which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of the Environmental Protection Agency to establish a grant program to facilitate the development of climate adaptation plans by certain entities, and for other purposes.</official-title></form><legis-body id="H848DC1AFCE61455AB32C1B4F3277BF8D" style="OLC"><section id="HC72F56FC43DA492CB65ECBC313753175" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Climate Adaptation Plan Act</short-title></quote> or the <quote>CAP Act</quote>.</text></section><section id="H57DDE862236A48899CAD831F3E19DAE7" section-type="subsequent-section"><enum>2.</enum><header>Climate adaptation plan grant program</header><subsection id="H8BF939D2B208495DA8465E25C76EB139"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Administrator shall establish a grant program to award amounts, on a competitive basis, to eligible entities to facilitate the development of a climate adaptation plan by such eligible entities.</text></subsection><subsection id="H3147CE411466403AB55AD8E435BCC210" commented="no"><enum>(b)</enum><header>Guidance</header><text>The Administrator shall issue guidance regarding the implementation of the grant program established under subsection (a) in consultation with stakeholders, including representatives of youth, farmers, nongovernmental organizations, the scientific and technological community, trade unions, the business and industrial community, Indigenous communities, and local governments.</text></subsection><subsection id="H382BDD07D8C4490F9CD0646E5DAE37FA"><enum>(c)</enum><header>Applications</header><text>To be eligible for a grant under this section, an eligible entity shall submit to the Administrator an application in such form, at such time, and containing such information as the Administrator determines appropriate, including the following:</text><paragraph id="H648F5685310C4A67801A88C4ABAF2A6E" commented="no"><enum>(1)</enum><text>Information demonstrating that a low-income community is included within the population represented by the eligible entity.</text></paragraph><paragraph id="HBE3CE06D676E41B8B095C0F881CB1A8F"><enum>(2)</enum><text>Information demonstrating that the eligible entity either has experience with, or plans to contract the services of an individual or entity who has experience with—</text><subparagraph id="H0F94925AC777478BB00A63E042CA695B"><enum>(A)</enum><text>conducting risk assessments with regard to climate change;</text></subparagraph><subparagraph id="HF2461787D09540EB802BCA3E707BFB1C"><enum>(B)</enum><text>hazard mitigation;</text></subparagraph><subparagraph id="H1EBBEAF4CA9D484A911B456AE92FB4F3"><enum>(C)</enum><text>program and project finance; and</text></subparagraph><subparagraph id="H830FE4F13B2548B3A2A19DE0B6242CE7"><enum>(D)</enum><text>Federal grant applications.</text></subparagraph></paragraph><paragraph id="HD401B3073AA249359CE1F474EEF37706"><enum>(3)</enum><text>Demographic information of the population represented by the eligible entity, including—</text><subparagraph id="H45BCD651707F47BDB25B2E6C846859BA"><enum>(A)</enum><text>population size;</text></subparagraph><subparagraph id="HB51FEFCFC433427EA9B9C5FF643F7A63"><enum>(B)</enum><text>average household income;</text></subparagraph><subparagraph id="H2006C688ADD4407F9606DDC293FE0989"><enum>(C)</enum><text>race;</text></subparagraph><subparagraph id="HAF8B042372884B77A366B1D67C68B77D"><enum>(D)</enum><text>education level; and</text></subparagraph><subparagraph id="H4C6F81CEFBCB4056B652F8C75D982743"><enum>(E)</enum><text>primary sectors of employment.</text></subparagraph></paragraph><paragraph id="HA780D1BDF3EA4AC0AD2DC276476E33D3"><enum>(4)</enum><text>A statement describing why the eligible entity wants to develop a climate adaptation plan.</text></paragraph><paragraph id="H237CC90397E34DB6BB4CB31DF774F1E7" commented="no"><enum>(5)</enum><text>Information regarding the negative effects of climate change the eligible entity is, or is at risk of, experiencing.</text></paragraph><paragraph id="HE719FC2C89BA4A5B85D34F6881B4C396" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">Information regarding the strategy the eligible entity will use in the development of the climate adaptation plan to engage stakeholders, which shall include, as applicable to the eligible entity, representatives of youth, farmers, nongovernmental organizations, the scientific and technological community, trade unions, the business and industrial community, Indigenous communities that will be affected by the climate adaptation plan of the eligible entity, and neighboring jurisdictions.