within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide that governmental pension plans may include certain firefighters, emergency medical technicians, and paramedics, and for other purposes.</official-title></form><legis-body id="H2A07C1F25C4B404C99BBBCC0A9788635" style="OLC"><section id="HC49104F74238445FB935B4C896FB8215" section-type="section-one"><enum>1.</enum><header>Governmental pension plans may include certain firefighters, emergency medical technicians, and paramedics</header><subsection id="H8B27687C33A4486788085A641CAD17D0"><enum>(a)</enum><header>Internal Revenue Code of <enum-in-header>1986</enum-in-header></header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/414">Section 414(d)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the first sentence the following new sentence: <quote>A plan shall not fail to be a <quote>governmental plan</quote> under the preceding sentence solely because such plan allows participation by a public safety agency (described in section 501(c) and exempt from taxation under section 501(a)) solely with respect to the employees of such agency who are emergency response providers (defined in section 2 of the Homeland Security Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)), substantially all of whose services as emergency response providers are in the performance of firefighting services or out-of-hospital emergency medical services for a political subdivision of a State under a contract between such public safety agency and the political subdivision of a State.</quote>.</text></subsection><subsection id="HAB2E9F9B5BE44BB5923AEB4A2BD857B8"><enum>(b)</enum><header>Employee Retirement Income Security Act of <enum-in-header>1974</enum-in-header></header><text display-inline="yes-display-inline">Section 3(32) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(32)</external-xref>) is amended by inserting after the first sentence the following new sentence: <quote>A plan shall not fail to be a <quote>governmental plan</quote> under the preceding sentence solely because such plan allows participation by a public safety agency (described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code) solely with respect to the employees of such agency who are emergency response providers (defined in section 2 of the Homeland Security Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)), substantially all of whose services as emergency response providers are in the performance of firefighting services or out-of-hospital emergency medical services for a political subdivision of a State under a contract between such public safety agency and the political subdivision of a State.</quote>.</text></subsection><subsection id="HD783577E44CB48248A32EEC7BA5835E1" commented="no"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="H443C0386571A4A5DAC4E4ED0E5B5D035"><enum>(1)</enum><text display-inline="yes-display-inline">Section 4021(b)(2) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1321">29 U.S.C. 1321(b)(2)</external-xref>) is amended by inserting <quote>(or public safety agency employees described in the second sentence of section 3(32))</quote> after <quote>established and maintained for its employees</quote>. </text></paragraph><paragraph id="HC1D66E7A096B4692A0B5683043662ED8" commented="no"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/415">Section 415(b)(2)(H)(ii)(I)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>described in the second sentence of section 414(d) or</quote> after <quote>As a full-time employee</quote>.</text></paragraph><paragraph id="H10392497AA4C43F2A6BC995094526DF6"><enum>(3)</enum><text>Section 415(b)(10)(A) of such Code is amended by inserting <quote>(or public safety agency employees described in the second sentence of section 414(d))</quote> after <quote>maintained for its employees</quote>. </text></paragraph></subsection><subsection id="H4F3D84BA119340FA93DDA95032B87660"><enum>(d)</enum><header>Effective date</header><text>The amendment made by this section shall apply to plan years beginning after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
