<section id="HE59FCFAE479342EE892907F837C22E84" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commission on the American Workforce Act</short-title></quote>. </text></section> <section id="H2C5587E84C5C437095B432AF1D24B203"><enum>2.</enum><header>American Workforce Commission</header> <subsection id="H50B9D095CB6140A4BB5A9C4B40AC84AD"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established a commission to be known as the <quote>American Workforce Commission</quote> (in this section referred to as the <quote>Commission</quote>).</text></subsection> 
<subsection id="H3A207E757E56497D8F88C7635B219B28"><enum>(b)</enum><header>Duties</header><text>The duties of the Commission shall be to conduct an examination of the following:</text> <paragraph id="HE8AD7C0872F6401AAF95FCA0B454005B"><enum>(1)</enum><text display-inline="yes-display-inline">The possible causes of workforce changes during the 10-year period beginning on the date that is 10 years prior to the date of the enactment of this section, including—</text> 
<subparagraph id="H143659164CF0496C9FA1C6318F4E49FA"><enum>(A)</enum><text display-inline="yes-display-inline">the COVID–19 pandemic, including—</text> <clause id="HC6526ABD91F74A7E96A1678EA3F088C8"><enum>(i)</enum><text>related public health and economic policy responses to such pandemic; and</text></clause> 
<clause id="H0E34F6B516DA4C84A5CF3A8CFCFC9AD5"><enum>(ii)</enum><text>psychological implications of such pandemic that may have altered the career trajectories or aspirations of individuals;</text></clause></subparagraph> <subparagraph id="H1AB45FD77A984F1CA217218168880201"><enum>(B)</enum><text>issues predating such pandemic, including issues stemming from the financial crisis of 2008–2009; </text></subparagraph> 
<subparagraph id="HC6CC84C8A2CD4065AC731777075604F7"><enum>(C)</enum><text>changes in—</text> <clause id="H606E53212862493BAEEC3B1DF85EDC73"><enum>(i)</enum><text display-inline="yes-display-inline">the highest level of education that individuals attain; and</text></clause> 
<clause id="H85D82952AC50403292666068CB26623B"><enum>(ii)</enum><text display-inline="yes-display-inline">the use of workforce development programs offered by employers to develop the skills of employees;</text></clause></subparagraph> <subparagraph id="HF10BEF3CC8C64ADEB63B49DB786B39D2"><enum>(D)</enum><text display-inline="yes-display-inline">availability of work-from-home policies;</text></subparagraph> 
<subparagraph id="H8567394B42A040168DC5A4AEB626C193"><enum>(E)</enum><text display-inline="yes-display-inline">the rise of the gig economy;</text></subparagraph> <subparagraph id="HE00CDB98A9944FF0B7FDB1E8AD74AF76"><enum>(F)</enum><text>the manufacturing industries and labor policies of the United States and the People’s Republic of China; </text></subparagraph> 
<subparagraph id="HCDEDB8761E814DD69B1D72DEA2533EBD"><enum>(G)</enum><text display-inline="yes-display-inline">changes in the social value of professions that do not require an associate or baccalaureate degree;</text></subparagraph> <subparagraph id="HF31FF6F923884D968A18D71ABC50A1CC"><enum>(H)</enum><text display-inline="yes-display-inline">the impact of globalization and job out-sourcing;</text></subparagraph> 
<subparagraph id="HDDB2AD6ED79D4D918384D4D90B2809B7"><enum>(I)</enum><text>changes in family structures, including changes relating to the number of two parent households, the number of households in which both parents are employed, and the number of children per household; and</text></subparagraph> <subparagraph id="H59B6F17E65EE4643BFE012A08CD1C185"><enum>(J)</enum><text display-inline="yes-display-inline">any additional changes the Commission deems appropriate to examine.</text></subparagraph></paragraph> 