</text></paragraph><paragraph id="H8A1E969286144308A4FCD4F9E89435FB"><enum>(7)</enum><text display-inline="yes-display-inline">The identity of the person who will lead the development of the climate adaptation plan.</text></paragraph><paragraph id="H04F308474B964116A6D498F766981819"><enum>(8)</enum><text display-inline="yes-display-inline">A statement regarding whether the eligible entity will hire a third party to facilitate the development of the climate adaptation plan.</text></paragraph><paragraph id="H7F1AE0D08E4A406E88CA70EE45B28C07"><enum>(9)</enum><text display-inline="yes-display-inline">The expected timeline for development of the climate adaptation plan.</text></paragraph><paragraph id="H1457658DCE794FFDAE648C7D03898C88"><enum>(10)</enum><text display-inline="yes-display-inline">Actions the eligible entity plans to take to ensure that environmental justice communities within the population represented by the eligible entity are informed of the process for developing the climate adaptation plan.</text></paragraph></subsection><subsection id="HE6C0ACBC347F4921A0DF922BB258B7E4" commented="no"><enum>(d)</enum><header>Integration</header><text>In developing a climate adaptation plan using amounts awarded under this section, an eligible entity shall, to the extent practicable, integrate such plan with other relevant existing plans, including any applicable—</text><paragraph id="HDC16DFE9BC734B4A95BC4C62F0C0FBCC" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">hazard mitigation plan developed pursuant to section 322(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5165">42 U.S.C. 5165(a)</external-xref>);</text></paragraph><paragraph id="HFFCA23E6132F472691C92BC98386EC0E" commented="no"><enum>(2)</enum><text>land use plan;</text></paragraph><paragraph id="HA753ECF83D184902B19312E88A5D78D5" commented="no"><enum>(3)</enum><text>economic development plan;</text></paragraph><paragraph id="H2FF1D7220C4B4BD38EE6C1E1B56F559C" commented="no"><enum>(4)</enum><text>capital improvement plan;</text></paragraph><paragraph id="H937E32AC3FBD4C418A8DCAAD3A5AC0FA" commented="no"><enum>(5)</enum><text>community comprehensive plan; and</text></paragraph><paragraph id="H04C13208DCDF4230A86A22B738FC5FC5" commented="no"><enum>(6)</enum><text>emergency management plan.</text></paragraph></subsection><subsection id="H4F46F909249B43A7B744556D52AF2905"><enum>(e)</enum><header>Climate adaptation plan requirements</header><text>An eligible entity that develops a climate adaptation plan using amounts awarded under this section shall include in such climate adaptation plan the following:</text><paragraph id="HA74C31991D3541E9AE368EB05BE7FE93"><enum>(1)</enum><text>An assessment of the risks posed by climate change to the population represented by the eligible entity, which shall take into consideration demographic and social factors of such population, including—</text><subparagraph id="H2D5BF645E9C542E6B9723FFB4C5B8F47"><enum>(A)</enum><text>geographic distribution;</text></subparagraph><subparagraph id="H46C25502F68E4A20B11DC5453BA2E55E"><enum>(B)</enum><text>race;</text></subparagraph><subparagraph id="HF86440F1915548699B28E390996E0294"><enum>(C)</enum><text>ethnicity;</text></subparagraph><subparagraph id="HD32CB65EC82D47579FE641CAFDB55516"><enum>(D)</enum><text>socioeconomic status;</text></subparagraph><subparagraph id="H6FE7F2B9D43D46748D3068966F2038D4"><enum>(E)</enum><text>health; and</text></subparagraph><subparagraph id="H8CD6EECA995545C2A9F93473FE955D23"><enum>(F)</enum><text>historic and ongoing systemic racism.</text></subparagraph></paragraph><paragraph id="HDB3D93C0EE57487E95CEDE1F489D6E04"><enum>(2)</enum><text>An assessment of the risks posed by climate change to the natural ecosystems within the jurisdiction of the eligible entity, which shall take into consideration factors including—</text><subparagraph id="H146A44E0E4124ADAAF046F0111CABEB6"><enum>(A)</enum><text>geography; and</text></subparagraph><subparagraph id="HE0EEE8DFD4FD4D29B652EC7A6126D7FB"><enum>(B)</enum><text>species present in such ecosystems.</text></subparagraph></paragraph><paragraph id="H62DB22CA921A48589E01BA0F041890AF" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">An assessment of the risks posed by climate change to housing, infrastructure, and public buildings within the jurisdiction of the eligible entity.</text></paragraph><paragraph id="H59D8272BE40F42BDB8B95334AB52AEF8" commented="no"><enum>(4)</enum><text>A description of the actions the eligible entity plans to take to address risks identified under paragraphs (1), (2), and (3), including—</text><subparagraph id="H9BF8D82E3F22478D83C0E38463765B2F" commented="no"><enum>(A)</enum><text>changes in land use, zoning, or building codes and standards; and</text></subparagraph><subparagraph id="HBDE94C73AD1745D3A87947241F20AFD5" commented="no"><enum>(B)</enum><text>restoration and protection of areas within the jurisdiction of the eligible entity and the development of strategies to achieve such restoration and protection.