R. 5884</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231003">October 3, 2023</action-date><action-desc><sponsor name-id="C001119">Ms. Craig</sponsor> introduced the following bill</action-desc></action><action display="yes"><action-date date="20231025">October 25, 2023</action-date><action-desc>Referred to the <committee-name committee-id="">Committee on Oversight and Accountability</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide members of the President’s Cabinet an allowance to acquire security equipment and services for the personal residences of such members, and for other purposes.</official-title></form><legis-body id="HB6A64951E17A4654A50AC006A1603B80" style="OLC"><section id="HDF633B151C2B4D49BA22677E04A32683" section-type="section-one"><enum>1.</enum><header>Cabinet member residential security allowance</header><subsection id="H9ADC34957B5B4787AAD977902574FFB4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/59">Chapter 59</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/5949">section 5949</external-xref> the following new section:</text><quoted-block style="USC" id="HB79DD7835FAC4FD0960D44CE937B8DB7" display-inline="no-display-inline"><section id="H9A97DE6B4FA94EED91D60414E0794D72"><enum>5949a.</enum><header>Residential security allowance</header><subsection id="H04FD7B850E4B4EDDB25B3E79CA54D790"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the United States Secret Service Uniformed Division shall reimburse each eligible Cabinet member for—</text><paragraph id="H9E1FD4B2400C46AF939765882C47BC52"><enum>(1)</enum><text display-inline="yes-display-inline">any costs incurred by such eligible Cabinet member for the acquisition or installation of safety and security equipment, including cameras, motion sensors, video recorders, door locks, and lighting, at any personal residence of such eligible Cabinet member; and</text></paragraph><paragraph id="H460DAF73F5FB45A3B05FFE33CFEEF633"><enum>(2)</enum><text display-inline="yes-display-inline">any recurring monthly fixed costs incurred by such eligible Cabinet member for—</text><subparagraph id="HD8F5B489CE6747DA9B4104E0C2B64BEE"><enum>(A)</enum><text display-inline="yes-display-inline">maintaining safety and security equipment at any personal residence of such eligible Cabinet member; and</text></subparagraph><subparagraph id="HFBC41CC0D2F74FFEA93E7A096433EEDE"><enum>(B)</enum><text>security monitoring services for any personal residence of such eligible Cabinet member.</text></subparagraph></paragraph></subsection><subsection id="HC85B308525244262BE2A6CB82D77CE66"><enum>(b)</enum><header>Limits</header><paragraph id="H985425A1CE5F4973B8BB22AACF2A6DBE"><enum>(1)</enum><header>In general</header><text>The Director may only reimburse a cost under subsection (a) if—</text><subparagraph id="HD75F56922AE143EEAC7DB55B37095979"><enum>(A)</enum><text>such cost was incurred by an eligible Cabinet member while an eligible Cabinet member; and</text></subparagraph><subparagraph id="H1B7C09964AAE4F6A923B99D392C34176"><enum>(B)</enum><text>such eligible Cabinet member submits an application in accordance with subsection (c).</text></subparagraph></paragraph><paragraph id="HF7756AFA77B84973B0AB9907762A416A"><enum>(2)</enum><header>Acquisition and installation</header><text display-inline="yes-display-inline">The aggregate amount which an individual may be reimbursed under paragraph (1) of subsection (a) may not exceed $10,000.</text></paragraph><paragraph id="H947035684A53422BADE4411C01CDA204"><enum>(3)</enum><header>Monthly fees</header><text display-inline="yes-display-inline">The amount which the Director may reimburse an eligible Cabinet member under paragraph (2) of subsection (a) may not exceed $150 per month.</text></paragraph></subsection><subsection id="HB005AD465CF0479CA87BA6A91FAEEB3A"><enum>(c)</enum><header>Application</header><text>Each eligible Cabinet member seeking reimbursement under this section shall submit to the Director an application at such time, in such manner, and containing such information as the Director determines appropriate.</text></subsection><subsection id="H08FFCD6466C24C0AA20124E91A057B71"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB01EDF25762B443EB426EC5072035B8F"><enum>(1)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the United States Secret Service Uniformed Division.