<paragraph id="HFB709B623141461FB6DE75F5EFA5304B" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The impact of workforce changes identified pursuant to paragraph (1), including—</text> <subparagraph id="HDADFFBDF3EFB4E54B44F048595CD629E"><enum>(A)</enum><text display-inline="yes-display-inline">areas within the United States that were most impacted by such changes; </text></subparagraph> 
<subparagraph id="HD6CBCE3A7B5A40328CF89266B7A37223"><enum>(B)</enum><text>whether any population or group became more vulnerable due to such changes;</text></subparagraph> <subparagraph id="HA1593376DC56401C86CE107E1EDD7BD4"><enum>(C)</enum><text>a comparison of the impact of such changes on—</text> 
<clause id="HB3DC8576BDDB455AA081C546926E4109"><enum>(i)</enum><text>businesses based on size; and</text></clause> <clause id="H043CFB887F8946A581E96964CD324A43"><enum>(ii)</enum><text>working parents and parents who are homemakers;</text></clause></subparagraph> 
<subparagraph id="HED49C37C9E624A178D693B114903D516"><enum>(D)</enum><text display-inline="yes-display-inline">changes in the rates of mental illness and drug use, including opioid use during the 10-year period beginning on the date that is 10 years prior to the date of the enactment of this section; and</text></subparagraph> <subparagraph id="HA0CEB3C3020146AF8FB54D54DF7B718C"><enum>(E)</enum><text>the impact on—</text> 
<clause id="HE16AAE2596364D95868CA9D599BB1D9D"><enum>(i)</enum><text>supply chains;</text></clause> <clause id="HD88192583959456E83F9985BB62AD6BF"><enum>(ii)</enum><text>quality of products and services;</text></clause> 
<clause id="H1BEE7E39B3544055AF1F612DBE7B00B2"><enum>(iii)</enum><text>Federal, State, and local tax revenue;</text></clause> <clause id="H044AAECF6A2E4B73BE2CACF459583887"><enum>(iv)</enum><text>formation or closure of businesses; </text></clause> 
<clause id="HA208351DEE114FA394A2831B301135FC"><enum>(v)</enum><text>family and individual income and wealth; </text></clause> <clause id="HB3CFDE32B33A434BAA7142ED16776215"><enum>(vi)</enum><text>Federal, State, and local workforce size;</text></clause> 
<clause id="HA95C6587EDF24E569AAB1E7406EB36E6"><enum>(vii)</enum><text>readiness of the armed services;</text></clause> <clause id="HD57C8CD7933B4350B51849561ECE5CA3"><enum>(viii)</enum><text>economic productivity;</text></clause> 
<clause id="H11F42F542C7C43498DE5EF94345A1EF1"><enum>(ix)</enum><text>manufacturing output; and</text></clause> <clause id="H86CD1E8055994D55B60F4504CDB84417"><enum>(x)</enum><text display-inline="yes-display-inline">changes to workplace and occupational safety standards.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HFDEED5E349B54483B421CCA868BA9E1B" commented="no"><enum>(c)</enum><header>Powers of Commission</header> 
<paragraph id="H656F2EADE29041F59F5662663B44B561" commented="no"><enum>(1)</enum><header>Hearings and sessions</header> 
<subparagraph id="HA9730C5260B2483798C562664FD1CBF5" commented="no"><enum>(A)</enum><header>In general</header><text>The Commission may, for the purpose of carrying out this section, hold hearings, sit and act at times and places, take testimony, and receive evidence as the Commission considers appropriate.</text></subparagraph> <subparagraph id="H9B53FDEDEB8742E786EDE69803603FDB" commented="no"><enum>(B)</enum><header>Scheduling of sessions</header> <clause id="H3183560D79014912B4CA8F8BE8936D88"><enum>(i)</enum><header>In general</header><text>Hearings and sessions of the Commission shall be scheduled by the Chairperson or by a vote of the majority of members.</text></clause> 
<clause id="H6C02E021D0D145A39DE19DEF65FE0B35"><enum>(ii)</enum><header>Initial hearing or session</header><text>The Chairperson shall schedule the initial hearing or session to occur not later than 90 days after the date on which the Chairperson is appointed pursuant to subsection (d)(5)(A).</text></clause></subparagraph> <subparagraph id="HFCC932C63368409580A5A957A1505380" commented="no"><enum>(C)</enum><header>Circumstances of hearings and sessions</header> <clause id="HCE275C1FFD3A412690060228229D082D"><enum>(i)</enum><header>In person hearings and sessions</header><text>Unless prohibited by Federal guidelines, hearings and sessions shall be conducted by the Commission in person.</text></clause> 
