<section id="HF8CDF4B9D09F44F7962604E60997BBF2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting the Right to Keep and Bear Arms Act of 2023</short-title></quote>.</text></section> <section id="H452976D303A1470FB61D2215EE74F378"><enum>2.</enum><header>Limitation on declarations by President</header><text display-inline="no-display-inline">The President (or any designee thereof) shall not, for the purpose of imposing gun control, declare an emergency pursuant to the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>) or an emergency or major disaster pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></section> 
<section id="H1FEBEF3A38ED4BAA82C012A4F745D4B1"><enum>3.</enum><header>Limitation on declarations by HHS</header><text display-inline="no-display-inline">The Secretary of Health and Human Services shall not, for the purpose of imposing gun control, declare a public health emergency pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>).</text></section> <section id="H90BB99D23F234A27A6351F44D7E2104C"><enum>4.</enum><header>Firearms policies</header><text display-inline="no-display-inline">Section 706(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5207">42 U.S.C. 5207(a)</external-xref>) is amended—</text> 
<paragraph id="H899BA30DA3944C3DAE31340F841DA976"><enum>(1)</enum><text>in paragraph (3) by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph> <paragraph id="H8CD0A224AE0841F7A6B91F3BEA15BDFF"><enum>(2)</enum><text>in paragraph (4) by striking the period and inserting a semicolon; and</text></paragraph> 
<paragraph id="H6D01CB4783D84A34923344C43CE81EFB"><enum>(3)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="H63DD747083B94D1EB56460F47D864DA5" display-inline="no-display-inline"> <paragraph id="H81C08A577CB64B25BF2D1C391C6E7E57"><enum>(5)</enum><text display-inline="yes-display-inline">prohibit the possession, manufacture, sale, or transfer of arms, as protected by the Second Amendment to the Constitution of the United States; </text></paragraph> 
<paragraph id="H202A32AD52744BE9BAE4B7370A33E127"><enum>(6)</enum><text display-inline="yes-display-inline">prohibit the possession, manufacture, sale, or transfer of ammunition;</text></paragraph> <paragraph id="H864AA33EC6CC48B498EE773E8B703B70"><enum>(7)</enum><text>prohibit the possession, manufacture, sale, or transfer of ammunition feeding devices; or</text></paragraph> 
<paragraph id="H108048C9DBDE4643B11A4442E7A90770"><enum>(8)</enum><text>prohibit the possession, manufacture, sale, or transfer of firearms accessories. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
