which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish in the Department of Agriculture an Office of Agritourism, and for other purposes.</official-title></form><legis-body id="H65634713DE094E3C9502F745BA2B0BD9" style="OLC"><section section-type="section-one" id="H1370EE34D6B64065A5B5CC8771027AA4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accelerating the Growth of Rural Innovation and Tourism Opportunities to Uphold Rural Industries and Sustainable Marketplaces Act</short-title></quote> or the <quote><short-title>AGRITOURISM Act</short-title></quote>. </text></section><section id="H2A531468BB764E86BBA5BA48CF010954"><enum>2.</enum><header>Findings; sense of Congress</header><subsection id="H54BDFD632C0E4BA78A465B5D2FF9511A"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph id="HFACB8673861D4E9ABD60AE5AC2F7C088"><enum>(1)</enum><text>agritourism provides a range of unique experiences to the public, including—</text><subparagraph id="HE98DD85CE70F424C809908D44D9C9608"><enum>(A)</enum><text>education, such as school tours, garden and nursery tours, winery tours, historical agricultural exhibits, hops and microbrewery tours, and distillery tours;</text></subparagraph><subparagraph id="HA92B99B38704402DB0660A41E8355A27"><enum>(B)</enum><text>outdoor recreation, such as river activities, mountain biking, horseback riding, wildlife viewing and photography, fee fishing and hunting, wagon and sleigh rides, cross-country skiing, game preserves, and clay bird shooting;</text></subparagraph><subparagraph id="H3F06B2257436454FB32B77C6597DA239"><enum>(C)</enum><text>entertainment, such as concerts and special events, culinary experiences, festivals, fairs, interaction with farm animals, and weddings;</text></subparagraph><subparagraph id="HEC2513ECBBBA44F88A94FF0599D70E86"><enum>(D)</enum><text>direct sales, such as on-farm sales, farm stands, agriculture-related crafts and gifts, u-pick operations, u-cut tree farms, wineries, breweries, cideries, distilleries, and cut flowers; </text></subparagraph><subparagraph id="H9FAA3F16B33E463B947CD4FA66AC2EA5"><enum>(E)</enum><text>accommodations, such as bed-and-breakfast inns, farm and ranch vacations, yurts, sheep wagons, and guest ranches; and</text></subparagraph><subparagraph id="HBFE9C99F3DFD4BDD8A804CB5D8E07ABB"><enum>(F)</enum><text>dining on a farm;</text></subparagraph></paragraph><paragraph id="HAE369C6BA57D44D5A3C17C8EAFE16D40"><enum>(2)</enum><text>agritourism has financial, educational, and social benefits to communities; and</text></paragraph><paragraph id="HBC612C99DF4D47C488EF2F47CCE10C26"><enum>(3)</enum><text>agritourism continues—</text><subparagraph id="HBE40C04FF0D54E8A8BCD806B04E2F125"><enum>(A)</enum><text>to offer educational opportunities for children and families;</text></subparagraph><subparagraph id="H4214CC4BF05E49E2A3F6F764B9FEB9DC"><enum>(B)</enum><text>to generate supplemental income for owners of agricultural enterprises, which are often small or family-run businesses;</text></subparagraph><subparagraph id="H4AE93E6B3EE349E4BBDD5DC163BC3E76"><enum>(C)</enum><text>to spur economic development in rural communities;</text></subparagraph><subparagraph id="HF7C617081B4249F592BDCF8F33FDB2A0"><enum>(D)</enum><text>to preserve agricultural heritage; and</text></subparagraph><subparagraph id="HBC1055CFF6AC4BF6B7A23A688B10AB64"><enum>(E)</enum><text>to help farms diversify.</text></subparagraph></paragraph></subsection><subsection id="H30E383D0981345E3BAE43EF3BB107568"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that, to further realize the benefits of agritourism to communities, the Secretary of Agriculture should incorporate agritourism into the Department of Agriculture comprehensively.</text></subsection></section><section id="HF54E84679D6640C09B61FCE2E9959808"><enum>3.</enum><header>Office of Agritourism</header><subsection id="HCD61CD02BAC4464EB5C3ED2A0808C792"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Department of Agriculture Reorganization Act of 1994 is amended by inserting after section 216 (<external-xref legal-doc="usc" parsable-cite="usc/7/6916">7 U.S.C. 6916</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6C875B3B75D14B62B0C58F08569D620B"><section id="H6C47FA98E3FF47CCA1709C5714F4EEA0"><enum>217.</enum><header>Office of Agritourism</header><subsection commented="no" display-inline="no-display-inline" id="HDAABBF2EFE4740F1BE749AAB840C6863"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H9D42B00340DD4A6FB35BE81DA2B7F6EE"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Agritourism described in subsection (c).