<clause id="H19F50D6844B94559AB87168DEE59496A"><enum>(ii)</enum><header>Witness testimony</header><text>The Commission may request witness testimony in any format the Commission determines appropriate.</text></clause></subparagraph></paragraph> <paragraph id="HF7ACC0A97D9B492CA563A4934C13EA4F" commented="no"><enum>(2)</enum><header>Powers of Members and agents</header><text>Any member or agent of the Commission may, if authorized by the Commission, take any action which the Commission is authorized to take by this section.</text></paragraph> 
<paragraph id="H6DE1A74BB6AE47769949DED19C59DBB5" commented="no"><enum>(3)</enum><header>Obtaining Official Data</header><text>The Commission may secure directly from any department or agency of the United States information, including privacy-protected information, necessary to enable it to carry out this Act. Upon request of the Chairperson or Vice Chairperson of the Commission, the head of such department or agency shall furnish such information to the Commission. </text></paragraph> <paragraph id="H83C3BC5703474561A4545E558720C6A4" commented="no"><enum>(4)</enum><header>Gifts, Bequests, and Devises</header><text>The Commission may accept, use, and dispose of gifts, bequests, or devises of services or property, both real and personal, for the purpose of aiding or facilitating the work of the Commission. Gifts, bequests, or devises of money and proceeds from sales of other property received as gifts, bequests, or devises shall be deposited in the Treasury and shall be available for disbursement upon order of the Chairperson. </text></paragraph> 
<paragraph id="H92D67531052B41D683095DEB2507E962" commented="no"><enum>(5)</enum><header>Mails</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States.</text></paragraph> <paragraph id="H773C2476366F4F799873F2858BB7E288" commented="no"><enum>(6)</enum><header>Administrative Support Services</header> <subparagraph id="H6379123DE4E241ACB88F69059939608C" commented="no"><enum>(A)</enum><header>General Services</header><text>Upon the request of the Commission, the Administrator of General Services shall provide to the Commission, on a reimbursable basis, the administrative support services necessary for the Commission to carry out its responsibilities under this Act.</text></subparagraph> 
<subparagraph id="H5FE3122999E4473AAFF603722A37FA21" commented="no"><enum>(B)</enum><header>Additional support</header><text>The Commission may accept additional assistance from any department or agency of the United States.</text></subparagraph></paragraph> <paragraph id="HC77E6BB2741D45D48E40216814D0286D" commented="no"><enum>(7)</enum><header>Subpoena Power</header> <subparagraph id="H6775A1B748084527B49EEE6CDEC9C094" commented="no"><enum>(A)</enum><header>In general</header><text>The Commission may issue subpoenas requiring the attendance and testimony of witnesses and the production of any evidence relating to any matter which the Commission is empowered to investigate by subsection (b). </text></subparagraph> 
<subparagraph id="HEA75D804EF2A4C849486C83CE89F58C4" commented="no"><enum>(B)</enum><header>Issuance of subpoena</header><text>A subpoena of a witness or evidence shall be issued only upon if agreement is reached that such subpoena should be issued by—</text> <clause id="HE5D0EFBFE416499088DDC01053B4876D" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the Chairperson and Vice Chairperson; or</text></clause> 
