which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and the Workforce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the McKinney-Vento Homeless Assistance Act to meet the needs of homeless children, youth, and families, and honor the assessments and priorities of local communities.</official-title></form><legis-body id="HBC72417AED2A41A0A7610124EA4D5BFE" style="OLC"><section id="H9BE96984F09744E887B3B8EEFA612778" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homeless Children and Youth Act of 2023</short-title></quote>.</text></section><section id="H857197CB38214074BDCF169A62FC5130"><enum>2.</enum><header>Amendments to the McKinney-Vento Homeless Assistance Act</header><subsection id="H18112E6DEB82427AAD0B660E4AA140A9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The McKinney-Vento Homeless Assistance Act is amended—</text><paragraph id="HA24E435C01F54624A2E5C96E19DF28C4"><enum>(1)</enum><text display-inline="yes-display-inline">in section 103 (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302</external-xref>)—</text><subparagraph id="H11C319B2BC8247F1A45ADBF99D1D03A5"><enum>(A)</enum><text>in subsection (a)—</text><clause id="H0E9A423BA6A1475093D59AE5FCF89228"><enum>(i)</enum><text>in paragraph (5)(A)—</text><subclause id="HCAE8494CF88549039CAC79A7FF9EE4FF"><enum>(I)</enum><text>by striking <quote>are sharing</quote> and all that follows through <quote>charitable organizations,</quote>;</text></subclause><subclause id="H9AD96006649B4744B13A12F24C50A4D3"><enum>(II)</enum><text>by striking <quote>14 days</quote> each place such term appears and inserting <quote>30 days</quote>;</text></subclause><subclause id="H76421CE2F6494B68A64FBEDEB928D450"><enum>(III)</enum><text>in clause (i), by inserting <quote>or</quote> after the semicolon;</text></subclause><subclause id="H2BE956D12CC044E98D064BD010313555"><enum>(IV)</enum><text>by striking clause (ii); and</text></subclause><subclause id="H1674C9B9E7364513ADD39559B92BF26B"><enum>(V)</enum><text>by redesignating clause (iii) as clause (ii); and</text></subclause></clause><clause id="H300A9692CA654228B05AB6584F1FC10F"><enum>(ii)</enum><text>by amending paragraph (6) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HF63CEFB428574D8E81717A4A5273131D" style="OLC"><paragraph id="H0C1F1CEB6C89474A8241062F722F0163"><enum>(6)</enum><text>a child or youth defined as homeless under any other Federal program who, without further action by the Department of Housing and Urban Development, has been verified as homeless under any other Federal program by the director, designee of the director, or other person responsible for the implementation of a program established under this Act or any other Federal statute.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H9D78F1F13DBF4CE5BF3134934FFD534B"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA62BB46947BC4FA0AECE1C6D8671FE23" style="OLC"><subsection id="H159AA488DA934BE792F4DF9F2B75D36E"><enum>(f)</enum><header>Other definitions</header><text>In this section—</text><paragraph id="H231FCE86DB5F4BE2B86AE38A426C07BD"><enum>(1)</enum><text>the term <term>child or youth defined as homeless under any other Federal program</term> has the meaning given the term in section 401; and</text></paragraph><paragraph id="HF10E0BF5783A48BE85860CB15D829E45"><enum>(2)</enum><text>the term <term>other Federal statute</term> has the meaning given the term in section 401.</text></paragraph></subsection><subsection commented="no" id="H2AFB4AE1B5384B8D8EFDB317782FDCFB"><enum>(g)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">If the Secretary of Housing and Urban Development promulgates rules, issues guidance, or sets forth conditions in any application, notice of funding availability, or other publication or advisory regarding the provisions of this Act, the Secretary shall ensure that—</text><paragraph id="H54C60363A5E94ED2995FA23755AA8EF7"><enum>(1)</enum><text>any individual defined as <quote>homeless</quote> under section 103 is eligible for any program or program component under this Act; and</text></paragraph><paragraph id="H1E0C0EF78DE2492294F1044CF6BA8F44"><enum>(2)</enum><text>all individuals defined as <quote>homeless</quote> under subsection (a) proposed to be served by an applicant, and all proposed program components or housing or service models, are given the same priority, points, or weight.