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA6BB2C914E244AF58440135DBEAE2193"><enum>(2)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HE57151916AA3459EAF305BB2FB3D6915"><enum>(A)</enum><text display-inline="yes-display-inline">each of the several States of the United States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H359B3C983F72438DB803409C35AD6489"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H332AD37070D84D0D90621248B345A7B6"><enum>(C)</enum><text>any territory of the United States.</text></subparagraph></paragraph></subsection><subsection id="H53093395B8BB438F8D68D2DF4462B0AF"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish in the Department an Office of Agritourism.</text></subsection><subsection id="HF6DE8D0CA7A74173BA11ED644E24A0FA"><enum>(c)</enum><header>Director</header><text>The Secretary shall appoint a senior official to serve as the Director of the Office of Agritourism.</text></subsection><subsection id="HD4469697B44D4B5EBB1827620C59D32F"><enum>(d)</enum><header>Duties</header><text>The Director shall encourage and promote, in each State, agritourism activities and agritourism businesses, including—</text><paragraph id="HB477158079E542E2857926C72102A373"><enum>(1)</enum><text>educational experiences;</text></paragraph><paragraph id="H90EB7DBA3E9140A7A08B3F44391678D2"><enum>(2)</enum><text>outdoor recreation;</text></paragraph><paragraph id="H378FC0283E914A3B833EB1F72AF07BB5"><enum>(3)</enum><text>entertainment and special events;</text></paragraph><paragraph id="H15A918EB17424FF4BA86C5D80B60C8D9"><enum>(4)</enum><text>direct sales;</text></paragraph><paragraph id="HF046A5108BF34A62922A8F403B7993F9"><enum>(5)</enum><text>accommodations; and</text></paragraph><paragraph id="H648E8D2AC1E642B194C2D3CB1224655C"><enum>(6)</enum><text>any other activity or business relating to agritourism, as determined by the Secretary.</text></paragraph></subsection><subsection id="HE3DA8D81649E4A079390B7326BB20A1F"><enum>(e)</enum><header>Means of achieving</header><text display-inline="yes-display-inline">In carrying out subsection (d), the Director shall—</text><paragraph id="H85349487A08B47DFA58685384259A3A9"><enum>(1)</enum><text display-inline="yes-display-inline">coordinate with the agencies and officials of the Department;</text></paragraph><paragraph id="H10D79DB461464B06965049B396AF73DA"><enum>(2)</enum><text>advise the Secretary on issues relating to agritourism;</text></paragraph><paragraph id="H690D337759164BE88862B63592D009FA"><enum>(3)</enum><text>ensure that the programs of the Department are updated to address best agritourism practices; </text></paragraph><paragraph id="H66F53CDB42C243809CBDE2DA19288F64"><enum>(4)</enum><text>conduct outreach to stakeholders and coordinate external partnerships to share best practices, provide mentorship, and offer technical assistance to agritourism businesses; </text></paragraph><paragraph id="HD95385D96CC6488BADB6898A28F2368A"><enum>(5)</enum><text>facilitate interagency program coordination and develop interagency tools for the promotion of agritourism programs and resources; </text></paragraph><paragraph id="H44AA41024C7E42A08B49B9092E39F6C3"><enum>(6)</enum><text>review and improve farm enterprise development programs that provide information about financial literacy, business planning, and marketing for agritourism;</text></paragraph><paragraph id="H46B01EAAB9614CE6B2DB9DD7869A3A01"><enum>(7)</enum><text>coordinate networks of agritourism businesses; and</text></paragraph><paragraph id="HB6A2413D332B47CB8BD0D5C757939B19"><enum>(8)</enum><text>collaborate with other Federal agencies, as needed.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H86221CDC5C9C4256967E7BE07997A954"><enum>(b)</enum><header>Technical amendment</header><text>The Department of Agriculture Reorganization Act of 1994 is amended by redesignating the first section 225 (<external-xref legal-doc="usc" parsable-cite="usc/7/6925">7 U.S.C. 6925</external-xref>) (relating to the Food Access Liaison) as section 224A.</text></subsection><subsection id="HC2BA8261A1B3493ABBE4175AEAC34E51"><enum>(c)</enum><header>Conforming amendment</header><text>Section 296(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1600B33191994B51A6535FD96257647E"><paragraph id="H250092BF5A2E4A68AC3B60860777DDDB"><enum>(11)</enum><text>The authority of the Secretary to carry out section 217.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
