph id="HA56255FFC7E44BE4A0FA857F87DA0112"><enum>(2)</enum><header>Disbursements</header><subparagraph id="HAB41768B7B9D4810915D8BFDA697013B"><enum>(A)</enum><header>In General</header><text display-inline="yes-display-inline">Subject to subparagraph (B)</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H74D6ADB1E23B4BC198DB1DE8BA0A974C"><enum>(2)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H72FC62F982154999B5F4F1B025111354"><subparagraph id="H9DBFE408C6C948D5A5D0B1F87DDD9165"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">No reimbursement may be made to any institution under this paragraph, or to family or group day care home sponsoring organizations under paragraph (3), for more than—</text><clause id="HFEEDE72ADD8F4BCCB31D73722255D03E"><enum>(i)</enum><text display-inline="yes-display-inline">2 meals and 1 supplement or 1 meal and 2 supplements per day per child; or</text></clause><clause id="H31D162E474394B3F84446BAEB44E8A61"><enum>(ii)</enum><text display-inline="yes-display-inline">3 meals and 1 supplement or 2 meals and 2 supplements per day per child, in the case of child care during which there are 8 or more hours between the beginning of the first meal service period and the beginning of the fourth meal service period.</text></clause></subparagraph><subparagraph id="HA263AB094BC1440EBD292947BFA2508C"><enum>(C)</enum><header>Study on third meal</header><text>The Secretary shall—</text><clause id="HF212768B8473464A9B14B02A85099F16"><enum>(i)</enum><text display-inline="yes-display-inline">conduct a study, not later than 2 years after the date of the enactment of this subparagraph, on—</text><subclause id="H4AAC7FD8776342B9A7CD5D1B60C9756C"><enum>(I)</enum><text>the prevalence of third meal reimbursement by program operators;</text></subclause><subclause id="H323B3ECD5D784F35B60246FB34A265FE"><enum>(II)</enum><text>the role of the additional meal in effectively supporting working families;</text></subclause><subclause id="HA46756D2FC074595A4CCB1653572767F"><enum>(III)</enum><text>the contribution of the additional meal to the local economy; and</text></subclause><subclause id="HEDD7D06435524B54BCB1CF8C89C8AC9F"><enum>(IV)</enum><text display-inline="yes-display-inline">the contribution of the additional meal to the economic viability of child care and afterschool programs, including in rural areas;</text></subclause></clause><clause id="HB508AF906A574663A38FA89D2F960A54"><enum>(ii)</enum><text display-inline="yes-display-inline">submit a report to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Education and the Workforce of the House of Representatives that includes the findings of the study required under clause (i); and</text></clause><clause id="H759636EA1E71437C89FC124545C8E6D9"><enum>(iii)</enum><text display-inline="yes-display-inline">based on the findings of such report, provide guidance to program operators to—</text><subclause id="H12D0E06185E84C719101B9C908284339"><enum>(I)</enum><text>improve implementation of the program under this section;</text></subclause><subclause id="H3954EA73DB63433C919D68D79F51B06D"><enum>(II)</enum><text>maximize the utility of the additional meal in supporting working families; and</text></subclause><subclause id="HFCC9637450FF45B695CC1047A0D121E0"><enum>(III)</enum><text>limit unnecessary costs to program operators and parents of participating children.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H7F0C86352A1C4C1288387F94CDAD3B0A"><enum>5.</enum><header>Adjustments</header><text display-inline="no-display-inline">Section 17(f)(3)(A) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(f)(3)(A)</external-xref>) is amended by striking <quote>Consumer Price Index for food at home</quote> each place it appears and inserting <quote>Consumer Price Index for food away from home</quote>.</text></section><section id="H6943209A0719483BB61616B70923BFF3"><enum>6.</enum><header>Advisory committee on paperwork reduction</header><text display-inline="no-display-inline">Section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1D356793F8BD4BE18898ED20F2D78D84"><subsection id="H28F9EC6923694C698E40C444F3EB4283"><enum>(v)</enum><header>Advisory committee on paperwork reduction</header><paragraph id="HEA52B3E011514E3ABFF9DB0B2CEC4A30"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this subsection, the Secretary shall establish an advisory committee (referred to in this subsection as the <quote>Advisory Committee</quote>) to carry out the duties described in paragraph (2).