R. 6035</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231024">October 24, 2023</action-date><action-desc><sponsor name-id="S001223">Mrs. Sykes</sponsor> introduced the following bill</action-desc></action><action display="yes"><action-date date="20231025">October 25, 2023</action-date><action-desc>Referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To criminalize stalking using an unauthorized geotracking device.</official-title></form><legis-body id="H6626201F765E40C493E6AA17E0A7A6D8" style="OLC"><section id="HCECB0142B795458CBE5D5EB875008482" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Electronic Stalking Act</short-title></quote>.</text></section><section id="HD934A1EFF2F749AE934073567CD23CFF"><enum>2.</enum><header>Stalking penalty</header><text display-inline="no-display-inline">Section 2261A of title 18, United States Code, is amended—</text><paragraph id="H0FC60F6E9E144F67B358724CF0C75CA8"><enum>(1)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>(a) <header-in-text level="subsection" style="USC">In general.—</header-in-text>Whoever</quote>;</text></paragraph><paragraph id="H62C2564572894228999DF4FD60DC1BC0"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after <quote>uses the mail,</quote> the following: <quote>uses an unauthorized geotracking device</quote>; and</text></paragraph><paragraph id="HCF08BFD998304A70B83B95B6C13FED80"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H01C34716EBF94545962AB2CC690531DE" display-inline="no-display-inline"><subsection id="HAD02767110784DF1B5F0A307893C1127"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H504339CE451C41BCBF3442A1863ECE77"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>geotracking device</quote> means an electronic or mechanical device that permits a person to remotely determine or track the position and movement of another person.</text></paragraph><paragraph id="HAA3328544A384946A5D45E7C32297FCF"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>unauthorized</quote> means, with respect to a geotracking device, that the person on whom the geotracking device is being used has not consented to such use or otherwise revoked consent to such use.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