</text></subparagraph></paragraph></subsection><subsection id="H3D0505AF2F43427F8AC8A29CBDFFF356"><enum>(f)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding amounts under this section, the Administrator shall give priority to applications from eligible entities that include an environmental justice community within the population represented by the eligible entity.</text></subsection><subsection id="H32A64F3F170E46D8BF30956028D54627"><enum>(g)</enum><header>Matching requirement</header><text>There shall be no matching requirement for amounts awarded under this section.</text></subsection><subsection id="H3BB7F029DF5F4438B48C1EDE83F8A1D6"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HEAE190847F404CE6AD79DCE564DA7467"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="H441E80DB041141658E04E91B0C93142C"><enum>(2)</enum><header>Climate adaptation plan</header><text>The term <term>climate adaptation plan</term> means a framework for—</text><subparagraph id="HB41D0CC298894E32BD7CFE4A1A6EC4F2"><enum>(A)</enum><text>measuring, tracking, and reducing greenhouse gas emissions; and</text></subparagraph><subparagraph id="HF44A93D938884818A5151769AE0BDC6D"><enum>(B)</enum><text>adopting climate change adaptation measures.</text></subparagraph></paragraph><paragraph id="H91CBC0CB0F024F5CB8B333C73F95B5EB"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="HE9F977E1B34B4D538582B466EC082BF2"><enum>(A)</enum><text>a local government;</text></subparagraph><subparagraph id="HBF5DE1215FAD422E87667BBC4E5A5A13"><enum>(B)</enum><text>an agency or instrumentality of a local government;</text></subparagraph><subparagraph id="H140385E296BA48E78B9FF7B6E3111A71" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">the governing body of a federally recognized Indian Tribe; or</text></subparagraph><subparagraph id="HDC38533A59464AA9B92562F94409E092" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">a federally recognized Indian Tribe or authorized Tribal organization or Alaska Native village or organization that is not a Tribal government or the governing body of a federally recognized Indian Tribe.</text></subparagraph></paragraph><paragraph id="H08B1103EE0C446D6AAE429B04BC8F3F4" commented="no"><enum>(4)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community that, as determined by the Administrator—</text><subparagraph id="HFF96FD7F5E3B41D9985BBF376C0650ED" commented="no"><enum>(A)</enum><text>has significant representation of—</text><clause id="HC419DAECF1694D28B30BD63552D606FD" commented="no"><enum>(i)</enum><text>communities of color;</text></clause><clause id="H865DF3E62D5F4CF38D4475B05A4F1584" commented="no"><enum>(ii)</enum><text>low-income communities; or</text></clause><clause id="H6F34034ED66448789258426F580137B4" commented="no"><enum>(iii)</enum><text>Tribal or Indigenous communities; and</text></clause></subparagraph><subparagraph id="H2BA0DEFAF0C342FD958AA73E8420E5F0" commented="no"><enum>(B)</enum><text>experiences or is at risk of experiencing greater or more frequent adverse environmental or health effects as a result of climate change.</text></subparagraph></paragraph><paragraph id="HE7E3FF9977774400999B91097F807661"><enum>(5)</enum><header>Local government</header><text display-inline="yes-display-inline">The term <term>local government</term> means a county, municipality, city, town, township, local public authority, school district, special district, intrastate district, council of governments (regardless of whether the council of governments is incorporated as a nonprofit corporation under State law), or regional or interstate governmental entity.</text></paragraph><paragraph id="H0BC5C29EAAEE4DE49F46812025390022"><enum>(6)</enum><header>Low-income community</header><text>The term <term>low-income community</term> means a census block group within which 30 percent or more of the population are individuals with an annual household income equal to, or less than, the greater of—</text><subparagraph id="HEDF08E330F2B41DC94A55044E2B3FE7A"><enum>(A)</enum><text>an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Department of Housing and Urban Development; and</text></subparagraph><subparagraph id="HA38219210BDF414895886EC190EDE4E8"><enum>(B)</enum><text>200 percent of the Federal poverty line.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
