<section id="H68CF20B32A204C0AAAC6C4012EAEBA5F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Put Our Neighbors to Work Act of 2023</short-title></quote>.</text></section> <section id="H27C0EBF1666D47A483D609F91F1D8B97"><enum>2.</enum><header>Supervision of military construction projects</header><text display-inline="no-display-inline">Section 2851(c) of title 10, United States Code, is amended—</text> 
<paragraph id="H4500FE40C3F543D29C761B63BE1ABE7D"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or appropriated</quote> after <quote>funds authorized</quote> each place such term appears; and</text> </paragraph> <paragraph id="H8144763480A8414CA838E01974DD4011"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text> 
<subparagraph id="HE5464B2C16A94F2CA13B22A4814A0134"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>, deadline for bid submissions,</quote> after <quote>solicitation date</quote>;</text></subparagraph> <subparagraph id="H00B8D527DA2F47A08EF37D6DBF16C421"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>(including the address of such recipient)</quote> after <quote>contract recipient</quote>; and</text></subparagraph> 
<subparagraph id="H743063B6C56349C1B3B9653A041EA0C3"><enum>(C)</enum><text>by adding at the end the following new subparagraphs:</text> <quoted-block style="OLC" id="H7454A9907EB24256B00B98A85173121A" display-inline="no-display-inline"> <subparagraph id="H97B2202124694892B419705160B58921" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">Any subcontracting plan required under paragraph (4) or (5) of section 8(d) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)</external-xref>) for the project submitted by the contract recipient to the Secretary of Defense.</text></subparagraph> 
<subparagraph id="H371386D8CFAB4F90A76B3BE0AAB0D740" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">A detailed written statement describing and justifying any exception applied or waiver granted under—</text> <clause id="H4E8EB5EC019F46F6AB169099D5A75C96"><enum>(i)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">chapter 83</external-xref> of title 41;</text></clause> 
<clause id="H70FBEE9D405040B09E5789B73F09D2E5"><enum>(ii)</enum><text>section 4862 of this title; or</text></clause> <clause id="H313C507FDE0149B9A69AE8867E9902BE"><enum>(iii)</enum><text>section 4863 of this title.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HA008A0AA4C464508BB87A2A794BCCFAF"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (3), by adding at the end the following new sentence: <quote>Such information shall constitute a record for the purposes of chapters 21, 29, 31, and 33 of title 44.</quote>.</text> </paragraph></section> <section id="H11544F123438474CB3A6F941E225A28B" section-type="subsequent-section"><enum>3.</enum><header>Increasing transparency in certain military construction processes</header><text display-inline="no-display-inline">Section 2851 of title 10, United States Code, is amended—</text> 
<paragraph id="H7082F63766974503BACB430C7154EFA7"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsections (f) and (g), respectively; and</text></paragraph> <paragraph id="H053655D4E567462ABBB3014D3D05BD1F"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsections:</text> 
<quoted-block style="USC" id="H8B3AB3A56692488FA0070EA22D71B2DF" display-inline="no-display-inline"> 
<subsection id="H17F1B8F6A10848D89C73409F923004EB" commented="no"><enum>(d)</enum><header>Information and notice requirements regarding solicitation and award of subcontracts</header> 
<paragraph id="H5BE3D4F17631445FBD4646F34535A352" display-inline="yes-display-inline" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall require a recipient of a contract for a project described in subsection (c)(1) to publish in the single Governmentwide point of entry described under section 1708 of title 41 any solicitation for a subcontract under such contract with an estimated value of $250,000 or more.</text></paragraph> <paragraph id="H21948937139A42DF811FE36BCD5CEC29" commented="no" indent="up1"><enum>(2)</enum> <subparagraph id="HCDBE660B0FAF43C68DB93265E08565ED" display-inline="yes-display-inline" commented="no"><enum>(A)</enum><text>Solicitations described under paragraph (1) shall—</text> 
<clause id="H188E51297CC94B5B88C57C3A62228115" indent="up1" commented="no"><enum>(i)</enum><text>clearly identify the prime contractor for such solicitation; and</text></clause> <clause id="H25B648191EE8450487848FB218902B12" indent="up1" commented="no"><enum>(ii)</enum><text>be sortable by the congressional district, State, or foreign country in which the prime contract or subcontract will be performed.</text></clause></subparagraph> 
