<section id="H78E9DB99C68B43499E778EFFADFB0F7A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Future Generations Protection Act</short-title></quote>.</text></section> <section id="H7C649417420A4A9FA46F7239512E3026"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="HD8A2638938494E1B8C468C44513C51DF"><enum>(1)</enum><text display-inline="yes-display-inline">The use of fossil fuels exacerbates the climate crisis, threatens America’s natural resources, and disproportionately damages frontline environmental justice communities.</text></paragraph> <paragraph id="H9F001F9C653746EFBEDD2B1D00F814A8"><enum>(2)</enum><text>In order to avoid the worst consequences of climate change, the Federal Government should transition away from fossil fuels to renewable energy sources.</text></paragraph>
<paragraph id="H75EDEA1372E843ECACFD3FBFA298F34A"><enum>(3)</enum><text>In achieving its energy goals, it is the responsibility of the Federal Government to ensure a fair and just transition for workers and frontline communities.</text></paragraph> <paragraph id="H0B0DBEF22A2E403097EE04C80E9FFD8D"><enum>(4)</enum><text>The Federal Government should do this by prioritizing racial and gender equity, environmental justice, and partnering with labor unions to ensure that workers have training for and access to clean-energy jobs.</text></paragraph></section>
<section id="HE207E94411424B45A9CF0E8B706381F2"><enum>3.</enum><header>Emissions of greenhouse gases</header>
<subsection id="H3208ACFC407F415DB3887FCAB7DDA6CB"><enum>(a)</enum><header>Prohibition against the emission of greenhouse gases from new electric utility steam generating units</header><text>The Clean Air Act is amended by inserting after section 111 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411</external-xref>) the following new section:</text> <quoted-block style="OLC" id="H3CA38406D90242B78EA4A664CC51A8FC" display-inline="no-display-inline"> <section id="H734E3A64B36A433D8B3D310B7AFE8B3C"><enum>111A.</enum><header>Prohibition against the emission of greenhouse gases from electric utility steam generating units</header> <subsection id="HC0C1273E74374A52900EC4A37A7118B4"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Beginning on the date of enactment of this section, the emission of a greenhouse gas in any quantity from a new electric utility steam generating unit shall be treated as a violation of a standard or limitation under section 111.</text></subsection>
<subsection id="H9F4EF3DA0D7143A3989DE8440E665833"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H3492EF6D6D8346A1A991971E2C27D39B"><enum>(1)</enum><text>The term <term>electric utility steam generating unit</term> has the meaning given to that term in section 112(a).</text></paragraph>
<paragraph id="HFCECFBD0E870488ABCB793A9AEC65E9E"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>greenhouse gas</term> means—</text> <subparagraph id="H3B87AE5C6E60400C870890963318F826"><enum>(A)</enum><text>carbon dioxide;</text></subparagraph>
<subparagraph id="HCB3EA05E87E94A1BBB0BA81E86871A75"><enum>(B)</enum><text>methane;</text></subparagraph> <subparagraph id="H571FC288FECF46C49F3FD6C6D94E3453"><enum>(C)</enum><text>nitrous oxide;</text></subparagraph>
<subparagraph id="HCC03DA08D7B0427DAC4D409DB33F1732"><enum>(D)</enum><text>hydrofluorocarbons;</text></subparagraph> <subparagraph id="HE4432096D97146DA9790DC06BA91EE60"><enum>(E)</enum><text>perfluorocarbons;</text></subparagraph>
<subparagraph id="HB9B50719B09A417DB64E5BA752A42C53"><enum>(F)</enum><text>sulfur hexafluoride; or</text></subparagraph> <subparagraph id="HD726F7DE5C9043C194A668C266ED85EA"><enum>(G)</enum><text>any other anthropogenically emitted gas that is determined by the Administrator, by regulation, to contribute to global warming to a non-negligible degree.</text></subparagraph></paragraph>
<paragraph id="HEFBE5AF1AD504354A57E643E7B09A898"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>new electric utility steam generating unit</term> means an electric utility steam generating unit that commences operations or otherwise becomes a new source (as defined in section 111(a)) on or after the date of enactment of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H58A099CDFD4E4FA3997A40F59D482790"><enum>(b)</enum><header>Prohibition</header> <paragraph id="H862B30A1FAAB4A5EB63C9F878253BB79"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Federal Energy Regulatory Commission may not—</text>
<subparagraph id="H76DDD2983A844F59970A4933B9F3FEC1"><enum>(A)</enum><text display-inline="yes-display-inline">approve an application for the siting, construction, expansion, or operation of an LNG terminal under section 3(e) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b</external-xref>); or</text></subparagraph> <subparagraph id="HD001DA5DD7DE40F5B5E0E8A8AE8CC015"><enum>(B)</enum><text display-inline="yes-display-inline">issue a certificate of public convenience and necessity under section 7 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f</external-xref>).</text></subparagraph></paragraph>