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE99E22E0A20340F2AB197B88498A0363"><enum>(2)</enum><text>in section 401 (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>)—</text><subparagraph id="HF86BEF1A13C84A68892C1C28E3BC76C5"><enum>(A)</enum><text>in paragraph (1)(C)—</text><clause id="H66E9D32B8E744E6499679437BB1AD7A7"><enum>(i)</enum><text>by striking clauses (ii) and (iv);</text></clause><clause id="HE24115D89D174FBE828397C611C5DC14"><enum>(ii)</enum><text>by redesignating clauses (iii), (v), (vi), and (vii) as clauses (ii), (iii), (iv), and (v), respectively; and</text></clause><clause id="HD0F0D1D37C9F4A2CB95918973BE9AB76"><enum>(iii)</enum><text>by striking the flush text following clause (v), as so redesignated;</text></clause></subparagraph><subparagraph id="H7E3ABA20ED9D4526BC1ADD921C1BDB50"><enum>(B)</enum><text>in paragraph (2)(A)—</text><clause id="H49BDC36C34DF460D9FFAA9F5794CD129"><enum>(i)</enum><text>in clause (i), by striking <quote>and lives</quote> and all that follows through <quote>shelter</quote> and inserting <quote>under any provision of section 103</quote>;</text></clause><clause id="H01E7C17A343942C7BB542ACB6E638FD9"><enum>(ii)</enum><text>in clause (ii), by striking <quote>and living or residing in a place not meant for human habitation, a safe haven, or in an emergency shelter continuously</quote> and inserting <quote>under any provision of section 103</quote>; and</text></clause><clause id="HFE09429FF8EB40DD98894BC48E200C60"><enum>(iii)</enum><text>in clause (iii)—</text><subclause display-inline="no-display-inline" id="HACF3000B4140405997CEC795681CCDAF"><enum>(I)</enum><text>by striking <quote>(or a minor head of household if no adult is present in the household)</quote> and inserting <quote>or a minor head of household (if no adult is present in the household),</quote>; and</text></subclause><subclause id="H107AB37015C64D359DFD400795E91B21"><enum>(II)</enum><text>by inserting before the period at the end the following: <quote>, or has a child with a disability, as such term is defined in section 602 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>), or an infant or toddler with a disability, as such term is defined in section 632 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1432">20 U.S.C. 1432</external-xref>)</quote>;</text></subclause></clause></subparagraph><subparagraph id="HF4BCD3657D0D4817B0F84EAB29285ABB"><enum>(C)</enum><text>by striking paragraph (7);</text></subparagraph><subparagraph id="HEB41532FB06441D8843E95C842BC16B3"><enum>(D)</enum><text>by redesignating paragraphs (2) through (6) as paragraphs (3) through (7), respectively;</text></subparagraph><subparagraph id="H0084292C57F94435965007EE94551C33"><enum>(E)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="H68C7FB0C0B2A43FFA2AC37C4AD57015E" style="OLC"><paragraph id="HE0C0C30B7DA84B90877CE87F402870CC"><enum>(2)</enum><header>Child or youth defined as homeless under any other Federal program</header><text>The term <term>child or youth defined as homeless under any other Federal program</term> means—</text><subparagraph id="HAD53A28F9C314DFCB57076231D097DDE"><enum>(A)</enum><text>a homeless child or youth, as defined in section 725, including any parent or guardian with whom the child or youth is living; and</text></subparagraph><subparagraph id="H49292F87461B4993923F5B97160ED43B"><enum>(B)</enum><text>a youth who—</text><clause id="HD0C4D22D3E3B4415BBB32A47C45C73B2"><enum>(i)</enum><text>is not more than 24 years of age;</text></clause><clause id="HA14FA8C406CC4F22A23B5C3701EE39EC"><enum>(ii)</enum><text>cannot live safely with a parent, legal guardian, or relative; and</text></clause><clause id="HA2D3840944134534A2B6446F3F806B9E"><enum>(iii)</enum><text>has no other safe alternative living arrangement.