which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Wildlife Refuge System Administration Act of 1966 to prohibit the possession or use of body-gripping traps in the National Wildlife Refuge System, and for other purposes.</official-title></form><legis-body id="HEB127177DA204373AC3D28FCB44CD2F8" style="OLC"><section id="H61D8AD4637874584AB2AFCACF2B5564F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Refuge From Cruel Trapping Act</short-title></quote>.</text></section><section id="H50A0EAC9FF304CAFACFE1D393B4C3E7C" section-type="subsequent-section"><enum>2.</enum><header>Possession or use of body-gripping trap prohibited</header><subsection id="HCE2C7F1A9B2D4D95BFC7167DE4976EA2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>) is amended—</text><paragraph id="H66AFA4D213A04AE98E758908D14EDD53"><enum>(1)</enum><text>in section 4(f), by striking <quote>this Act</quote> each place it appears and inserting <quote>this section</quote>; and</text></paragraph><paragraph id="H9001E71DE4D14348824D99CC96D5B752"><enum>(2)</enum><text>by inserting after section 4 the following:</text><quoted-block style="OLC" id="HCBC13868533643F79AA022F38A51CCFE"><section id="H699B5719B25146DA8E2376FE4D5E4278"><enum>4A.</enum><header>Possession or use of body-gripping trap prohibited</header><subsection id="H97A7DCFBC16A41518F8292087BE5EBD1"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), a person may not possess or use a body-gripping trap in the System.</text></subsection><subsection id="H4D0C7096C7BE40219E37CC3569D7C79F"><enum>(b)</enum><header>Exceptions</header><paragraph id="HF15CDBC387CF4DF7AB3321E49D8FEC74"><enum>(1)</enum><header>Federal agency</header><text>Subsection (a) does not apply to the possession or use of a body-gripping trap by a Federal agency—</text><subparagraph id="H5529CDF6E40D476BB71C948CC503D4E9"><enum>(A)</enum><text>to—</text><clause id="H46791D3629844D32BDFBC54E8605BA88"><enum>(i)</enum><text>control an invasive species to achieve resource management objectives; or</text></clause><clause id="HDC807B8CFF2E443298C915C6072C8D25"><enum>(ii)</enum><text>protect a species that—</text><subclause id="HAF4FAB0CCB2F4FDB9F8BF8F57058B837"><enum>(I)</enum><text>is listed as threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></subclause><subclause id="H529C05750AA242809369DF0EAE1165E6"><enum>(II)</enum><text>the Secretary has designated as a sensitive species; and</text></subclause></clause></subparagraph><subparagraph id="H904D116604A043BA86E8B66EE6F07D1D"><enum>(B)</enum><text>if—</text><clause id="H0DEA9B141ECE4BE0A11E2CEED7AF5257"><enum>(i)</enum><text>such use is in accordance with Federal and State law; and</text></clause><clause id="HA292261E1464426DB3BAD239C3020CC5"><enum>(ii)</enum><text display-inline="yes-display-inline">all other viable nonlethal methods for achieving a goal described in subparagraph (A) have been thoroughly explored, described, and attempted and documentation of such activities is maintained at the relevant headquarters of the Federal agency that carried out such exploration, description, and attempt.</text></clause></subparagraph></paragraph><paragraph id="H52583108A8F64A25810233CD92CACDB9"><enum>(2)</enum><header>Dismantling</header><text>Subsection (a) does not apply to the dismantling of body-gripping traps.</text></paragraph><paragraph id="HF834E3E4A8FB48108B7BB9320BB1B1CD"><enum>(3)</enum><header>Alaska</header><text display-inline="yes-display-inline">Subsection (a) does not apply to the System in Alaska.</text></paragraph><paragraph id="H336026545F23432BB392CC18D81F42DC" commented="no"><enum>(4)</enum><header>Members of Indian Tribes</header><text>Subsection (a) does not apply to the possession or use of a body-gripping trap by a member of a federally recognized Indian Tribe for subsistence purposes.