R. 5324</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230901">September 1, 2023</action-date><action-desc><sponsor name-id="E000297">Mr. Espaillat</sponsor> (for himself, <cosponsor name-id="G000582">Mrs. González-Colón</cosponsor>, <cosponsor name-id="C001125">Mr. Carter of Louisiana</cosponsor>, <cosponsor name-id="T000487">Ms. Tokuda</cosponsor>, <cosponsor name-id="M001219">Mr. Moylan</cosponsor>, and <cosponsor name-id="C001072">Mr. Carson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HBU00">the Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To make available necessary disaster assistance for families affected by major disasters, and for other purposes.</official-title></form><legis-body id="H724B1611B4D242D284F97A25124FA234" style="OLC"><section id="H6C591079420A439190CB981BA05D7E3E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Survivors of Major Disasters Act</short-title></quote>.</text></section><section id="HDF979559F69C4A02AC4CB3CCE914431E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H823DA478D3DA4F4DA477548236682A23"><enum>(1)</enum><header>FEMA</header><text>The term <quote>FEMA</quote> means the Federal Emergency Management Agency.</text></paragraph><paragraph id="HC7C071C9CA8146BAB93B60FAD0446411"><enum>(2)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of FEMA.</text></paragraph></section><section id="H9A074A1EAF274D74835A6DDB852789B3"><enum>3.</enum><header>Eligibility for and use of disaster assistance</header><subsection id="H9AD7F023F3E14387A79BE2F1A1CE7E60"><enum>(a)</enum><header>Evidence</header><paragraph id="HB92AD3558BF74CF1853126CAD21A8821"><enum>(1)</enum><header>Consideration</header><text display-inline="yes-display-inline">Where an individual or household does not have documented ownership rights in their predisaster primary residence, in making a determination to provide assistance pursuant to paragraphs (2) and (3) of section 408(c) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(c)</external-xref>), the President shall consider an individual or household claim to having constructive ownership where evidence supports that it is more likely than not the individual or household has such ownership.</text></paragraph><paragraph id="H97C266C5643F49078F42C285BC11C404"><enum>(2)</enum><header>Forms of evidence</header><text display-inline="yes-display-inline">In determining whether it is more likely than not that an individual or household has constructive ownership under paragraph (1), the Administrator shall consider all evidence provided by an individual or household, including the following:</text><subparagraph id="H6EFE0B56499941518621D247A7EDD235"><enum>(A)</enum><text>The deed or title for the applicable property.</text></subparagraph><subparagraph id="H1568ADE6BB444EF6A0F04B112D619E3D"><enum>(B)</enum><text>A mortgage payment booklet or another mortgage document.</text></subparagraph><subparagraph id="HEC89B0E1F4C6489A80C7665E16830C6F"><enum>(C)</enum><text>Property title of mobile home certificate of title.</text></subparagraph><subparagraph id="H629746405EE84802B12AD1859F11F075"><enum>(D)</enum><text>A real estate property tax receipt.</text></subparagraph><subparagraph id="H8477124DC3C0441396D071BA06956FC6"><enum>(E)</enum><text>A will and testament with the name and address of the individual that conveys the individual is the owner.</text></subparagraph><subparagraph id="H7A57D50BF8714349B8639C1253893834"><enum>(F)</enum><text>In a State that does not require a will and testament for the transfer of immovable property, a death certificate and birth certificate that establishes an automatic transfer of legal ownership.</text></subparagraph><subparagraph id="H4DD89FC569934D3AB35449B03D2F7CA5"><enum>(G)</enum><text>Any other documentation, certification, identification, or proof of occupancy or ownership not included on this list that can reasonably link the individual requesting assistance to the applicable property, as determined by the President.