which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit certain Federal agencies from requiring certain institutions to include assets held in custody as a liability, and for other purposes.</official-title></form><legis-body id="H8D220F735B514B99B993D36F47359E32" style="OLC"><section id="HFBA09023BE61451FB060336EEFEF1C14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Uniform Treatment of Custodial Assets Act</short-title></quote>. </text></section><section id="H0E260249EE4C4FEA9C7890D77D1D4EB1"><enum>2.</enum><header>Accounting treatment of custody activities</header><subsection id="H9A564AAEBC2C4A9BBEADA8C1699F0A3F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The appropriate Federal banking agency, the National Credit Union Administration (in the case of a credit union), and the Securities and Exchange Commission may not require or take supervisory action that would cause a depository institution, national bank, Federal credit union, State credit union, trust company, or any affiliate thereof—</text><paragraph id="H491E47518D484E7DADDC51B3E76385F0"><enum>(1)</enum><text display-inline="yes-display-inline">except as provided in subsection (b), to include assets held in custody or safekeeping, or the assets associated with a cryptographic key held in custody or safekeeping, as a liability on such institution’s financial statement or balance sheet;</text></paragraph><paragraph id="H33798D32C3974126A932BE99E5C652A7"><enum>(2)</enum><text display-inline="yes-display-inline">to hold additional regulatory capital against assets in custody, or safekeeping, or the assets associated with a cryptographic key held in custody or safekeeping, except as necessary to mitigate against operational risks under regulations with general application, as determined by—</text><subparagraph id="HE01758ABFE7F4E029D695496AB3AF62D"><enum>(A)</enum><text display-inline="yes-display-inline">the appropriate Federal banking agency or State bank supervisor;</text></subparagraph><subparagraph id="H416A98B9E40C49C3847F548EFAE84A85"><enum>(B)</enum><text>the National Credit Union Administration (in the case of a credit union); or</text></subparagraph><subparagraph id="H197945D950294E2CB2B7B102ECCC3036"><enum>(C)</enum><text>a State credit union supervisor; or </text></subparagraph></paragraph><paragraph id="H9C7F4DD78BE7407B8AF1A230BCB5A604"><enum>(3)</enum><text display-inline="yes-display-inline">to recognize a liability for any obligations related to activities or services performed for digital assets that such institution does not have beneficial ownership of if that liability would exceed the expense recognized in the income statement as a result of the corresponding obligation.</text></paragraph></subsection><subsection id="HFA44E2EC9F474CF59A0520121F12A22B"><enum>(b)</enum><header>Exception for commingling</header><text display-inline="yes-display-inline">Cash held for a third party by an institution described in subsection (a) may be treated as a liability on such institution’s financial statement or balance sheet if such cash is commingled with the general assets of such institution.</text></subsection><subsection id="H7D49A0D2B1E44DBBAD392DF84362E267"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H5BD7000D65A6476F8BCAB95B1EB45FA8"><enum>(1)</enum><header>Affiliate</header><text display-inline="yes-display-inline">The term <quote>affiliate</quote> has the meaning given the term in section 2 of the Bank Holding Company Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/12/1841">12 U.S.C. 1841</external-xref>).</text></paragraph><paragraph id="HAD37E5DEF5FF4EFFAFA925B08FA34C73"><enum>(2)</enum><header>Credit union terms</header><text display-inline="yes-display-inline">The terms <quote>Federal credit union</quote> and <quote>State credit union</quote> have the meaning given those terms, respectively, in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>).</text></paragraph><paragraph id="H31582B13383447F8B21A063E14958B1C"><enum>(3)</enum><header>FDIA terms</header><text display-inline="yes-display-inline">The terms <quote>appropriate Federal banking agency</quote>, <quote>depository institution</quote>, and <quote>State bank supervisor</quote> have the meanings given the terms, respectively, in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>).</text></paragraph><paragraph id="HD3E54043E904405998353B34AF5E3E54"><enum>(4)</enum><header>State credit union supervisor</header><text display-inline="yes-display-inline">The term <quote>State credit union supervisor</quote> means a State official described in section 107A(e) of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1757a">12 U.S.C. 1757a(e)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
