R. 5178</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230808">August 8, 2023</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Homeland Security to investigate and remove aliens providing false information about drug-related grounds of inadmissibility.</official-title></form><legis-body id="H052FFDB7220F4A42AA227C4FD8042795" style="OLC"><section id="HCCC257CE76D748B192B19C71A818303A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Substance and Possession Abuse Restrictions for Entrance Act of 2023</short-title></quote> or the <quote>SPARE Act of 2023</quote>. </text></section><section id="H65F73088F684437584092C0BC109FEF5"><enum>2.</enum><header>Requirement to investigate and remove aliens providing false information about drug-related grounds of inadmissibility</header><subsection id="H433EAAFF30AD4972B9453761724AA186"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after receiving credible information that an alien knowingly provided false information on an application for admission to the United States related to whether the alien was inadmissible under paragraph (1)(A)(iv) or paragraph (2)(A)(i)(II) of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(1)(A)(iv)</external-xref>, (2)(A)(i)(II)), the Secretary of Homeland Security shall—</text><paragraph id="HFE85B4A4A1D54B8D97F87D6C3CABAF89"><enum>(1)</enum><text>investigate such information; and</text></paragraph><paragraph id="H0F794E57705744BEBEE12F8E2AE54A3E"><enum>(2)</enum><text>if the Secretary determines that at the time of the alien’s admission the alien was so inadmissible, initiate removal proceedings under section 239 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229">8 U.S.C. 1229</external-xref>).</text></paragraph></subsection><subsection id="H54C6EE598AF64064838419DD4D672CC4"><enum>(b)</enum><header>Permanent bar to reentry</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an alien who is removed pursuant to subsection (a)(2) may not seek admission to the United States at any time after such removal. </text></subsection><subsection id="H7D196EF381404F58A5D63678D177B1CC"><enum>(c)</enum><header>Waivers subject to FOIA</header><text display-inline="yes-display-inline">A waiver under subsection (d)(3)(A) or subsection (h) of section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(3)(A)</external-xref>, (h)) of the ground of inadmissibility under paragraph (1)(A)(iv) or paragraph (2)(A)(i)(II) of section 212(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(1)(A)(iv)</external-xref>, (2)(A)(i)(II)) granted by the Secretary of Homeland Security for an alien seeking admission to the United States shall be subject to section 552 of title 5, United States Code (commonly referred to as the <quote>Freedom of Information Act</quote>).</text></subsection></section></legis-body></bill>