<paragraph id="HC0C5CAEEF7BD4345A9FC440F664CE480"><enum>(2)</enum><header>Exception</header>
<subparagraph id="H3B12B483C77A45F9B5071CA309D616C4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply with respect to an application or certificate that, if approved or issued, will result in a reduction in emissions of any greenhouse gas at the LNG terminal, as determined by the Commission.</text></subparagraph> <subparagraph id="HE518751C453444C5A7E9F4427FB30A3B"><enum>(B)</enum><header>Definition</header><text>In this section, the term <term>greenhouse gas</term> means—</text>
<clause id="H96A8C904B1B1482C976F7CBB6C78D4E6"><enum>(i)</enum><text display-inline="yes-display-inline">carbon dioxide;</text></clause> <clause id="H45CDACCD727B450481C6BF51094B9946"><enum>(ii)</enum><text>methane;</text></clause>
<clause id="H03C37F6707F0471EA9006B69A6F5D930"><enum>(iii)</enum><text>nitrous oxide;</text></clause> <clause id="H49201F8E878949FE8E7B2FD932DBCD18"><enum>(iv)</enum><text>hydrofluorocarbons;</text></clause>
<clause id="H5C71591BFE92401C949FEC62A2E1EF74"><enum>(v)</enum><text>perfluorocarbons;</text></clause> <clause id="H1453296D7A364AC0839404BBEF1D71FB"><enum>(vi)</enum><text>sulfur hexafluoride; or</text></clause>
<clause id="H403C96449E7144B48C15E7C074375ECD"><enum>(vii)</enum><text>any other anthropogenically emitted gas that is determined by the Administrator of the Environmental Protection Agency, by regulation, to contribute to global warming to a non-negligible degree.</text></clause></subparagraph></paragraph></subsection></section> <section id="HE0A37733908241EFA079E7103F26219D" commented="no"><enum>4.</enum><header>Prohibiting hydraulic fracturing</header> <subsection id="H8867A9F2A11645CB913605729BEEEDC0"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Hydraulic fracturing is prohibited on all onshore and offshore land within the jurisdiction of the United States.</text></subsection>
<subsection id="H2F5647D8EDB3470989C4BD0474072242"><enum>(b)</enum><header>Definition</header><text>In this section, the term <term>hydraulic fracturing</term> means an operation conducted in an individual wellbore designed to increase the flow of hydrocarbons from a rock formation to the wellbore through modifying the permeability of reservoir rock by fracturing it, except that such term does not include enhanced secondary recovery, including water flooding, tertiary recovery, and other types of well stimulation operations.</text></subsection> <subsection id="H30453D9F0C1E40699D032D0EBD713C8B" commented="no"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect on January 1, 2027.</text></subsection></section>
<section id="H89526B8FCDD2439195D917712E188A1E"><enum>5.</enum><header>Ban on crude oil and natural gas exports</header>
<subsection id="HCA3DD613CB954D748610D7D8FC6566DE"><enum>(a)</enum><header>In general</header><text>Section 101 of title I of division O of the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="usc" parsable-cite="usc/42/6212a">42 U.S.C. 6212a</external-xref>) is amended to read as follows:</text> <quoted-block id="HF9758F38D39C42CEBF93FDFC988C9C9E" style="OLC"> <section id="H6801A134D4CA4D4296F0356E94017045"><enum>101.</enum><header>Prohibition on exports of crude oil and natural gas</header><text display-inline="no-display-inline">Except as provided in this section, notwithstanding any other provision of this Act, exports of domestically produced crude oil and natural gas, including liquefied natural gas and natural gas liquids, are prohibited. The Secretary of Commerce may, with the approval of the President, approve the export of crude oil for—</text>
<paragraph id="HCD5D835925FE40CFBFCAB88056BD04DF"><enum>(1)</enum><text>exchanges in similar quantity for convenience or increased efficiency of transportation with persons or the government of a foreign state;</text></paragraph> <paragraph id="H5648E3293BEC47E898D37D6E4E69C76B"><enum>(2)</enum><text>temporary exports for convenience or increased efficiency of transportation across parts of an adjacent foreign state which exports reenter the United States; and</text></paragraph>
<paragraph id="H04E6FBA904764EA5B802CD6C04DFEC2D"><enum>(3)</enum><text>the historical trading relations of the United States with Canada and Mexico.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HDC648252023E49DE974A4E6147393111"><enum>(b)</enum><header>Repeal relating to exportation of natural gas</header><text>Section 3 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b</external-xref>) is amended—</text>
<paragraph id="H79CCB753FD884D20AE57169521CFD4E3"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HC141B9520EFF4408B8D83841760B3D3F"><enum>(A)</enum><text>by striking <quote>export any natural gas from the United States to a foreign country or</quote>; and</text></subparagraph>
<subparagraph id="H15BA2AC366FE4D75900305C817BF028C"><enum>(B)</enum><text>by striking <quote>exportation or</quote>; and </text></subparagraph></paragraph> <paragraph id="H965264EF4BAC44438792B0B73B85339C"><enum>(2)</enum><text>by striking subsection (c).</text></paragraph></subsection></section>
