<section id="HBE6C4B9DA9004E80AAF656DD886B1282" section-type="section-one"><enum>1.</enum><header>Equivalent authority to carry out certain projects at facilities of the National Guard and the Air National Guard</header>
<subsection id="H396330AEFB0741E481BCF5EDCBC73BC2"><enum>(a)</enum><header>Revision of definition</header><text>Paragraph (4) of section 2700 of title 10, United States Code, is amended—</text> <paragraph id="HA8963CF8003A4164B01876CFDD05DF3A"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>State-owned</quote>;</text></paragraph>
<paragraph id="HC0319C3A4F26412F9A316A76C75DBB7B"><enum>(2)</enum><text>by striking <quote>owned and operated by a State when such land is</quote>; and</text></paragraph> <paragraph id="HFC2AB59C264D47818CE883E329BB7E01"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>even though such land is not under the jurisdiction of the Department of Defense</quote> and inserting:</text>
<quoted-block style="USC" id="HFA760A0B76DE458081E658E33D8F3E75" display-inline="yes-display-inline"><text display-inline="yes-display-inline">without regard to—</text> <subparagraph id="HDEEBB5CDF9BF41998C98896ABDEAA84D"><enum>(A)</enum><text display-inline="yes-display-inline">the owner or operator of the facility; or</text></subparagraph>
<subparagraph id="HC7B8C74DD12048A38CA475FDBD7F70C2"><enum>(B)</enum><text>whether the facility is under the jurisdiction of the Department of Defense or a military department.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HE35D98788D7C4998833AFF74D3D17B4A"><enum>(b)</enum><header>Inclusion under defense environmental restoration program</header><text>Section 2701 of title 10, United States Code, is amended—</text>
<paragraph id="HB125E2ACB3074F3C85F374E11A2E1012"><enum>(1)</enum><text>in paragraph (1) of subsection (a), by striking <quote>State-owned</quote>;</text></paragraph> <paragraph id="HEAB5E4A3F6E64E7FB08B2189279059EE"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (D) of subsection (c)(1), by striking <quote>State-owned</quote>; and</text></paragraph>
<paragraph id="H2AFA8813146849FA9E062711312EE74C"><enum>(3)</enum><text>in paragraph (1) of subsection (d) by inserting <quote>or at a National Guard facility</quote> after <quote>Secretary’s jurisdiction</quote>.</text></paragraph></subsection> <subsection id="H4D32F24EA0284C6B9BBC3FCB313C3B9F"><enum>(c)</enum><header>Environmental restoration accounts</header><text>Section 2703(g)(1) of such title is amended by inserting <quote>, a National Guard facility,</quote> after <quote>Department of Defense</quote>.</text></subsection>
<subsection id="H3CCDB9691B2F4986B0DD4C7AD31BCA66"><enum>(d)</enum><header>Technical and conforming amendments</header>
<paragraph id="H3AB812DEF73249B4948D689DCAD46AF1" commented="no"><enum>(1)</enum><header>Repeal of provision</header><text>Section 2707 of such title is amended by striking subsection (e).</text></paragraph> <paragraph id="H61112499B03849B0B7AD7D2E0B376F99"><enum>(2)</enum><header>Reference update</header><text>Section 345(f)(1) of the National Defense Authorization Act for Fiscal Year 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/81">Public Law 117–81</external-xref>; 135 Stat. 1646; <external-xref legal-doc="usc" parsable-cite="usc/10/2715">10 U.S.C. 2715</external-xref> note) is amended by striking <quote>facility where military activities are conducted by the National Guard of a State pursuant to section 2707(e) of title 10, United States Code</quote> and inserting <quote>National Guard Facility, as such term is defined in section 2700 of title 10, United States Code</quote>.</text></paragraph></subsection></section>