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF989BD2C46B14999A149C7354D9D8F69"><enum>(F)</enum><text>in paragraph (10)(A), by inserting <quote>any provision of</quote> before <quote>section 103</quote>;</text></subparagraph><subparagraph id="HD97EB391F2B44C21BB0BB71E36E11C8E"><enum>(G)</enum><text>by redesignating paragraphs (16) through (35) as paragraphs (17) through (36), respectively;</text></subparagraph><subparagraph id="H4F773EA82CE24808874568E89520E524"><enum>(H)</enum><text>by inserting after paragraph (15) the following:</text><quoted-block display-inline="no-display-inline" id="H7D8468356B684989A3BDD3F500F395D8" style="OLC"><paragraph id="HF4775D981C2D4CDE948A279CFF9E369C"><enum>(16)</enum><header>Other Federal statute</header><text>The term <term>other Federal statute</term> includes—</text><subparagraph id="H91960A94305C46228D8797160D3B1E83"><enum>(A)</enum><text>the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701 et seq.</external-xref>);</text></subparagraph><subparagraph id="H7555D2AF009748B5A7BA0DED959993B3"><enum>(B)</enum><text>the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>);</text></subparagraph><subparagraph id="HDAD392D439B0478E8ED553A539EC2C2D"><enum>(C)</enum><text>the Child Care and Development Block Grant of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>);</text></subparagraph><subparagraph id="H6C1A8E14CC2140AD90E04CB451819C1C"><enum>(D)</enum><text>subtitle N of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14043e">42 U.S.C. 14043e et seq.</external-xref>);</text></subparagraph><subparagraph id="HDE6C979AAEA34CFC91EDA897019B2CC3"><enum>(E)</enum><text>section 330(h) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(h)</external-xref>);</text></subparagraph><subparagraph id="HC99B8905721441388253C7540CD7355E"><enum>(F)</enum><text>section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>);</text></subparagraph><subparagraph id="H4264F3FC216549B185BF3872AA1991EF"><enum>(G)</enum><text>the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>); and</text></subparagraph><subparagraph id="HCAE7930AE17A45C9B60E5FE4C64EF639"><enum>(H)</enum><text>the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437 et seq.</external-xref>).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H72B500C789E6425D9CC7FBA5C8963F45"><enum>(I)</enum><text>in paragraph (34), as so redesignated, by inserting <quote>children under 5 years of age, youth and young adults between 14 and 24 years of age,</quote> after <quote>status, or age),</quote>;</text></subparagraph><subparagraph id="HD6BC10927C7C40EE9E2C2A292614CC0D"><enum>(J)</enum><text>in paragraph (35), as so redesignated, by inserting <quote>trafficking,</quote> after <quote>victims of</quote>; and</text></subparagraph><subparagraph id="HAD92B8CDF18643A68F344EFF35DE8CDF"><enum>(K)</enum><text>in paragraph (36), as so redesignated—</text><clause id="H6DFDED2953B349EB821E445F1063AF84"><enum>(i)</enum><text>by inserting <quote>victims of trafficking,</quote> after <quote>assist</quote>;</text></clause><clause id="H4994867229F145839D5640AFA004B6D5"><enum>(ii)</enum><text>by striking <quote>stalking victims</quote> and inserting <quote>stalking</quote>; and</text></clause><clause id="H9A3067436C3B4ECE92A50A04A0CFA632"><enum>(iii)</enum><text>by inserting <quote>trafficking,</quote> after <quote>concerning</quote>;</text></clause></subparagraph></paragraph><paragraph id="H0D5C0DA2360E401583A557D471F95AA0"><enum>(3)</enum><text>in section 402(f) (<external-xref legal-doc="usc" parsable-cite="usc/42/11360a">42 U.S.C. 11360a(f)</external-xref>)—</text><subparagraph id="H71F7E80A39D1432C99BA34788AE0109F"><enum>(A)</enum><text>in paragraph (1)(B), by inserting <quote>considering the prevalence and needs of homeless individuals, as defined under any provision of section 103</quote> after <quote>involved</quote>; and</text></subparagraph><subparagraph id="HA5AFB84F5E1E4DFE969D1FD16FE16AB6"><enum>(B)</enum><text>in paragraph (3)(D)—</text><clause id="H23C6205FBD3E4D8F89D60A9DB2933B43"><enum>(i)</enum><text>in clause (v), by striking <quote>and</quote> at the end;</text></clause><clause id="HDE379D2AF585443A8FFB0C517ACB07E6"><enum>(ii)</enum><text>by redesignating clause (vi) as clause (vii); and</text></clause><clause id="H9A64C31A26F44643BFB5A78F62602C09"><enum>(iii)</enum><text>by inserting after clause (v) the following:</text><quoted-block display-inline="no-display-inline" id="H9DC724E4A44847ACA97024C776363503" style="OLC"><clause id="H0511F8388E234CE082812CA93DE1B5DC"><enum>(vi)</enum><text>the submission of HMIS data to the Secretary on at least an annual basis; and</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H6A707AA7A91640F39EDF901A3307C11D"><enum>(4)</enum><text>by inserting after section 408 (<external-xref legal-doc="usc" parsable-cite="usc/42/11364">42 U.S.C. 11364</external-xref>) the following:</text><quoted-block display-inline="no-display-inline" id="H3B3B8DA9DDE7447BA481DB18D5816CEA" style="OLC"><section id="H15BA1AE37F4848EC9429FB1EEF3266D4"><enum>409.