R. 5900</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231006">October 6, 2023</action-date><action-desc><sponsor name-id="G000578">Mr. Gaetz</sponsor> introduced the following bill</action-desc></action><action display="yes"><action-date date="20231025">October 25, 2023</action-date><action-desc>Referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit individuals from publicizing certain information relating to security clearances.</official-title></form><legis-body id="H5FC1165D41334F5EACA74105A956FF7B" style="OLC"><section id="H67AD61892BC0483997C64A215FFB1087" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Security Clearance Revolving Door Act of 2023</short-title></quote>. </text></section><section id="H7038371D3B56443F807D5B5C314C457E"><enum>2.</enum><header>Prohibition on publicizing certain information relating to security clearances</header><subsection id="H3835AD41CAFF4B1D8DC4C91E1DD07C1C"><enum>(a)</enum><header>Prohibition on publicizing certain information relating to security clearance</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/93">Chapter 93</external-xref> of title 18, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HC0C2D6B5512E4C02A10D2E0CB53B4DA3"><section id="H6C456937C1804A4F8A21603EE0D3729E"><enum>1925.</enum><header>Prohibition on publicizing certain information relating to security clearances</header><subsection id="HBCAF639192194A398D4080DFA2447BD0"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever, having received notice of a favorable adjudication with respect to a security clearance investigation, periodic reinvestigation, or other determination of eligibility to access classified information by an authorized adjudicative agency, publishes the fact of such favorable adjudication during the period of the current investigation file shall be fined not more than $1000, imprisoned for a term of not more than one year, or both.</text></subsection><subsection id="H74047EEBB8244623AB5A43D464E76BE3"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">It shall not be an offense under this section for an individual who has received a favorable adjudication specified in subsection (a) to include the fact of such favorable adjudication in connection with an application for a position of employment or for a governmental contract (or a subcontract thereof), where such favorable adjudication is a requirement for such employment or contract.</text></subsection><subsection id="H23AF1D76A258464A87410C159A6E9AFF"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms <quote>authorized adjudicative agency</quote>, <quote>current investigation file</quote>, and <quote>periodic reinvestigation</quote> have the meanings given those terms in section 3001(a) of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341(a)</external-xref>). </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA8DCBFCC513A489684BB85E878C54C97"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/93">chapter 93</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/1924">section 1924</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H56FA35EFD5C2424C9B0C5A2B98D10229"><toc regeneration="no-regeneration"><toc-entry level="section">1925.