<subparagraph id="H1703F629DB52497693CCC41965C1F295" indent="up1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">In this paragraph, the term <term>State</term> means each of the several States, the District of Columbia, and each territory, commonwealth, or possession of the United States.</text></subparagraph></paragraph> <paragraph id="H40BADB30AB964A3AAA2CA59D74EAE3E4" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Each quarter, the Administrator of the General Services Administration shall make publicly available on the single Governmentwide point of entry a report containing a list of solicitations described under paragraph (1) that is sortable by the congressional district in which the prime contract or a subcontract under such a solicitation will be performed.</text></paragraph> 
<paragraph id="H869A1C8057A94B16806D104B32532C77" commented="no" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary of Treasury, in consultation with the Secretary of Defense, shall update the public website of Governmentwide spending data (commonly referred to as <quote>USASpending.gov</quote>) each fiscal year quarter to identify projects described in subsection (c)(1) carried out using amounts appropriated during the five fiscal years preceding the date of such update. Each update shall include—</text> <subparagraph id="H21B2C6B9D5E645FF8EAC81A4D58FB7F6" commented="no"><enum>(A)</enum><text>the prime contractor for each such project; and</text></subparagraph> 
<subparagraph id="H0F6D1581AE144A29AD49BA74D73D9739" commented="no"><enum>(B)</enum><text>any subcontracts awarded by such prime contractor for each such project.</text></subparagraph></paragraph></subsection> <subsection id="H1D1C452CCBC74C5A8A05D4E10EB834A2"><enum>(e)</enum><header>Exclusion for classified projects</header><text>The requirements of subsection (d) shall not apply to a classified project described in subsection (c)(1).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HEC3FC8095D1E4B7CBB866CADED83D572"><enum>4.</enum><header>Small business credit for local businesses</header><text display-inline="no-display-inline">Section 15 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="HBF93D293F28447758579EDCC0DB38A4D" display-inline="no-display-inline"> <subsection id="H82706E8450C945C09A95EB113B507943" commented="no"><enum>(z)</enum><header>Small business credit for local businesses</header> <paragraph id="H3188A28EAA5F42DB995228C501CD3E1C" commented="no"><enum>(1)</enum><header>Credit for meeting subcontracting goals</header><text display-inline="yes-display-inline">If a prime contractor awards a subcontract (at any tier) to a small business concern that has its principal office located in the same State as, or within a 60-mile radius of, the location of the work to be performed pursuant to the contract of the prime contractor, the value of such subcontract shall be doubled for purposes of determining compliance with the goals for procurement contracts under subsection (g)(1)(A) during each fiscal year of performance of such subcontract.</text></paragraph> 
<paragraph id="HD5284A2D0CD2466482D49AD4719D24B9" commented="no"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Along with the report required under subsection (h)(1), the head of each Federal agency shall submit to the Administrator, and make publicly available on the scorecard described in subsection (y), an analysis of the number and dollar amount of each subcontract awarded pursuant to paragraph (1) for each fiscal year of performance of such subcontract.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HA20A80A649564C158560BCDA72B565AD"><enum>5.</enum><header>Requirements relating to the award of covered military construction contracts</header> <subsection id="H5A0F09EB32BA4D1B915266C8B9054634"><enum>(a)</enum><header>Requirements for covered military construction contracts</header> <paragraph id="H557D0A1F71E742818CC60EA83F4AEF7A"><enum>(1)</enum><header>In general</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/169">chapter 169</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2851a">section 2851a</external-xref> the following new section:</text>

<section id="H7D2EEF440A0044A186F709BDEB72162A" section-type="subsequent-section"><enum>2851b.</enum><header>Requirements relating to the award of covered military construction contracts</header> 