<clause id="HC50179104BD84425806B5987C5F5E94D" commented="no"><enum>(ii)</enum><text>an affirmative vote of the majority of members present and voting.</text></clause></subparagraph> <subparagraph id="HBE79F664A9C14846A2A2F67DE9EA0EA8" commented="no"><enum>(C)</enum><header>Failure to obey a Subpoena</header><text>If a person refuses to obey a subpoena issued under subparagraph (A), the Commission may apply to a United States district court for an order requiring that person to appear before the Commission to give testimony, produce evidence, or both, relating to the matter under investigation. The application may be made within the judicial district where the hearing is conducted or where that person is found, resides, or transacts business. Any failure to obey the order of the court may be punished by the court as civil contempt.</text></subparagraph> 
<subparagraph id="H4B293C9D3E0C415894FA38DE4343E820" commented="no"><enum>(D)</enum><header>Service of subpoenas</header><text>The subpoenas of the Commission shall be served in the manner provided for subpoenas issued by a United States district court under the Federal Rules of Civil Procedure for the United States district courts.</text></subparagraph> <subparagraph id="HEE69813296D34F8589E93D569F2EADE3" commented="no"><enum>(E)</enum><header>Service of process</header><text>All process of any court to which application is made under paragraph (2) may be served in the judicial district in which the person required to be served resides or may be found.</text></subparagraph></paragraph> 
<paragraph id="H90694949AAAD446094AF7F1D704B4E33" commented="no"><enum>(8)</enum><header>Immunity</header><text>The Commission is an agency of the United States for the purpose of part V of title 18, United States Code (relating to immunity of witnesses).</text></paragraph> <paragraph id="H3938BD8799974897BA35EDDF46720D2A" commented="no"><enum>(9)</enum><header>Contract Authority</header><text>The Commission may contract with and compensate government and private agencies or persons for goods and other services.</text></paragraph></subsection> 
<subsection id="H92FCEFD0AFC746E78230789740D61C41"><enum>(d)</enum><header>Membership</header> 
<paragraph id="HABAABEB5E6F747E49DF6CDC31FFF9B92"><enum>(1)</enum><header>Number and appointment</header><text>The Commission shall be composed of 12 members, of whom—</text> <subparagraph id="H581E84BAE09D462A9B5A630E521C2A32"><enum>(A)</enum><text>three members shall be appointed by the majority leader of the House of Representatives;</text></subparagraph> 
<subparagraph id="HAEEA6D8D433F4C4BA9146BB58539C002"><enum>(B)</enum><text display-inline="yes-display-inline">three members shall be appointed by the minority leader of the House of Representatives;</text></subparagraph> <subparagraph id="H96623BB4D77B413C92F9FC04BAC35BEE"><enum>(C)</enum><text display-inline="yes-display-inline">three members shall be appointed by the majority leader of the Senate; and</text></subparagraph> 
<subparagraph id="H71F6F6E08BE94493A6AD9C81549F380C"><enum>(D)</enum><text display-inline="yes-display-inline">three members shall be appointed by the minority leader of the Senate.</text></subparagraph></paragraph> <paragraph id="HE54864507E3E4B1BBAD90CAEC98D5B0F"><enum>(2)</enum><header>Qualifications</header> <subparagraph id="HD9A402D56A674711A8AA9A8AD6821677"><enum>(A)</enum><header>Limitation on Congressional service</header><text display-inline="yes-display-inline">An individual appointed to the Commission may not be a former or current Member of Congress.</text></subparagraph> 
<subparagraph id="HFD080F5B61764AC291746AFE95BFE39E"><enum>(B)</enum><header>Other qualifications</header><text>It is the sense of Congress that individuals appointed to the Commission should have national recognition and significant depth of experience in at least one of the following areas:</text> <clause id="H93E63BE02748479580745CB20EE3CC4B" commented="no"><enum>(i)</enum><text>Economics.</text></clause> 
<clause id="H9A4FBD79FE5F45F18150560C262381DC" commented="no"><enum>(ii)</enum><text>Human resources.</text></clause> <clause id="H614B42D8EE474109A89926AF24BA3C71" commented="no"><enum>(iii)</enum><text>Industry.</text></clause> 
