R. 5328</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230901">September 1, 2023</action-date><action-desc><sponsor name-id="G000595">Mr. Good of Virginia</sponsor> (for himself, <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>, <cosponsor name-id="L000578">Mr. LaMalfa</cosponsor>, <cosponsor name-id="P000605">Mr. Perry</cosponsor>, <cosponsor name-id="L000564">Mr. Lamborn</cosponsor>, <cosponsor name-id="T000165">Mr. Tiffany</cosponsor>, and <cosponsor name-id="B001302">Mr. Biggs</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Civil Rights Act of 1964 to make using certain pedagogies in any program or activity receiving Federal financial assistance a violation of such Act, and for other purposes.</official-title></form><legis-body id="H96EF44AA83B2417ABE4945910C83BB88" style="OLC"><section id="H23C9B6F91215438D857F4D09A7DFFB37" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defending Students’ Civil Rights Act of 2023</short-title></quote>. </text></section><section id="H51FB128448AE4FEA845B76EEF5574760"><enum>2.</enum><header>Rule of construction making certain pedagogies a violation of the Civil Rights Act</header><text display-inline="no-display-inline">Title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="appropriations" id="H8837235BEFD6420C9FDB1BEECA974B01" display-inline="no-display-inline"><section id="HEE7C41E125A74AC09C8C94315F2196DF"><enum>607.</enum><text display-inline="yes-display-inline">It is a violation of section 601 to use Federal financial assistance for any program or activity that is premised on the following:</text><paragraph id="HB340369759A144CEA71CF3D8BC5F0703"><enum>(1)</enum><text>The United States is a Nation founded on White supremacy and oppression, or that White supremacy and oppression are at the root of American society.</text></paragraph><paragraph id="H43178C7D67E8458EAF4F66C3AC6D1078"><enum>(2)</enum><text>One race or sex is inherently superior to another race or sex.</text></paragraph><paragraph id="HC79C04B885EA476B9F1B866CF740217F"><enum>(3)</enum><text>The United States is fundamentally racist or sexist.</text></paragraph><paragraph id="H5960EC2AC06449DC951C9BD7CD0750AA"><enum>(4)</enum><text>An individual, by virtue of his or her race or sex, is inherently racist, sexist, or oppressive, whether consciously or unconsciously.</text></paragraph><paragraph id="H4A89739E53474343AF25A1F88AA52644"><enum>(5)</enum><text>An individual should be discriminated against or receive adverse treatment solely or partly because of the individual’s race or sex.</text></paragraph><paragraph id="H0088E1CD0469482894329158F5D5962F"><enum>(6)</enum><text>Members of one race or sex cannot and should not attempt to treat others without respect to race or sex.</text></paragraph><paragraph id="H7161669045014052B43AD2063BA27578"><enum>(7)</enum><text>An individual’s moral character is necessarily determined by the individual’s race or sex.</text></paragraph><paragraph id="H5A816FFE944B471D9A0C3766B067F618"><enum>(8)</enum><text>An individual, by virtue of the individual’s race or sex, bears responsibility for actions committed in the past by other members of the same race or sex.</text></paragraph><paragraph id="H0A0DE7DDF84542C1956C9C3C14D916F8"><enum>(9)</enum><text>Any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of his or her race or sex.</text></paragraph><paragraph id="H11D2851D722E439D850073A1651FD275"><enum>(10)</enum><text>Meritocracy or traits such as a hard work ethic are racist or sexist, or were created by a particular race to oppress another race.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