</enum><header>Availability of HMIS data</header><subsection id="HD2342B715A5847A88EF1212F552ECA5F"><enum>(a)</enum><header>In general</header><text>The community-wide homeless management information system (in this section referred to as <term>HMIS</term>) data provided to the Secretary under section 402(f)(3)(D)(vi) shall be made publically available on the internet website of the Department of Housing and Urban Development.</text></subsection><subsection id="HFF34927465B645538F3F547483105BA1"><enum>(b)</enum><header>Required data</header><text>The data publically available under subsection (a) shall be updated on at least an annual basis and shall include—</text><paragraph id="HFAA1E4009826441088BA0A18DAD88006"><enum>(1)</enum><text>a cumulative count of the number of homeless individuals and families, as defined under any provision of section 103;</text></paragraph><paragraph id="H70892AD5FF134653BE56B14712B85B82"><enum>(2)</enum><text>a cumulative assessment of the patterns of assistance provided under subtitles B and C for each geographic area involved;</text></paragraph><paragraph id="H986F889F93F64AE2BD71ECB28C2B5CD8"><enum>(3)</enum><text>a count of the number of homeless individuals and families, as defined under any provision of section 103, that are documented through the HMIS by each collaborative applicant; and</text></paragraph><paragraph id="HC25718C490F74B6B8AAF1C3FC9E3F6D9"><enum>(4)</enum><text>a count of the number of homeless women, as defined under any provision of section 103 and both unaccompanied and accompanied, including a breakout of the count by—</text><subparagraph id="HAAC9AC4E59D445AF90C61C34EC65AE8F"><enum>(A)</enum><text>age range;</text></subparagraph><subparagraph id="H3A9C0E7D42C648938FA171C186E7E1C1"><enum>(B)</enum><text>disability; and</text></subparagraph><subparagraph id="HCC20265A2C70440E916A172327A4732D"><enum>(C)</enum><text>length of time experiencing homelessness.</text></subparagraph></paragraph></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H56A1012D978C44F2BF9BF4484632C12B"><enum>(5)</enum><text>in section 422 (<external-xref legal-doc="usc" parsable-cite="usc/42/11382">42 U.S.C. 11382</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC50CC477142D419EAFB338442E6DA337"><enum>(A)</enum><text>in subsection (c)(1)(B), by striking <quote>establish</quote> and inserting <quote>demonstrate local, needs-based</quote>; and</text></subparagraph><subparagraph commented="no" id="HC4A85C3D25934BC1A428BCB1D77AEA64"><enum>(B)</enum><text>by striking subsection (j) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H38357040C1F647AC9D58B43836D33640" style="OLC"><subsection id="H33ADAECDC36845548F512DDEEE23A8F8"><enum>(j)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">In awarding grants under subsection (a) and releasing a notification of funding availability under subsection (b), the Secretary shall—</text><paragraph id="H40132D51A5794F8C9C1306FF4D2A0A55"><enum>(1)</enum><text>without further action by the Department, ensure that any individual defined as <quote>homeless</quote> under any provision of section 103 is eligible for any program or program component under this Act;</text></paragraph><paragraph id="H3CD09840A8554B139E7EC16B26394A1D"><enum>(2)</enum><text>ensure that homeless populations proposed to be served by the applicant, and proposed program components or housing or service models, are not awarded different priority, points, or weight; and</text></paragraph><paragraph id="HE8A27F863B904B3585B0C9DDDEB3AD33"><enum>(3)</enum><text>ensure that scoring is based primarily on the extent to which the applicant demonstrates that the project and program components—</text><subparagraph id="HC67D15CC5D664DCB8E7DBADDC6CE9A92"><enum>(A)</enum><text>would meet the priorities identified in the plan submitted under section 427(b)(1)(B); and</text></subparagraph><subparagraph id="H79FA67B79E85419BB5704C67C83BA998"><enum>(B)</enum><text>are cost-effective in meeting the overall goals and objectives identified in that plan.