</text></paragraph><paragraph id="HC3F9867A571047048653297F1F3989A2"><enum>(2)</enum><header>Eligible Cabinet member</header><text>The term <term>eligible Cabinet member</term> means—</text><subparagraph id="HE2D4AC0258CD47CE953813EF9A5B30D6"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture;</text></subparagraph><subparagraph id="H84861B8BD2084848B2211DCBA7550790"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Commerce;</text></subparagraph><subparagraph id="HC88FAE994FC44B9988076D5E8C8C63E6"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary of Defense;</text></subparagraph><subparagraph id="HD59DCD943BE5402993D726086DC71983"><enum>(D)</enum><text display-inline="yes-display-inline">the Secretary of Education;</text></subparagraph><subparagraph id="H4B1FEE1FC5164116A5C34F08704FDAA0"><enum>(E)</enum><text display-inline="yes-display-inline">the Secretary of Energy;</text></subparagraph><subparagraph id="H44B3D9EA04494CB491E0F8088622DF34"><enum>(F)</enum><text display-inline="yes-display-inline">the Secretary of Health and Human Services;</text></subparagraph><subparagraph id="H28368069688A453D8D9F4F9105226A71"><enum>(G)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security;</text></subparagraph><subparagraph id="H90115DF1328543A9B3E9CE8FB50D5F0E"><enum>(H)</enum><text display-inline="yes-display-inline">the Secretary of Housing and Urban Development;</text></subparagraph><subparagraph id="H4DD50BDDF03A4824B2CF557581D89157"><enum>(I)</enum><text display-inline="yes-display-inline">the Secretary of Interior;</text></subparagraph><subparagraph id="HD79578E5E74B44AABDF8BA2D2E409208"><enum>(J)</enum><text display-inline="yes-display-inline">the Secretary of Labor;</text></subparagraph><subparagraph id="HBC00EB5B276240759A81293B09081E42"><enum>(K)</enum><text display-inline="yes-display-inline">the Secretary of State;</text></subparagraph><subparagraph id="H3ECA23056A464D9297EAEAF8FD066876"><enum>(L)</enum><text display-inline="yes-display-inline">the Secretary of Transportation;</text></subparagraph><subparagraph id="HD5607DE7F2244C2FA8D4AC43438F9E05"><enum>(M)</enum><text display-inline="yes-display-inline">the Secretary of the Treasury;</text></subparagraph><subparagraph id="HDA00603FB8264B9BB8D62E8590BD924D"><enum>(N)</enum><text display-inline="yes-display-inline">the Secretary of Veterans Affairs;</text></subparagraph><subparagraph id="H9F1ECE591AF0448C86AF9AF7D460422D"><enum>(O)</enum><text>the Attorney General;</text></subparagraph><subparagraph id="H515B41FE2CEC4BE38DD0C3B3CFC50CD6"><enum>(P)</enum><text>the Director of National Intelligence;</text></subparagraph><subparagraph id="H73209DFDFDC54B4B889CEB3C4570D5CF"><enum>(Q)</enum><text>the Administrator of the Environmental Protection Agency; and</text></subparagraph><subparagraph id="HB073ADA89A0F496B842D8E41AE2205DC"><enum>(R)</enum><text>the Administrator of the Small Business Administration.</text></subparagraph></paragraph><paragraph id="HD3B30BEF1BC546E3A66834CD574F9683"><enum>(3)</enum><header>United States Secret Service Uniformed Divisions</header><text display-inline="yes-display-inline">Term <quote>United States Secret Service Uniformed Division</quote> has the meaning given that term under section 3056A of title 18.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H76ECCF45ADE04D56B6D5DC2731E01EC1"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/59">chapter 59</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/5949">section 5949</external-xref> the following new item:</text><quoted-block style="USC" id="H1A87FDCE93E74DA0A624C58693A3CF3D" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">5949a. Residential security allowance.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H6B99F07809324D1B8A29588D13D76EF1"><enum>2.</enum><header>Exclusion of residential security allowance from gross income</header><subsection id="HEB54D87450364BFC9BAD1CC79528D4E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 139I the following new section:</text><quoted-block style="OLC" id="H00044337D2814ABEA36B9FD0B6B132DC" display-inline="no-display-inline"><section id="H5CB165D8B8DD4F6FB778B94689D56264"><enum>139J.</enum><header>Residential security allowance for eligible cabinet members</header><text display-inline="no-display-inline">In the case of an eligible cabinet member (as defined in section 5949a(d) of title 5, United States Code), gross income does not include any amounts received as a reimbursement issued by the Director of the United States Secret Service Uniformed Division under section 5949a(a) of title 5, United States Code.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3C141CAE0393423D82E2E149443259F3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for part III of subchapter B of chapter 1 of such Code is amended by inserting after the item relating to section 139I the following new item:</text><quoted-block style="OLC" id="H2835DDDE5356498FABBF3AAE6BFE41E0" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry idref="H5CB165D8B8DD4F6FB778B94689D56264" level="section">Sec. 139J. Residential security allowance for eligible cabinet members.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB00976429D5240F8B8C5760C8BA335A1"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to amounts received after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
