<section id="H3202DD407B694798A4174CCBD6614AFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fusion Energy Act </short-title></quote>.</text></section> <section id="H842C2789B6064587B84EC2FB052D42BC"><enum>2.</enum><header>Fusion energy machines</header> <subsection id="HB4D2EDB295644336896FC1B3F09EF6AE"><enum>(a)</enum><header>Use of byproduct material framework</header><text display-inline="yes-display-inline">Section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>) is amended—</text>
<paragraph id="H9AA2DB2A69C04EB3903902637C593858"><enum>(1)</enum><text>in subsection e.—</text> <subparagraph id="H9302A8EBBCAF4562BFDBAC66D1B0A7E2"><enum>(A)</enum><text>in paragraph (3)(B)(ii), by striking <quote>research activity; and</quote> and inserting <quote>research activity;</quote>;</text></subparagraph>
<subparagraph id="HFCD16ECC148149AEBA94D8984DC49013"><enum>(B)</enum><text>in paragraph (4)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H920EBABD60304E8EAEAFA8E5EFEB61C1"><enum>(C)</enum><text>by adding at the end the following paragraph: </text>

<paragraph id="H16CAFBFE6E4E43B184A7FDD538E92D21"><enum>(5)</enum><text display-inline="yes-display-inline">any material that is made radioactive directly or indirectly by use of a fusion energy machine.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HA358D18359B645A7860A286F7CF207F6"><enum>(2)</enum><text>by adding at the end the following: </text>

<subsection id="H01326BFA9D1C49E8A5DAC7DF82AF52E7"><enum>kk.</enum><header>Fusion energy machine</header><text display-inline="yes-display-inline">The term <term>fusion energy machine</term> means a particle accelerator that is capable of—</text> <paragraph id="H9780C4A78CEE4D93A7282C6C933BEAC8"><enum>(1)</enum><text display-inline="yes-display-inline">transforming atomic nuclei, through fusion processes, into other elements; and</text></paragraph>
<paragraph id="H7A9418A0D2644E79A9BFC3F6D4D548ED"><enum>(2)</enum><text>directly capturing and using the resultant products, including particles, heat, and other electromagnetic radiation, for a commercial or industrial purpose. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H1AED0947B95C42D5B0D3F89723963C6B" commented="no"><enum>(b)</enum><header>Technology-Inclusive regulatory framework</header> <paragraph id="H8A05C10CF4404A20BC5687F8EBC8BE98"><enum>(1)</enum><header>In general</header><text>Section 103(a) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note) is amended—</text>
<subparagraph id="H51441E2829B741AB806DE3494022EC18" commented="no"><enum>(A)</enum><text>in paragraph (4)—</text> <clause id="H07541EF6A1C6432088647E6E47948277"><enum>(i)</enum><text>by striking <quote>a technology-inclusive</quote> and inserting the following:</text>
<quoted-block style="OLC" id="H796323F5BDC44D0C88119406381ACE9D" display-inline="no-display-inline">
<subparagraph id="HDA5B2A11A0034CF180E283FF6CBF7150"><enum>(A)</enum><text display-inline="yes-display-inline">a technology-inclusive</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause> <clause id="H9D794A794C3647548B305FBC7D5595C2"><enum>(ii)</enum><text>by striking <quote>license applications.</quote> and inserting <quote>license applications; and</quote>; and</text></clause>
<clause id="H471431B7A8844DA4BC4CCAF00A71F46B"><enum>(iii)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="HB80822110F9440D28DA1F59AA99FD1B4" display-inline="no-display-inline"> <subparagraph id="H8BD3C43380BD44E3ABC32D8E52AFCA76"><enum>(B)</enum><text display-inline="yes-display-inline">a technology-inclusive, regulatory framework for optional use by fusion energy machine applicants for new license applications. </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="H6B9D18A004114F3787B7E9ED87A630A7" commented="no"><enum>(B)</enum><text>in paragraph (5)(B)(ii), by inserting <quote>and fusion energy machine license applications</quote> after <quote>commercial advanced nuclear reactor license applications</quote>.</text></subparagraph></paragraph> <paragraph id="H5F16FA7E5793473C90B57194B46656D8"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref> note) is amended by adding at the end the following: </text>

<paragraph id="HA40F5AE986F644EC866684975EE09E17"><enum>(16)</enum><header>Fusion energy machine</header><text display-inline="yes-display-inline">The term <term>fusion energy machine</term> has the meaning given such term in subsection kk. of section 11 of the Atomic Energy Act of 1954. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H7E55D3114EA44FD49189EA2BC389BAE8"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Nuclear Regulatory Commission shall submit to Congress a report on—</text>
<paragraph id="H8068B0980D9146F7A1A4CA054045A5C9"><enum>(1)</enum><text display-inline="yes-display-inline">the results of a study, conducted in consultation with Agreement States (as defined in section 3(3) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref> note (3)) and the private fusion sector, on risk- and performance-based, design-specific licensing frameworks for mass-manufactured fusion energy machines (as defined in subsection kk. of section 11 of the Atomic Energy Act of 1954, as added by this section), that includes evaluation of the Federal Aviation Administration’s design, manufacturing, and operations certification process for aircraft as a potential model for mass-manufactured fusion energy machine regulations; and</text></paragraph> <paragraph id="H22F79D5DE0B947AF9780EA1F4116496C" commented="no"><enum>(2)</enum><text>the estimated timeline for the Commission to issue consolidated guidance or regulations for licensing mass-manufactured fusion energy machines, taking into account the results of such study and the anticipated need for such guidance or regulations. </text></paragraph></subsection></section>