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7207FA439F22498D994BF911C6AC4338"><enum>(6)</enum><text>in section 424(d) (<external-xref legal-doc="usc" parsable-cite="usc/42/11384">42 U.S.C. 11384(d)</external-xref>), by striking paragraph (5);</text></paragraph><paragraph id="H99B592A5306F4313B201F28253BD0ADF"><enum>(7)</enum><text>in section 425(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/11385">42 U.S.C. 11385(c)</external-xref>), by striking <quote>and (G) providing</quote> and inserting <quote>(G) providing transportation to employment, early care and education programs, career and technical education programs, and health and mental health care services, and (H) providing</quote>;</text></paragraph><paragraph id="HADC38D6491A0499F868C19988B43857D"><enum>(8)</enum><text>in section 426(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/11386">42 U.S.C. 11386(b)</external-xref>)—</text><subparagraph id="H2B02554AC16641A4A5E624A65F0284E7"><enum>(A)</enum><text>in paragraph (4), by amending subparagraph (D) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HD75686C4AC9F48D69A0E5EB99B073CE0" style="OLC"><subparagraph id="H1F36641E96D9496F81E8F72DE64E0F11"><enum>(D)</enum><text>in the case of programs providing housing or services to families or youth, they will designate a staff person to be responsible for ensuring that children and youth being served in the program are—</text><clause id="HDEE13239AE934F16A5B3C91D08C23F46"><enum>(i)</enum><text>enrolled in school and connected to appropriate services in the community, including Head Start, part C of the Individuals with Disabilities Act, programs authorized under the Child Care and Development Block Grant Act of 1990, career and technical education, and services provided by local educational agency liaisons designated under subtitle B of title VII of this Act; and</text></clause><clause id="H6A28FCF036994082A440DE64142B9163"><enum>(ii)</enum><text>in the case of an unaccompanied youth, as defined in section 725, informed of their status as an independent student under section 480 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv</external-xref>) and receive verification of such status for purposes of the Free Application for Federal Student Aid described in section 483 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>); and</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HC8B0E02C1A884C11919E79067F542810"><enum>(B)</enum><text>in paragraph (6), by inserting <quote>the actual compliance with the certifications required under paragraph (4) and</quote> after <quote>Secretary</quote>; and</after-quoted-block></quoted-block></subclause><subclause id="H0DA4952CF9114FA9A68F1110CB34D17D"><enum>(II)</enum><text>by striking clause (v) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H75B38F6B57A94AD582C4C803F62A994A" style="OLC"><clause id="H3FB561BF91C747C8A0243AFF34544C87"><enum>(v)</enum><text>how the recipient will ensure the full implementation of the certifications and agreements described in paragraphs (4)(D) and (7) of section 426(b);</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="H5B5102CF31474F2E8AB9B766B92E4B02"><enum>(iii)</enum><text>in subparagraph (C)(i), by inserting <quote>and appropriate</quote> after <quote>rapid</quote>; and</text></clause><clause commented="no" id="H37973130FC63452BB0F9812F0AAA2C9D"><enum>(iv)</enum><text>by striking subparagraphs (F) and (G) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H262B62F99D054491AA5540FBC3EE3FE8" style="OLC"><subparagraph id="H0E79DD8491254C269C86F2BB139128FF"><enum>(F)</enum><text>for communities that establish and operate a centralized or coordinated assessment system, the extent to which that system—</text><clause id="H5950AF2010624ABAA644A28A23A7C4FF"><enum>(i)</enum><text>ensures that individuals who are most in need of assistance receive it in a timely manner;</text></clause><clause id="HF1EF7C7F4F484A08B7D724193620773C"><enum>(ii)</enum><text>in assessing need under clause (i), uses separate, specific, age-appropriate