<section id="HA88D7741F5304899A49360BFAD6926BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unemployment Integrity Act of 2023</short-title></quote>.</text></section> <section id="H0C42827BE9D149BB85B94F1149454704"><enum>2.</enum><header>Reform of unemployment compensation to promote work</header> <subsection id="HBE1BC44D62BB4A0CA235B2F4FBF70F29"><enum>(a)</enum><header>Interview requirement</header> <paragraph id="H1C8CB8BB0B574CF2BC9BED0B27FE649F"><enum>(1)</enum><header>In general</header><text>Section 303(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/503">42 U.S.C. 503(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="H246E091C48CE4329B61FA067EE60CBAB" display-inline="no-display-inline"> 
<paragraph id="HF7C454DA160245ACB6E21DF1517162BE"><enum>(13)</enum><text display-inline="yes-display-inline">A requirement that, as a condition of eligibility for regular compensation for any week, a claimant must, if requested, in relation to work that may be available—</text> <subparagraph id="HAA693762A771453296707A522DCFEA9C"><enum>(A)</enum><text display-inline="yes-display-inline">respond to requests;</text></subparagraph> 
<subparagraph id="H51D65BAA655E4C0D979B814AD045074C"><enum>(B)</enum><text display-inline="yes-display-inline">schedule and attend an interview and participate in reemployment services at an agreed upon time; and</text></subparagraph> <subparagraph id="H62C1E86FD6FD4E15BACEFB5F61F8A46A"><enum>(C)</enum><text display-inline="yes-display-inline">comply with any other reasonable request, including any request that an individual undergo drug testing or skill assessments.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA19DCF35999A42EFB2B207BED723D9D3"><enum>(2)</enum><header>Reporting of noncompliance</header><text>Section 303(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/503">42 U.S.C. 503(a)</external-xref>), as amended by paragraph (1), is further amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HCC089A7C03C244C49165271D2C0D0400" display-inline="no-display-inline"> <paragraph id="H8AFBFCBEAC7C4EB99A484C9696670B38"><enum>(14)</enum><text display-inline="yes-display-inline">A method by which a person with whom a claimant is seeking employment may voluntarily report to the State the failure of a claimant to comply with the State law provisions described in paragraphs (12) and (13).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> 
<subsection id="H54CD4873C0B34CCEB355A73397C46610"><enum>(b)</enum><header>Audit requirement</header> 
<paragraph id="H51EA6E8B28CA48509B1C8FA56FF0F36F"><enum>(1)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary of Labor shall conduct a study on the effect of increasing the number of random audits under the Beneficiary Accuracy Management program on the administration of State unemployment compensation laws.</text></paragraph> <paragraph id="H38D9F33F9312428982190B70BDA20158"><enum>(2)</enum><header>Audit program adjustments</header><text display-inline="yes-display-inline">Not later than 1 year after submitting the report required under paragraph (1), if such report indicates that increasing the number of random audits under the Benefit Accuracy Measurement program (or any successor audit program) will improve the administration of State unemployment compensation laws, the Secretary shall prescribe regulations to increase the number of such audits in accordance with such report.</text></paragraph> </subsection> 
<subsection id="HA8EC0A1B6BBC48A5909C7BD5701A7891" commented="no"><enum>(c)</enum><header>Effective dates</header> 
<paragraph id="H544AE6D3B5E1420697866AA6E4E45C2F" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text>Subject to subparagraph (B), the amendments made by subsections (a) and (b) shall, with respect to a State, apply to weeks beginning after the date that is 1 year after the date of enactment of this Act.</text></paragraph> <paragraph id="H278BC457F89542FEBBE487E82DB512B2"><enum>(2)</enum><header>States with biennial legislative sessions</header><text display-inline="yes-display-inline">In the case of a State whose legislature is not in session during the 1-year period beginning on the date of enactment of this Act, the amendments made by subsections (a) and (b) shall, with respect to such State, apply to weeks beginning after the end of the first session of the State legislature which begins after the date of enactment of this Act.</text></paragraph> </subsection> </section> 
<section id="H0ED45CC9C29F4CF8862DAFFB231A8AC9"><enum>3.</enum><header>Work requirements for extended and emergency unemployment compensation</header> 
<subsection id="H7B386642C4DF418F93DE9EB283D38E88"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1105">42 U.S.C. 1105</external-xref>) is amended—</text> <paragraph id="H23E8437B0C174CF5A148A7F5F964E34B"><enum>(1)</enum><text>in subsection (c), by striking <quote>Amounts</quote> and inserting <quote>Subject to subsection (e), amounts</quote>; and</text></paragraph> 
<paragraph id="H68C842EC287C4874BB7B240D78F529AA"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block style="traditional" id="H33D83927440D4ADE825187B1CAA92588" display-inline="no-display-inline"> <subsection id="H32625ADCB1994C0C88A2970F334196B1"><enum>(e)</enum><header>Limitation on funds transfers</header> <paragraph id="H0CC558DEB5924743BE708C3A181312E0" display-inline="yes-display-inline"><enum>(1)</enum><text>Amounts in the extended unemployment compensation account may not be transferred to a State account for the purposes of any unemployment compensation law unless the Secretary of Labor certifies that the State law under which such unemployment compensation will be administered includes the provisions required by paragraphs (13) and (14) of section 303(a).</text></paragraph> 
<paragraph id="H6CCFD6DCE4F5466E9E188BFC3C76DE66" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The provisions of this subsection shall apply notwithstanding any other provision of law enacted after the date of enactment of the <short-title>Unemployment Integrity Act of 2023</short-title>, unless such other provision of law specifically cites this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H5B079E347D764353A4BE78A27FB02172"><enum>(b)</enum><header>Effective date</header> <paragraph id="H5C9B3E3931BC4E27821D24454C7C5C30" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amendments made by subsection (a) shall, with respect to a State, apply to weeks beginning after the date that is 1 year after the date of enactment of this Act.</text></paragraph> 
<paragraph id="H635EA3C8AF3646419CD7703B0B8F6995"><enum>(2)</enum><header>States with biennial legislative sessions</header><text display-inline="yes-display-inline">In the case of a State whose legislature is not in session during the 1-year period beginning on the date of enactment of this Act, the amendments made by subsection (a) shall, with respect to such State, apply to weeks beginning after the end of the first session of the State legislature which begins after the date of enactment of this Act.</text></paragraph></subsection> </section> </legis-body></bill>
