R. 5862</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231002">October 2, 2023</action-date><action-desc><sponsor name-id="S001135">Mrs. Steel</sponsor> (for herself and <cosponsor name-id="P000613">Mr. Panetta</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HHM00">Homeland Security</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 relating to authority of U.S. Customs and Border Protection to consolidate, modify, or reorganize Customs revenue functions.</official-title></form><legis-body id="HBD6F2FD1168344D281BAE1FBEF5AA63C" style="OLC"><section id="H51C237DF58D04872AA718C17307BE71B" section-type="section-one"><enum>1.</enum><header>Authority of U.S. Customs and Border Protection to consolidate, modify, or reorganize Customs revenue functions</header><subsection id="H7A9C9EE68FBB4BE2A6FD4C853D39AFA4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 412 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/212">6 U.S.C. 212(b)</external-xref>) is amended—</text><paragraph id="H08C14510FBBD4957812DEFB864B4BA82"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HC828113DCFD340EC88F5D9A225B385FC"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HFDA87166D82743DDBD7ABFC81AA7C45E"><enum>(i)</enum><text>by striking <quote>consolidate, discontinue,</quote> and inserting <quote>discontinue</quote>; and</text></clause><clause id="H4F39777E35594823A273389570FD3986"><enum>(ii)</enum><text>by inserting after <quote>reduce the staffing level</quote> the following: <quote>below the optimal staffing level determined in the most recent Resource Allocation Model required by section 301(h) of the Customs Procedural Reform and Simplification Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/19/2075">19 U.S.C. 2075(h)</external-xref>)</quote>; and </text></clause></subparagraph><subparagraph id="H400C8ED72E30414DA923D8AAFEFEF391"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>, National Account Managers, and International Trade Analysts</quote> after <quote>Financial Systems Specialists</quote>; and </text></subparagraph></paragraph><paragraph id="H94D88710B3D642208ED9CB7735D60018"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HB34DA6B6512548D5896C8E41D4C70523" display-inline="no-display-inline"><subsection id="H4EFF946C5B4A47B2AFE50B05FD631249"><enum>(d)</enum><header>Authority To Consolidate, Modify, or Reorganize Customs Revenue Functions</header><paragraph id="HCFF8D799BB994D6685775881BE3C4F53"><enum>(1)</enum><header>In general</header><text>The Commissioner of U.S. Customs and Border Protection may, subject to subsection (b), consolidate, modify, or reorganize customs revenue functions delegated to the Commissioner under subsection (a), including by adding such functions to existing positions or establishing new or modifying existing job series, grades, titles, or classifications for personnel, and associated support staff, performing such functions. </text></paragraph><paragraph id="HE3F708FBD8A04897AC16863790D1904E"><enum>(2)</enum><header>Position classification standards</header><text>At the request of the Commissioner, the Director of the Office of Personnel Management shall establish new position classification standards for any new positions established by the Commissioner under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H37881929036B41759595EAF85E1CB798"><enum>(b)</enum><header>Technical correction</header><text display-inline="yes-display-inline">Section 412(a)(1) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/212">6 U.S.C. 212(a)(1)</external-xref>) is amended by striking <quote>403(a)(1)</quote> and inserting <quote>403(1)</quote>.</text></subsection></section></legis-body></bill>