criteria for assessing the safety and needs of children under 5 years of age, school-age children, unaccompanied youth and young adults between 14 and 24 years of age, and families that are unrelated to the criteria through which an individual qualifies as <quote>homeless</quote> under section 103;</text></clause><clause id="HE3BE9AD5D8974BC19C289224001C6DF6"><enum>(iii)</enum><text>is accessible to unaccompanied youth and homeless families;</text></clause><clause id="H86F3EB45B8DD445E8365148D56B21C65"><enum>(iv)</enum><text>diverts individuals to safe, stable, age-appropriate accommodations; and</text></clause><clause id="H82916BBD1AED4F08A2972A898EEF2808"><enum>(v)</enum><text>includes affordable housing developers, youth service providers, early childhood programs, local educational agencies, and mental health organizations; and</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="HD2EF8294B8E5444AB2F49E50604DC73C"><enum>(G)</enum><text>such other factors as the Secretary determines to be appropriate to carry out this subtitle in an effective and efficient manner, except that such factors may not have the effect of prioritizing or weighting, unless justified by local data or information contained in a plan submitted under subparagraph (B)—</text><clause id="H27E2734BD79E44AC9A0800B24848CA94"><enum>(i)</enum><text>any service with respect to a specific subpopulation of homeless individuals over another; or</text></clause><clause id="H26468163CB474C9190DEFF246B5D0DA6"><enum>(ii)</enum><text>any program component or housing or service model over another.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H7C1092441AFF43FDBC9E1A5EC78A258B"><enum>(B)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H24BD26153F6048338734B0E81DAF0CBE" style="OLC"><paragraph commented="no" id="HB9F1354B4813473EAF77D90AA4B528D9"><enum>(3)</enum><header>Homelessness counts</header><text display-inline="yes-display-inline">The Secretary shall require that communities that conduct an annual count of homeless people shall count all homeless individuals identified and reported by any program funded under any provision of this Act or any other Federal statute (as such term is defined in section 401 (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>)).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0266553B922A46459EC30AC0BBA4FFA7"><enum>(10)</enum><text>in section 428 (<external-xref legal-doc="usc" parsable-cite="usc/42/11386b">42 U.S.C. 11386b</external-xref>)—</text><subparagraph id="HE52E1250D3194DB392533FA06102F09D"><enum>(A)</enum><text>in subsection (a)(1)—</text><clause id="H7121F02C6AFD41B4A470ECFFB267CF8B"><enum>(i)</enum><text>by striking <quote>disabilities and</quote> and inserting <quote>disabilities,</quote>; and</text></clause><clause id="HD1F59B4930B04CE5BF3D169B56796DFA"><enum>(ii)</enum><text>by inserting <quote>, and homeless families where a child has a disability</quote> before the period at the end;</text></clause></subparagraph><subparagraph id="H1E03D77F451E4D20A873B963CA17CF9D"><enum>(B)</enum><text>in subsection (d)—</text><clause id="H1E1090779DA94C3F948BA3C41A88D510"><enum>(i)</enum><text>in paragraph (1), by inserting <quote>promoting</quote> before <quote>independent</quote>; and</text></clause><clause id="H4392B2C98880452E84036BF45ED81505"><enum>(ii)</enum><text>by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HE14C10A1A0714C5085BA35032BF08AFD" style="OLC"><paragraph id="H4696BDE346564BEC97C3387A47A0298E"><enum>(2)</enum><header>Prohibition</header><text>The Secretary shall not provide bonuses or other incentives under paragraph (1) that have the effect of prioritizing or weighting, unless justified by local data or information contained in a plan submitted under section 427(b)(1)(B)—</text><subparagraph id="H1B99118665E341C983B6CA87043C7B13"><enum>(A)</enum><text>any service with respect to a specific subpopulation of homeless individuals over another; or</text></subparagraph><subparagraph id="H3F881C097A054E789DEB497EEF26EC39"><enum>(B)</enum><text>any program component or housing or service model over another.