<official-title display="yes">To require the Secretary of Health and Human Services to publish all information in the possession of the Department of Health and Human Services relating to the origin of COVID–19, and for other purposes.</official-title>

<section section-type="section-one" id="H474C3C4E0A344A38870502F03FA6E22E" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>HHS COVID–19 Origin Transparency Act of 2023</short-title></quote>.</text></section> <section id="HFEF19481D40746958098C8D0A82F2C18" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Publication of HHS information related to the origin of COVID–19</header> <subsection id="H17786D40214F4413AF38D6D805F0826B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall—</text>
<paragraph id="HC314F222305148DC8A2B139B4C9C0429"><enum>(1)</enum><text>except as provided in subsection (d), publish all information described in subsection (b); and</text></paragraph> <paragraph id="H91996E3AA7144604B9135DD81EE087DA"><enum>(2)</enum><text>submit a report to the Congress containing a summary of each item of information that is described in subsection (b) but withheld from such publication pursuant to subsection (d).</text></paragraph></subsection>
<subsection id="HEAB76D0E48174374AC19B5A3764F54B1" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Information described</header><text display-inline="yes-display-inline">The information described in this subsection is any and all information in the possession of the Department of Health and Human Services (including any agency, office, operating or staffing division, and any other component of the Department, including the National Institutes of Health, the Centers for Disease Control and Prevention, the Food and Drug Administration, the Administration for Strategic Preparedness and Response, the Health Resources and Service Administration, the Office of National Security, the Office of Inspector General, and any person under contract to the Department) relating to the Coronavirus Disease 2019 (COVID–19) outbreak, coronavirus research including vaccine development, or the concealment of information about the COVID–19 outbreak, including any such information that consists of—</text> <paragraph id="H404FBAB53E204E6F818FC2AD136F63CE"><enum>(1)</enum><text>unpublished and unreleased records including—</text>
<subparagraph id="HFBE27248C66E4A91B3702C946CAB0893"><enum>(A)</enum><text>the report titled <quote>One Health Zoonotic Disease Prioritization workshop in China</quote> (prepared by the Centers for Disease Control and Prevention in 2019) and related records;</text></subparagraph> <subparagraph id="H87D52704B8AF491189D429140C50BF99"><enum>(B)</enum><text>all records pending authorization or other approval from any organization of the People’s Republic of China;</text></subparagraph>
<subparagraph id="H016E4901E9BD490CA009488D956CF5CE"><enum>(C)</enum><text display-inline="yes-display-inline">coronavirus research genetic sequence records in the Sequence Read Archive of the National Institutes of Health and all requests from higher educational institutions, research institutions, or other persons or entities in China to withdraw or delay sequence data publication;</text></subparagraph> <subparagraph id="H57D9B8866A08445CB5264DFE823D384C"><enum>(D)</enum><text display-inline="yes-display-inline">all research applications submitted to an agency of the Public Health Service seeking funding to undertake coronavirus-related research that were not funded by the relevant agency; </text></subparagraph>
<subparagraph id="H2C7609C6FF4C4340BFD6B5ECA0FF2C78"><enum>(E)</enum><text>all coronavirus records;</text></subparagraph> <subparagraph id="H8B31372443244ABB98E101F5949EFB95"><enum>(F)</enum><text>all coronavirus research records, including—</text>
<clause id="HF044270664E64FCFA8145FB13101A56C"><enum>(i)</enum><text>grant applications, grant research project annual progress reports, and final reports; and</text></clause> <clause id="HF8E4BDC2730B498388619680CEA3CF5D"><enum>(ii)</enum><text>records of compensation for each researcher—</text>
<subclause id="H1F894091F3E54AB2A88486BF6AD522FE" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">who was an employee or contractor of the Government of the People’s Republic of China or any entity (including any public university) controlled by such Government; and</text></subclause> <subclause id="HC8302F4368F64663812EEDEFD01BA055" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">whose compensation was funded in part, directly or indirectly, by the Department of Health and Human Services; and</text></subclause></clause></subparagraph>
<subparagraph id="HAE1E172373F24D35894F81AB528D53C5"><enum>(G)</enum><text>all records related to the suspension, denial, termination, or other risk mitigation actions related to coronavirus research projects;</text></subparagraph> <subparagraph id="HE23278818FE3492DB104408530839AAC"><enum>(H)</enum><text>all records of the Office of Inspector General of the Department of Health and Human Services that include—</text>