</text></paragraph></subsection><subsection id="H3E0F2A3C22E1481587EDD3121230D872"><enum>(c)</enum><header>Penalties</header><paragraph id="H8307CF5009B84B4A8A12AFD03F46C8BD"><enum>(1)</enum><header>In general</header><text>A person who violates subsection (a) shall be subject to—</text><subparagraph id="HE28E5E2C75664BD2AE83E830E85305B7"><enum>(A)</enum><text>a civil fine of not more than $500 for—</text><clause id="H1637C64FB48F4EDE89B336AA5AF35AC5"><enum>(i)</enum><text>each body-gripping trap possessed; and</text></clause><clause id="H62A13DA9DA15429884E490EB3511A769"><enum>(ii)</enum><text>each use of a body-gripping trap;</text></clause></subparagraph><subparagraph id="H4FD176C3EA5F4C94BDF76703D056CB21"><enum>(B)</enum><text>imprisonment for not more than 180 days; or</text></subparagraph><subparagraph id="H0CBFA73F67E740F0B8671E78DD1A7C40"><enum>(C)</enum><text>both a civil fine and imprisonment in accordance with subparagraphs (A) and (B).</text></subparagraph></paragraph><paragraph id="H9F4E0AA8338B4FBE8BEA7A9A13808534"><enum>(2)</enum><header>Adjustment for inflation</header><text>The Secretary shall annually adjust the fine described in paragraph (1) to reflect the change in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></paragraph></subsection><subsection id="HA9B64D906CBC49D586E74EB32969C624"><enum>(d)</enum><header>Forfeiture</header><text>Any body-gripping trap that is possessed or used in violation of this section, and any wildlife captured through the use of such body-gripping trap, including a pelt or raw fur of such wildlife, shall be subject to forfeiture to the United States in accordance with the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">chapter 46</external-xref> of title 18, United States Code, relating to civil forfeitures.</text></subsection><subsection id="H96D4664B5AC945F2B4F4C8E749485C04"><enum>(e)</enum><header>Payment of associated court costs</header><text>A person found to be in violation of subsection (a) shall pay all associated court costs.</text></subsection><subsection id="HBB193EAB18ED4C868C7BC9A132854C2A"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H3F02781A6EDB4C48BE240613B08B10FE"><enum>(1)</enum><header>Body-Gripping trap</header><text display-inline="yes-display-inline">The term <term>body-gripping trap</term>—</text><subparagraph id="HA37BEBAEDC064FD798842251C75FE0CC"><enum>(A)</enum><text>means any device that is intended to kill or capture wildlife by physically restraining any part of the animal;</text></subparagraph><subparagraph id="H15649417075448B78B3E7203841CF4EA"><enum>(B)</enum><text>includes any—</text><clause id="H939ADDC2FC214C9A8FBC6E4B7251DAAF"><enum>(i)</enum><text>steel-jaw, padded, or other modified leghold trap;</text></clause><clause id="H041E58E7110E4E268516D74B027236CD"><enum>(ii)</enum><text>kill-type trap;</text></clause><clause id="H06A8AD58231A492FBE2555A88B3F6BB8"><enum>(iii)</enum><text>snare trap; or</text></clause><clause id="HD7316820DC13408B859D6C5EA58B39D1"><enum>(iv)</enum><text>modified version of any trap described in clauses (i) through (iii); and</text></clause></subparagraph><subparagraph id="HC626A76B11EF4AEF890EBDB666BF770E"><enum>(C)</enum><text>does not include any—</text><clause id="H4419EB87731E48DDBA9EE164EA2C5AA4"><enum>(i)</enum><text>cage or box trap; or</text></clause><clause id="HFF385BC480B849EAA059F8632581B25F"><enum>(ii)</enum><text>suitcase-type live beaver trap.</text></clause></subparagraph></paragraph><paragraph id="H2D54E03A5EAC492AAA18996347276FC0"><enum>(2)</enum><header>Invasive species</header><text display-inline="yes-display-inline">The term <term>invasive species</term> means, with regard to a particular ecosystem, a non-native organism the introduction of which causes or is likely to cause economic or environmental harm, or harm to human, animal, or plant health. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB46EE390779A476D98289A045D80BE39"><enum>(b)</enum><header>Regulations</header><paragraph id="HA994DA347F3E471DA685C48A4DA1D00E"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this section, the Secretary of the Interior shall issue any regulations necessary to carry out the amendments made by subsection (a).</text></paragraph><paragraph id="HFAAE6ECE59F74BFC82D357B438056B65"><enum>(2)</enum><header>Enforceability</header><text>The enforceability of the amendments made by subsection (a) shall not be affected by a failure of the Secretary of the Interior to issue regulations under paragraph (1).</text></paragraph></subsection><subsection id="HACDE7432AD07495EAA3CC8C975067D48"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is 120 days after the date of the enactment of this section.</text></subsection></section></legis-body></bill>