</text></paragraph><paragraph id="H500298D916E44230B13CCC0940AF6FC2"><enum>(2)</enum><header>Duties</header><text>The duties of the Advisory Committee shall be to—</text><subparagraph id="HBB068F4E5B974589AEC9F5F3C1994922"><enum>(A)</enum><text display-inline="yes-display-inline">examine the feasibility of reducing unnecessary or duplicative paperwork resulting from regulations and recordkeeping requirements, including paperwork resulting from additional State requirements, for those participating or seeking to participate in the program under this section, including State agencies, family child care homes, child care centers, and sponsoring organizations; and</text></subparagraph><subparagraph id="HE299A83450ED4AF9887384B9616766DF"><enum>(B)</enum><text display-inline="yes-display-inline">provide recommendations to the Secretary to reduce such paperwork for participants in the program under this section while ensuring that proper accountability and program integrity are maintained.</text></subparagraph></paragraph><paragraph id="H7F28CDB688F347BDBFAC2275C5E73692"><enum>(3)</enum><header>Membership</header><text>The Advisory Committee shall be composed of not fewer than 14 members, of whom:</text><subparagraph id="HE83675F8B10C4DC2AC6BA7E9702E2C6F"><enum>(A)</enum><text>1 shall be a representative of a public nonprofit center.</text></subparagraph><subparagraph id="HB2F124C89A904A89A131F7010393712C"><enum>(B)</enum><text display-inline="yes-display-inline">1 shall be a representative of a private nonprofit center.</text></subparagraph><subparagraph id="H3A7A0D655B3140EBA7BE59F3E86711C1"><enum>(C)</enum><text display-inline="yes-display-inline">1 shall be a representative of a family or group day care home.</text></subparagraph><subparagraph id="HF001028E40F14F80A545FBD8C94D6BEA"><enum>(D)</enum><text display-inline="yes-display-inline">1 shall be a representative of a Head Start center.</text></subparagraph><subparagraph id="H73B193CD7A9843D38A96FFF57097DDE9"><enum>(E)</enum><text display-inline="yes-display-inline">1 shall be a representative of a for-profit center.</text></subparagraph><subparagraph id="H71ECD1B9A8EA457A80940A45A0254557"><enum>(F)</enum><text display-inline="yes-display-inline">1 shall be a representative of an emergency shelter.</text></subparagraph><subparagraph id="H14EF755C74BF4D8AA6D9080AA15BB18F"><enum>(G)</enum><text display-inline="yes-display-inline">1 shall be a representative of an adult day care center.</text></subparagraph><subparagraph id="HCA35771C1DBA40489FB9EA1FEDEEB4DB"><enum>(H)</enum><text display-inline="yes-display-inline">1 shall be a representative of a State agency.</text></subparagraph><subparagraph id="H051EEC0B1B0141E3AA653F06CF51B989"><enum>(I)</enum><text display-inline="yes-display-inline">1 shall be a representative of a sponsoring organization for the entities referred to in subparagraphs (A), (B), (D), (E), (F), and (G).</text></subparagraph><subparagraph id="HF67F37547E644506A23A6B23B3679434"><enum>(J)</enum><text display-inline="yes-display-inline">1 shall be a representative of a sponsoring organization of family or group day care homes.</text></subparagraph><subparagraph id="HCD30A8064E2144A4BC7E716A326AD355"><enum>(K)</enum><text display-inline="yes-display-inline">1 shall be a representative of an anti-hunger advocacy organization.</text></subparagraph><subparagraph id="H26CB3242B84C4174BA5B105227EC0A16"><enum>(L)</enum><text display-inline="yes-display-inline">1 shall be a representative of an at-risk, after school program.</text></subparagraph><subparagraph id="H055E070F6DB842939DCDE7685143F265"><enum>(M)</enum><text display-inline="yes-display-inline">1 shall be a representative of a child care advocacy organization.</text></subparagraph><subparagraph id="H64146078D2D5493B98C86BE364D314D6"><enum>(N)</enum><text display-inline="yes-display-inline">1 shall be a representative of an advocacy organization representing parents with young children.