<clause id="HBAC14E61D8854484B6BACB8B2A07CAC2"><enum>(i)</enum><text display-inline="yes-display-inline">hotline records, including all referrals from the operating divisions of the Department of Health and Human Services, including the National Institutes of Health;</text></clause> <clause id="HAD71A780FED44DD1ACD2895F7CAE19B8"><enum>(ii)</enum><text display-inline="yes-display-inline">communications related to potential misconduct by employees of the Department of Health and Human Services, including Anthony Fauci and Francis Collins; </text></clause>
<clause id="H9BA88AD1995B41F4AFF910D4AFDF2F6F"><enum>(iii)</enum><text>communications related to potential monetary fraud or research misconduct involving grants of the National Institutes of Health, including any such grants awarded to EcoHealth Alliance; and</text></clause> <clause id="H1BE4BC9EB6CA4F33B9A769C7D0CE5CCC"><enum>(iv)</enum><text>all EcoHealth Alliance audit records;</text></clause></subparagraph>
<subparagraph id="H00DD1F5B9147459C8FD10AC584B3C114"><enum>(I)</enum><text>all records involving EcoHealth Alliance research projects and personnel including—</text> <clause id="H2ED48490582A4896B74D3D104BE4DB22"><enum>(i)</enum><text>all names, salaries, levels of effort, and Department of State clearances;</text></clause>
<clause id="H0684D4A1E35B4C87B57249A86EA467E9"><enum>(ii)</enum><text>all peer review records; and</text></clause> <clause id="H51610FAF30D5411E88B89CF16B26961F"><enum>(iii)</enum><text>all financial records;</text></clause></subparagraph>
<subparagraph id="H5AA1F68BBBD143308BFF210B364460D9"><enum>(J)</enum><text>all outbreak-related communication records including observations, reports, memoranda, and requests, except individually identifiable patient health information, from—</text> <clause id="H97F667A8A30A4FCFB10AB1845802F62B"><enum>(i)</enum><text display-inline="yes-display-inline">all personnel of the Department of Health and Human Services stationed in China;</text></clause>
<clause id="H9D2C64E5B4EC481181B3315BA9677A3C"><enum>(ii)</enum><text display-inline="yes-display-inline">all foreign nationals from China on visas sponsored directly or indirectly by the Department of Health and Human Services, including—</text> <subclause id="H3E46A1127AEC4AF79FF65B1CCC4A7953"><enum>(I)</enum><text>personnel located in the United States; and</text></subclause>
<subclause id="H51A05B249BA74C0A851A43B3FA2A9767"><enum>(II)</enum><text>personnel teleworking from China;</text></subclause></clause></subparagraph> <subparagraph id="H0FD725D4D2C84C9DB1265B8D3066C9BB"><enum>(K)</enum><text display-inline="yes-display-inline">all memoranda of understanding, data sharing agreements, and intellectual property transfer commitments between the Department of Health and Human Services and academic or public health institutions in the People’s Republic of China, including—</text>
<clause id="H92A25BB556C842F1AB2B6F119E5638DC"><enum>(i)</enum><text>the Memorandum of Understanding for the Collaborative Program on Emerging and Re-emerging Infectious Diseases;</text></clause> <clause id="HC049EACC47D543008118596680D4EC72"><enum>(ii)</enum><text>all material transfer agreements and intellectual property transfer records related to coronavirus research and vaccine development; and</text></clause>
<clause id="H3509A3B3CEC9483C96364E0847F503F0"><enum>(iii)</enum><text display-inline="yes-display-inline">all agreements between Department of Health and Human Services-sponsored principal investigators and any organization involving the transfer of coronavirus research data to academic or public health institutions in the People’s Republic of China; and</text></clause></subparagraph> <subparagraph id="H0B57352F36DC4F1B92AD63C07DD85A54"><enum>(L)</enum><text>analysis of the first 6,000 patients hospitalized in Wuhan, China, of whom 1,100 had severe COVID–19 disease;</text></subparagraph></paragraph>
<paragraph id="H667E0E615CAE4FF491724E969039E06D"><enum>(2)</enum><text>a record pertaining to sick researchers in Wuhan, China, during the fall of 2019, including for any such researcher—</text> <subparagraph id="H7C2FD0AD20894827BCAE754EC602F6B8"><enum>(A)</enum><text>the researcher’s name, laboratory name, laboratory role, symptoms, and date of symptom onset;</text></subparagraph>
<subparagraph id="HFC942D5257674668B6C8FA28BB913DFF"><enum>(B)</enum><text>whether the researcher was involved with or exposed to coronavirus research in Wuhan research laboratories;</text></subparagraph> <subparagraph id="HED07EDFA5F1D48FE811B12624A0BA549"><enum>(C)</enum><text>whether the researcher visited a hospital or medical clinic while they were ill; and</text></subparagraph>