<subsection id="HC080DD2A76824AD19FA8B6B465BF666E"><enum>(a)</enum><header>Local hire requirements</header> 
<paragraph id="H91FC8319E4E040989338292EE0500153" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent practicable, in awarding a covered military construction contract, the Secretary concerned shall give preference to an entity or individual that certifies that at least 51 percent of the total number of employees hired to perform the contract (including any employees hired by a subcontractor at any tier) will reside in the same covered State as, or within a 60-mile radius of, the location of the work to be performed pursuant to the contract. </text></paragraph> <paragraph id="H649EE23D9E5E4EB5A171F04EF36CCCA0"><enum>(2)</enum><header>Justification required</header><text display-inline="yes-display-inline">The Secretary concerned shall prepare a written justification, and make such justification available on the Internet site required under section 2851 of this title, for the award of any covered military construction contract to an entity or individual that is not described under paragraph (1).</text></paragraph></subsection> 
<subsection id="H1753EF9FF862413FA7DDC04AA2531BF1"><enum>(b)</enum><header>Licensing</header><text display-inline="yes-display-inline">A contractor and any subcontractors performing a covered military construction contract shall be licensed to perform the work under such contract in the covered State in which the work will be performed.</text></subsection> <subsection id="H4B69C53B83FB48D883D660547CBD03F7" commented="no"><enum>(c)</enum><header>Monthly report</header><text display-inline="yes-display-inline">Not later than 10 days after the end of each month, the Secretary of Defense shall submit to the congressional defense committees a report identifying for that month the following:</text> 
<paragraph id="HB344D6DFD9DA404B8A7EE1F7D7765E14" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Each covered military construction contract and each subcontract of a covered military construction contract awarded during that month.</text></paragraph> <paragraph id="H961FC7F544C645CA900B0945DCDEB3F6" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The location of the work to be performed pursuant to each contract and subcontract identified pursuant to paragraph (1).</text></paragraph> 
<paragraph id="HF8A0CFB98EB446ED96252340DFC74321" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The prime contractor and any subcontractor performing each contract and subcontract identified pursuant to paragraph (1).</text></paragraph> <paragraph id="HBD3F686A481E41048A6B4DB804E94D75" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">The estimated value of each contract and subcontract identified pursuant to paragraph (1).</text></paragraph></subsection> 
<subsection id="H501DD5FF0EFB48C1A83E434AA860EAC2"><enum>(d)</enum><header>Exclusion of classified projects</header><text display-inline="yes-display-inline">This section does not apply to a classified covered military construction project.</text></subsection> <subsection id="HF7916ED369DF4B8BB02F9C8D2B3F6870"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HDA11167FE32F44CA91DCA458FD698143"><enum>(1)</enum><header>Covered military construction contract</header><text display-inline="yes-display-inline">The term <term>covered military construction contract</term> means a contract for work on a military construction project, military family housing project, or Facilities Sustainment, Restoration, and Modernization project carried out in a covered State.</text></paragraph> <paragraph id="HD06FAAD26F684FD0B715FBA04FCE7923"><enum>(2)</enum><header>Covered State</header><text>The term <term>covered State</term> means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, or the Commonwealth of the Northern Mariana Islands.</text></paragraph> 
<paragraph id="H6AF88E0C736F41848743DEE5FD56D8B9"><enum>(3)</enum><header>Member of Congress</header><text>The term <term>Member of Congress</term> has the meaning given in section 2106 of title 5.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> <subsection id="HD2CA4C67BC7F4497A316611A5FDD6827" commented="no"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Section 2851b of title 10, United States Code, as added by subsection (a), shall apply with respect to a covered military construction contract, as defined in such section, entered into on or after the date of the enactment of this Act.</text></subsection></section>