</text></subparagraph></paragraph><paragraph id="H9FC97989D2514AD8A3152D1AF87464B1"><enum>(4)</enum><header>Considerations</header><text>In developing the recommendations described in paragraph (2)(B), the Advisory Committee shall consider—</text><subparagraph id="H3AC6A4C781084990B40BADBCFA94DFD8"><enum>(A)</enum><text>information, recommendations, and reports from the Paperwork Reduction Work Group established by the Food and Nutrition Service pursuant to section 119(i) of the Child Nutrition and WIC Reauthorization Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/265">Public Law 108–265</external-xref>; 118 Stat. 755); </text></subparagraph><subparagraph id="HD3F785E8FB71427A9E7F7990A5AE2904"><enum>(B)</enum><text>the use of electronic systems and recordkeeping technologies to reduce paperwork for program participants and program operators; and</text></subparagraph><subparagraph id="H650FBE33B46746CA8BA1C689FFE664D8"><enum>(C)</enum><text display-inline="yes-display-inline">duplicative requirements across multiple Federal programs.</text></subparagraph></paragraph><paragraph id="H63DF06320ED541748C65787040FDD498"><enum>(5)</enum><header>Guidance and regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this subsection, the Secretary shall issue guidance and, as appropriate, regulations based on the recommendations described in paragraph (2)(B) for streamlined and consolidated paperwork and recordkeeping requirements for the program, including recommendations and actions taken to reduce paperwork for parents and program operators by—</text><subparagraph id="H0062473EE88C40B887A6879F4288660D"><enum>(A)</enum><text>streamlining and modernizing applications; and</text></subparagraph><subparagraph id="HF8FA21C42FAE497794DA454BD53E145C"><enum>(B)</enum><text>streamlining and modernizing the monitoring and auditing of programmatic documentation and recordkeeping, including—</text><clause id="H0FB657660EAC488DB752196344478606"><enum>(i)</enum><text>eliminating the use of the enrollment form for the purpose of claiming meals;</text></clause><clause id="H29B9EE2A6D26477DAAC59317576A6828"><enum>(ii)</enum><text>allowing the use of direct certification in all States;</text></clause><clause id="H1D6C7BF2234546E2BCBF44359751A683"><enum>(iii)</enum><text>requiring States to accept as documentation digital forms, digitized and electronic signatures, and electronic records;</text></clause><clause id="HEB3804C51C664103960E8EBCB597F745"><enum>(iv)</enum><text>allowing the use of electronic data collection systems containing all required Federal child and adult care food program standards;</text></clause><clause id="H59D4615E56324EB8B64F7DAE939E9738"><enum>(v)</enum><text>addressing non-mandated State-specific requirements; and</text></clause><clause id="H7F22BB893B4B4F2C9EE93E087A77FE64"><enum>(vi)</enum><text>requiring the adoption of generally accepted technologies for client-facing technology, virtual visits, and technology used for administrative functions by the child and adult care food program to reduce the burden on participants and program operators and administrators.</text></clause></subparagraph></paragraph><paragraph id="H242D46F3BC6E4C4BA7F6C14D72B96ACF"><enum>(6)</enum><header>Report</header><subparagraph id="H42AAEFF4E5AD4CF3A07278C6C566BB21"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after issuing the guidance and, as appropriate, regulations described in paragraph (5), the Secretary shall submit a report to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Education and the Workforce of the House of Representatives containing the information described in subparagraph (B).</text></subparagraph><subparagraph id="HC0ABF66143B14860B23C1A6F6EAB468F"><enum>(B)</enum><header>Contents</header><text>The report under subparagraph (A) shall contain the following:</text><clause id="HB38AFABBB41449E39063C96D916BF0F5" commented="no"><enum>(i)</enum><text>With respect to each instance in which the Secretary did not implement a recommendation of the Advisory Committee, an explanation with respect to why such recommendation was not implemented.</text></clause><clause id="H1ADF8A9148B641C28E5116963A71C8EB"><enum>(ii)</enum><text>Additional recommendations with respect to legislative action that may further strengthen and streamline the program application and monitoring process and reduce administrative burdens on grantees, program participants, and local, State, and Federal governments.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