</text></subparagraph></paragraph><paragraph id="H6DC45E49AC3441558687DE6604D56B58"><enum>(3)</enum><header>Rule of construction</header><text>For purposes of this subsection, activities that have been proven to be effective at reducing homelessness generally or reducing homelessness for a specific subpopulation include any activity determined by the Secretary, after providing notice and an opportunity for public comment, to have been proven effective at—</text><subparagraph id="H14959F998A6146BC91B8695FF5E4AB36"><enum>(A)</enum><text>reducing homelessness generally;</text></subparagraph><subparagraph id="H680E49AF0F6944F2B1AC5B19EA1BDD3E"><enum>(B)</enum><text>reducing homelessness for a specific subpopulation;</text></subparagraph><subparagraph id="H78FC13D9F02540A2A124974C9EE45616"><enum>(C)</enum><text>reducing homelessness in a community for populations overrepresented in any counts conducted in that community under section 427(b)(3); or</text></subparagraph><subparagraph id="H26C7830AA9444930BE5AC5208FAFF798"><enum>(D)</enum><text>achieving homeless prevention, reducing recidivism, and promoting self-sufficiency and independent living.</text></subparagraph></paragraph><paragraph id="H533386BAD5754E8793D150F9D4776527"><enum>(4)</enum><header>Encouraging local success and innovation</header><text>In providing bonuses or incentives under paragraph (1), the Secretary shall seek to encourage the implementation of proven strategies and innovation in reducing homelessness among the local priority populations identified in the plan submitted by an applicant under section 427(b)(1)(B). The Secretary shall not implement bonuses or incentives that promote a national priority established by the Secretary.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HA820907596AA4C728A572B341CA50133"><enum>(C)</enum><text>by striking subsection (e); and</text></subparagraph></paragraph><paragraph id="H5DF108402AEB403BAE9227D429ABD141"><enum>(11)</enum><text>by amending section 434 (<external-xref legal-doc="usc" parsable-cite="usc/42/11388">42 U.S.C. 11388</external-xref>) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H9F2E342B6E4C42DE91A9D2DC277EC7F7" style="OLC"><section id="HEC9CF5F58EED4CFB92372318FECDF03E"><enum>434.</enum><header>Reports to Congress</header><subsection id="HAFD042854EE74CB2A6D09B34DEE86EC1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall submit to Congress an annual report, which shall—</text><paragraph id="H2541A7585B0D44558CB8124BE1B216A4"><enum>(1)</enum><text>summarize the activities carried out under this subtitle and set forth the findings, conclusions, and recommendations of the Secretary as a result of the activities;</text></paragraph><paragraph id="HBC6BFCCFB62C425FA5502E1505A66536"><enum>(2)</enum><text>include, for the year preceding the date on which the report is submitted—</text><subparagraph id="HF3AC3FE792AF433793E853CF2AC9A346"><enum>(A)</enum><text>data required to be made publically available in the report under section 409;</text></subparagraph><subparagraph id="H6D3DB0858ED9419BB24C745B9DEBD7F3"><enum>(B)</enum><text>data on programs funded under any other Federal statute; and</text></subparagraph></paragraph><paragraph id="H3915EE00848C44219D819ADAF1F56962"><enum>(3)</enum><text>provide information on—</text><subparagraph id="HAE39C8EE03F444D5A57A1ECBBC46F8FC"><enum>(A)</enum><text>the extent to which the data collected under section 427(b)(3) may be duplicative; and</text></subparagraph><subparagraph id="HF86A36EAF2F94687A57EDCEF0F5E2B7F"><enum>(B)</enum><text>the policies and practices employed to account for such duplication, where applicable, to ensure an accurate point-in-time count.</text></subparagraph></paragraph></subsection><subsection id="HF51F28F5A01C42CD95CC167F3E890836"><enum>(b)</enum><header>Timing</header><text>A report under subsection (a) shall be submitted not later than 4 months after the end of each fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1FFEE9BD3AAE4C889167B43B04557F4B"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents in section 101(b) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11301">42 U.S.C. 11301</external-xref> note) is amended by inserting after the item relating to section 408 the following:</text><quoted-block display-inline="no-display-inline" id="H7694C6D8D79F42D2A6A5FC74EE882B78" style="OLC"><toc><toc-entry bold="off" level="section">Sec. 409.