</text></subparagraph></paragraph><paragraph id="HD70DFE2FC43E4E0F8123E21A1BE3DCCB"><enum>(3)</enum><header>Declarative statement</header><subparagraph id="HF060A2664D054BE0A60FFC06B2FAF597"><enum>(A)</enum><header>In general</header><text>Where evidence of constructive ownership is not sufficient, the Administrator may require the individual or household to provide a declarative statement, signed under penalty of perjury, that describes why the individual or household is the constructive owner of the property.</text></subparagraph><subparagraph id="H3E49E38DA11E431EB3F73FCB6E9D1D24"><enum>(B)</enum><header>Prohibition of notarization</header><text>The Administrator may not require notarization of a declarative statement submitted under this paragraph.</text></subparagraph></paragraph></subsection><subsection id="H0F6E3813FB704F6E9C0012EE5EF3E44B"><enum>(b)</enum><header>Definition of constructive ownership</header><text>In this section, the term <quote>constructive ownership</quote> means that an individual’s or household’s residence is owner-occupied, as determined by the Administrator, the purposes of section 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>).</text></subsection><subsection id="H72496BC8CAA0469A84E831F5FF5FBE96"><enum>(c)</enum><header>Applicability</header><text>This section shall apply to funds appropriated on or after the date of enactment of this Act.</text></subsection></section><section id="HAC7908FE37704D009ED611AE92FF34DD"><enum>4.</enum><header>Repair and rebuilding</header><subsection id="H3E191A67CA07454187B5B01F3B9AD8A0"><enum>(a)</enum><header>Housing assistance</header><text>Section 408(b)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(b)(1)</external-xref>) is amended—</text><paragraph id="H1078E93E655E46D49A757F74B9AE6BF2"><enum>(1)</enum><text>by striking <quote>rendered uninhabitable</quote> and inserting <quote>damaged by a major disaster</quote>; and</text></paragraph><paragraph id="H0E4D162FA10849FA9BC3DBB017B02D7F"><enum>(2)</enum><text>by striking <quote>uninhabitable, as a result of damage caused by a major disaster</quote> and inserting <quote>damaged by a major disaster</quote>.</text></paragraph></subsection><subsection id="HE3EE1A1658E84058B0EA85D0F09F9E65"><enum>(b)</enum><header>Types of housing assistance</header><text>Section 408(c)(4) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>) is amended by striking <quote>in cases in which</quote> and all that follows through the end of the paragraph and inserting <quote>if the President determines such assistance is a cost effective alternative to other housing solutions, including the costs associated with temporary housing provided under this section.</quote>.</text></subsection><subsection id="H42D0B98C50EF4E5B8A1F9D4D525F39D6"><enum>(c)</enum><header>Provision of grants as pilot program</header><text display-inline="yes-display-inline">Section 408(f)(3)(J) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(f)(3)(J)</external-xref>) is amended—</text><paragraph id="H4478A84F9B5E4D9E851FCAA6DD4F3F2C"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ii) by striking <quote>Not later than 2 years after the date of enactment of this paragraph, the Administrator</quote> and inserting <quote>The Administrator</quote>; and</text></paragraph><paragraph id="HD4113D0C248843DB8A0079950D693BAF"><enum>(2)</enum><text>in clause (iii)—</text><subparagraph id="H969CC4A7E6704FD8B8109346BF987B49"><enum>(A)</enum><text>by striking <quote>2 years after the date of enactment of this paragraph or</quote>; and</text></subparagraph><subparagraph id="H44953FF375034622AEC4B893E4779E62"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>, whichever occurs sooner</quote>.</text></subparagraph></paragraph></subsection><subsection id="HDF7DD2E396834F71B47AFBE669A709AD" commented="no"><enum>(d)</enum><header>Applicability</header><text>This section and the amendments made by this section shall only apply to—</text><paragraph id="H13EBA884FD884D508DA3AD6772836E91" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">applications received on or after the date of enactment of this Act; and</text></paragraph><paragraph id="H6EF34ADC29624059AA3E74196160F51E" commented="no"><enum>(2)</enum><text>amounts appropriated on or after the date of enactment of this Act.</text></paragraph></subsection></section><section id="HFF34F29D8542416B9B9F45806867567B"><enum>5.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