<clause id="HE01D10C2131C462BAA43A2696030B873" commented="no"><enum>(iv)</enum><text>Labor organization.</text></clause> <clause id="HED3F986892774CC7B9D4407CBCB4A8A5" commented="no"><enum>(v)</enum><text>Political science.</text></clause> 
<clause id="H8430B01EC5D540119F1640233AA00962" commented="no"><enum>(vi)</enum><text>Public policy.</text></clause> <clause id="H03D8DBADAD974283947FB4360AD990DA" commented="no"><enum>(vii)</enum><text>Any other area related to the national workforce.</text></clause></subparagraph></paragraph> 
<paragraph id="H30A6167A225B4725AE326BD0DB83611C"><enum>(3)</enum><header>Terms</header> 
<subparagraph id="H2D81ED413C7E4DBDA8D953ECE4B78D55" display-inline="no-display-inline"><enum>(A)</enum><header>In general</header><text>Each member shall be appointed not later than 60 days after the date of the enactment of this section and for the life of the Commission.</text></subparagraph> <subparagraph id="H5E26FC72CAD047E9A89E2D9E933BDFDB"><enum>(B)</enum><header>Vacancies</header><text>A vacancy on the Commission shall be filled in the same manner in which the original appointment was made.</text></subparagraph></paragraph> 
<paragraph id="H9FBD8DCA61A34C1BBCE1FF74889487B6"><enum>(4)</enum><header>Basic pay</header> 
<subparagraph id="H1224D476FB6F4C2580CA3F926D93FEF9"><enum>(A)</enum><header>Rates of pay</header><text display-inline="yes-display-inline">Members shall each be paid at a rate equal to the rate of basic pay for level IV of the Executive Schedule for each day (including travel time) during which they are engaged in the actual performance of duties vested in the Commission.</text></subparagraph> <subparagraph id="H5DB2DEB46A064C039464772A294E8207"><enum>(B)</enum><header>Prohibition on compensation of Federal employees</header><text>Members of the Commission who are full-time officers or employees of the United States may not receive additional pay, allowances, or benefits by reason of their service on the Commission.</text></subparagraph> 
<subparagraph id="H92084A13AD294A8CAF2B431B3DA050F1"><enum>(C)</enum><header>Travel expenses</header><text>Each member shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subparagraph></paragraph> <paragraph id="H65F4BAB7A74F467DA9EECC5911D23B12"><enum>(5)</enum><header>Chairperson; Vice Chairperson</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the final member of the Commission is appointed the—</text> 
<subparagraph id="H00025FC6BBB24812946A0E1D1AA1B583"><enum>(A)</enum><text>Chairperson shall be designated by the majority leader of the House of Representatives; and</text></subparagraph> <subparagraph id="H819348266A194780AD96194412128B2C"><enum>(B)</enum><text display-inline="yes-display-inline">Vice Chairperson shall be designated by the leader of the party within the Senate that is different from the majority leader of the House of Representatives.</text></subparagraph></paragraph></subsection> 
<subsection id="HB18637B9BBDC4BFA93AB13D0B3A1C232"><enum>(e)</enum><header>Quorum</header><text>Seven members of the Commission shall constitute a quorum.</text></subsection> <subsection id="H03774B570D87497697977399A7A7B459" commented="no"><enum>(f)</enum><header>Staff of Commission</header> <paragraph id="HBE401AAA7275459F82894644EF47086E" display-inline="no-display-inline" commented="no"><enum>(1)</enum><header>Director</header><text>The Commission shall have a Director who shall be appointed by the Chairperson and Vice Chairperson. </text></paragraph> 
<paragraph id="H6E5F746D5F6D4F65B51F02FB774729B6" commented="no"><enum>(2)</enum><header>Staff</header><text>The Chairperson and the Vice Chairperson may appoint additional staff as the Chairperson and Vice Chairperson consider appropriate.</text></paragraph> <paragraph id="HED4CF7C687114A1CA855C38307EB948D" commented="no"><enum>(3)</enum><header>Applicability of Certain Civil Service Laws</header><text>The Director and staff of the Commission may be appointed without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and may be paid without regard to the provisions of chapter 51 and subchapter III of chapter 53 of that title relating to classification and General Schedule pay rates, except that an individual so appointed may not receive pay in excess of the annual rate of basic pay for level V of the Executive Schedule.</text></paragraph> 
