<section id="HC018885FBD4A43CD837D53519FFEC0FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Veterans Claim Options Act</short-title></quote>.</text></section> <section id="HD2C614627317488FA549CFBC0D6DAD64" section-type="subsequent-section"><enum>2.</enum><header>Certain rules of evidence in certain claims under laws administered by the Secretary of Veterans Affairs</header> <subsection id="H5173BE557A8D434C8DF9109BD7267E48"><enum>(a)</enum><header>Evidence in supplemental claims</header> <paragraph id="H0186047ACEFC4A2CB2B35D0394858C15"><enum>(1)</enum><header>In general</header><text>Subsection (a) of section 5108 of title 38, United States Code, is amended to read as follows:</text>

<subsection id="H89244555B3EC4CCD95C1C3DA9D9D89B3"><enum>(a)</enum><header>In general</header> 
<paragraph id="HB12BCCAE961E4CDC8D3643996C30A49F" display-inline="yes-display-inline"><enum>(1)</enum> 
<subparagraph id="H8F36652E7C404FE0804A25176DBE7CAC" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary shall readjudicate a claim if the claimant files a supplemental claim before the date that is one year after the date on which the agency of original jurisdiction issues a decision with respect to such claim. </text></subparagraph> <subparagraph id="HDE9587CF23C84FCCB89E799FF3AB1390" indent="up2"><enum>(B)</enum><text>In readjudicating a claim under subparagraph (A), the Secretary shall consider all of the evidence of record.</text></subparagraph></paragraph> 
<paragraph id="HE14828B8139043119A3A2135AD1806AC" indent="up1"><enum>(2)</enum> 
<subparagraph id="HE6549EFB95C44B358B7D485F5B46AD7F" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary shall readjudicate a claim if the claimant presents new and relevant evidence with respect to a supplemental claim—</text> <clause id="HDDBD4A86FEBA435D8CAC03CE4AA95090" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">more than one year after the date of the decision of the agency of original jurisdiction with respect to such claim;</text></clause> 
<clause id="HE8E92F1530A64C86BEF3D8F41F4A62B5" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">after the Board of Veterans' Appeals issues a decision with respect to such claim; or</text></clause> <clause id="H2641713E2D8C4E54BFB82726EFF2B1FD" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">after the Court of Appeals for Veterans Claims issues a decision with respect to such claim.</text></clause></subparagraph> 
<subparagraph id="HC50FEDAA123E47DFAECDB5AB508F54F4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In readjudicating a claim under subparagraph (A), the Secretary shall consider all of the evidence of record and the new and relevant evidence described in such subparagraph. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HFB3DF4EDC653434CBA7C559996C83DC8" commented="no"><enum>(2)</enum><header>Conforming amendments</header> <subparagraph id="HD48484AB9CEE40E18B2AF1486E689D4F"><enum>(A)</enum><header>Options following decision by agency of original jurisdiction</header><text>Section 5104C of such title is amended—</text> 
<clause id="H431D43482B8649FCB82F33D5B56CD106"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(B), by striking <quote>section 5108</quote> and inserting <quote>section 5108(a)(1)</quote>; and</text></clause> <clause id="H3446A936B80645548A8EE68E26CC6559"><enum>(ii)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>section 5108</quote> and inserting <quote>section 5108(a)(2)</quote>.</text></clause></subparagraph> 
<subparagraph id="H7017BA1A157D4BD1BE62A968BB91884F"><enum>(B)</enum><header>Effective dates of awards</header><text>Section 5110(a)(2) of such title is amended—</text> <clause id="H5065BBC21B8B4FA89DC5A7E469B9B1AE"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>section 5108</quote> and inserting <quote>section 5108(a)(1)</quote>; and</text></clause> 
<clause id="HB852B2C03297437CA1C9CBC0A6044E52"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraphs (D) and (E), by striking <quote>section 5108</quote> both places it appears and inserting <quote>section 5108(a)(2)</quote>.</text></clause></subparagraph> <subparagraph id="HC21CE4E2F02E484FA906876AD2126232"><enum>(C)</enum><header>Jurisdiction of the Board of Veterans’ Appeals</header><text display-inline="yes-display-inline">Section 7104(b) of such title is amended by striking <quote>section 5108</quote> and inserting <quote>section 5108(a)(2)</quote>. </text></subparagraph></paragraph> 
<paragraph id="H6184DCCBF83C45B2ABE0E2F1E3C14292"><enum>(3)</enum><header>Retroactivity</header><text display-inline="yes-display-inline">The amendments made by this subsection shall apply to supplemental claims filed on or after August 23, 2017.</text></paragraph> <paragraph id="HBA74338BA97D46F58702909928C5B0B8"><enum>(4)</enum><header>Regulations</header><text>The Secretary of Veterans Affairs shall prescribe regulations to carry out the amendments made by this subsection not later than 180 days after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H1657181B9F8348DBAE450F654731BC69"><enum>(b)</enum><header>Evidence in cases remanded by the Court of Appeals for Veterans Claims</header><text display-inline="yes-display-inline">Section 7113 of title 38, United States Code, is amended by adding at the end the following new subsection:</text> <quoted-block style="USC" id="H539EC40C6B054D719F1F3CAC3565B60B" display-inline="no-display-inline"> <subsection id="H48300BA3EE304399912D7F1B2249BD5A"><enum>(d)</enum><header>Cases remanded by the Court of Appeals for Veterans Claims</header> <paragraph id="H6FD73C93D3F74CCCB063F3C90471089C" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), for cases remanded to the Board by the Court of Appeals for Veterans Claims, the evidentiary record before the Board shall be limited to the evidence previously considered by the Board in such case.</text></paragraph> 
<paragraph id="H54CA2A7195A94E808EDDD5C0E58410D3" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The evidentiary record before the Board for cases described in paragraph (1) shall include evidence submitted by the appellant and his or her representative, if any, within 90 days following such remand, which the Board shall consider in the first instance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