<subparagraph id="H889558FD294C4D66A59BAF7A1EC75E0E"><enum>(D)</enum><text>a description of any other actions taken by the researcher that may suggest they were experiencing a serious illness at the time;</text></subparagraph></paragraph> <paragraph id="H23CDB17990B443F0A28613C56FF9110A"><enum>(3)</enum><text display-inline="yes-display-inline">a record pertaining to coronavirus research conducted in cooperation with any Chinese national public research university affiliated with and funded by the Ministry of Industry and Information Technology of China, including Beihang University, Beijing Institute of Technology, Harbin Engineering University, Harbin Institute of Technology, Nanjing University of Aeronautics and Astronautics, Nanjing University of Science and Technology, Northwestern Polytechnical University, PLA Naval University of Engineering, PLA National Defence University, PLA Information Engineering University, and the PLA Academy of Military Science; and</text></paragraph>
<paragraph id="H8F6761F08DEC421194B27D9DDA10331A"><enum>(4)</enum><text>a record pertaining to concerns of bioweapon programs in China, including all records related to the evaluation and analysis of the SARS–CoV–2 virus as a potential bioweapon, including records from the Integrated Research Facility at Fort Detrick.</text></paragraph></subsection> <subsection id="HCD26B3BA6EE9473B9F8DF69BB561E200"><enum>(c)</enum><header>Identification of information supplied to intelligence community</header><text display-inline="yes-display-inline">In publishing information pursuant to subsection (a), the Secretary shall identify any such information that was supplied by the Department of Health and Human Services to any agency of the intelligence community in support of the intelligence community’s COVID–19 origins assessments from the onset of the outbreak of COVID–19 through the date of enactment of this Act.</text></subsection>
<subsection id="H762D4137B11F413BAC52ECADFDCAE010" commented="no"><enum>(d)</enum><header>Withholding of certain information</header><text display-inline="yes-display-inline">Except as inconsistent with subsection (b), the Secretary may, in accordance with other applicable law, withhold or redact from publication under subsection (a)(1) any information that—</text> <paragraph id="HC60E86E3FD5E417E8A568174260A3D6A" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">is classified and for which the Department of Health and Human Services was not the original classification authority;</text></paragraph>
<paragraph id="HB6267D5B62B347B2BDDF92B4D599C1FF" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">is individually identifiable information; or</text></paragraph> <paragraph id="HB666A903D7FD43109FAE3DE23293E532" commented="no"><enum>(3)</enum><text>is national security, confidential commercial, or proprietary information.</text></paragraph></subsection>
<subsection id="H10C51062F9EA4E84807A9603BBCCC888"><enum>(e)</enum><header>Declassification</header><text>The Secretary shall—</text> <paragraph id="H72450CA2645B42DC8DD3D6F68378F82A"><enum>(1)</enum><text display-inline="yes-display-inline">to the extent necessary to publish pursuant to subsection (a)(1) all information described in subsection (b), declassify any such information for which the Department of Health and Human Services was the original classification authority; or</text></paragraph>
<paragraph id="HF6D13BF05BCD4E7B931246D891A9C2EB"><enum>(2)</enum><text display-inline="yes-display-inline">certify in the publication that no such classified information exists.</text></paragraph></subsection> <subsection id="HFC05363FBDBA441CAA00E6D529EDD19C" commented="no"><enum>(f)</enum><header>Failure To publish</header><text display-inline="yes-display-inline">Beginning on the day that is 91 calendar days after the date of enactment of this Act—</text>
<paragraph id="H9A3369A8275241FAA04123946AE62843"><enum>(1)</enum><text>of the unobligated amounts appropriated or otherwise made available to the immediate Office of the Secretary of Health and Human Services—</text> <subparagraph id="HB47D80F606784687B2EC5EC0163DFF05" commented="no"><enum>(A)</enum><text>there is rescinded an amount equal to $1,000,000 for each calendar day on which the Secretary of Health and Human Services fails—</text>
<clause id="H905D080B1468444C8379B7955C0BE1B3"><enum>(i)</enum><text>to make the publication required by subsection (a)(1); or</text></clause> <clause id="H757C1D522DAD4B41AE4AA638C8135588"><enum>(ii)</enum><text>to submit the report required by subsection (a)(2); and</text></clause></subparagraph>
<subparagraph id="HA2EDBBA182AD41D899181FF11BC6F8E5" commented="no"><enum>(B)</enum><text>the amount so rescinded shall be deposited into the general fund of the Treasury for the sole purpose of reducing the national debt; and</text></subparagraph></paragraph> <paragraph id="H4993C75171E34E4BA8D147EF65A4ACEE"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary may not reprogram or use any other funds to replace any funds that are rescinded under paragraph (1).</text></paragraph></subsection></section>