<paragraph id="H8B88B567F973474BAB769E32729AD861" commented="no"><enum>(4)</enum><header>Experts and Consultants</header><text>The Commission may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, but at rates for individuals not to exceed the daily equivalent of the maximum annual rate of basic pay for IV of the Executive Schedule.</text></paragraph></subsection> <subsection id="HE7D52A0BDD8F4A55A293559EDEC3C26D"><enum>(g)</enum><header>Nonapplicability of Federal Advisory Commission Act</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></subsection> 
<subsection id="HBF14FE60ECDA443F9A1EDA6DF342A7D1"><enum>(h)</enum><header>Reports; briefing; termination</header> 
<paragraph id="HB5D47635A82046499A3675933CDEB6D6"><enum>(1)</enum><header>Reports</header> 
<subparagraph id="H0780A42ABF8B4DC3A3A44FF64F0F2886"><enum>(A)</enum><header>Interim report</header><text display-inline="yes-display-inline">Not later than 4 months after the date of the initial meeting of the Commission, the Chairperson shall submit to the President and the Congress an interim report that includes a detailed summary of the work of the Commission and any preliminary findings. </text></subparagraph> <subparagraph id="H11CF60D0FC20438098FBFB62F13D81EE"><enum>(B)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the initial meeting of the Commission, the Chairperson shall submit to the President and the Congress a final report that includes—</text> 
<clause id="H32BDFEBD541A4582A97567BE603B6390" display-inline="no-display-inline"><enum>(i)</enum><text>a detailed statement of the findings and conclusions of the Commission; </text></clause> <clause id="H815918FCC43444A3BD4DD9BE5105F20F" display-inline="no-display-inline"><enum>(ii)</enum><text>dissenting opinions of any member who does not support the findings and conclusions referred to in clause (i); and</text></clause> 
<clause id="H56E27516A65D477B9A39D59FD96059DD" display-inline="no-display-inline"><enum>(iii)</enum><text>any recommendations for legislative and administrative actions to address workforce shortages.</text></clause></subparagraph> <subparagraph id="H7F5517C579A7456AA1275CDC840AB5FC" commented="no"><enum>(C)</enum><header>Publication</header> <clause id="HF976B20C82F444DCA7197DE84FCFB8E6" commented="no"><enum>(i)</enum><header>In general</header><text>Not more than 7 days after the date on which a report under this section is submitted to Congress, the Chairperson shall publish such report on the website of the Commission and the Federal Register.</text></clause> 
<clause id="H0C5CA2B7D82D4C648B5CABD7160EB0FC" commented="no"><enum>(ii)</enum><header>Privacy-protected data</header><text>When publishing the final report required under clause (i), the Chairperson shall remove any personally identifiable information included in such report.</text></clause></subparagraph></paragraph> <paragraph id="HAA56381F44A947199FF1110AB51FA356"><enum>(2)</enum><header>Briefing</header><text>Not later than 120 days after the date on which the Chairperson submits the final report pursuant to subsection (b), the Chairperson shall brief Congress on such report.</text></paragraph> 
<paragraph id="H661FF341961443848F136F4218DE8EAB"><enum>(3)</enum><header>Termination</header><text display-inline="yes-display-inline">The Commission, and all the authorities of this section, shall terminate upon the expiration of the 60-day period which begins on the date on which the Commission submits the final report under paragraph (1)(B).</text></paragraph></subsection></section> </legis-body></bill>
