<section id="HBB24A842541447D58D1112D4F124C6BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vaccine Injury Compensation Modernization Act of 2023</short-title></quote>.</text></section> <section id="H8B36E5F425D74401B8F66BC0B9FEE34C"><enum>2.</enum><header>Changes to Vaccine Injury Compensation Program</header> <subsection id="H33BE5BBCB39249909867E164E47E1934"><enum>(a)</enum><header>Special masters</header> <paragraph id="HA2E812DE1DEE432C935E4DBD25F56E39"><enum>(1)</enum><header>Establish minimum number of special masters</header><text display-inline="yes-display-inline">Section 2112(c)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-12">42 U.S.C. 300aa–12(c)(1)</external-xref>) is amended by striking <quote>not more than 8</quote> and inserting <quote>not less than 10</quote>.</text></paragraph> 
<paragraph id="HD1663733A20044A8880C98A7DA036E3E"><enum>(2)</enum><header>Terms</header><text display-inline="yes-display-inline">Section 2112(c)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-12">42 U.S.C. 300aa–12(c)(4)</external-xref>) is amended—</text> <subparagraph id="H8F697F978B4A4CE3B12070E998EE206B" commented="no"><enum>(A)</enum><text>by striking <quote>a term of 4 years</quote> and inserting <quote>an initial term of 4 years</quote>;</text></subparagraph> 
<subparagraph id="H7F12C20B93384A62B7CAC6628D56D731" commented="no"><enum>(B)</enum><text>by striking the second and third sentences; and</text></subparagraph> <subparagraph id="HF1B32A1BE0654E6F86F40C55DC073C73" commented="no"><enum>(C)</enum><text>by adding at the end the following: <quote>An individual appointed as special master may be reappointed to serve one or more additional terms of up to 8 years each, pursuant to paragraph (1), and subject to termination under paragraphs (2) and (3).</quote>.</text></subparagraph></paragraph> 
<paragraph id="HB7E27EB70EB94E769C711B39C57A9D17"><enum>(3)</enum><header>Additional reporting requirements</header><text display-inline="yes-display-inline">Section 2112(c)(6)(E) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-12">42 U.S.C. 300aa–12(c)(6)(E)</external-xref>) is amended—</text> <subparagraph id="H3EC3F576389A4C4C9756277D46D6EFB6"><enum>(A)</enum><text>by inserting after <quote>disposition of petitions,</quote> the following: <quote>the number of petitions filed that are pending disposition, the number of hearings scheduled with respect to a pending disposition,</quote>; and</text></subparagraph> 
<subparagraph id="H9D2865513CBE423FB54522AC1DF68D5B"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, including recommendations on whether additional special masters are needed to ensure an expeditious and fair resolution of petitions or otherwise improve the Program</quote> after <quote>in the Program</quote>.</text></subparagraph></paragraph></subsection> <subsection id="H1464E5E66A4F4BD480E207D3892D31FC"><enum>(b)</enum><header>Recommendations from CDC</header><text display-inline="yes-display-inline">Section 2114(e)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-14">42 U.S.C. 300aa–14(e)(2)</external-xref>) is amended—</text> 
<paragraph id="HCF8A8BE462104021B06C2D3E33CD311E"><enum>(1)</enum><text>by striking <quote>within 2 years of</quote> and inserting <quote>within 6 months of</quote>; and</text></paragraph> <paragraph id="HDF8A6BAEFB524F7D9C840DDC7401499D"><enum>(2)</enum><text>in subparagraph (A), by inserting <quote>adults, or pregnant women</quote> after <quote>to children,</quote>.</text></paragraph></subsection> 
<subsection id="HCAF1B5FF275C43B389A9EB66497D777E"><enum>(c)</enum><header>Increase in compensation</header> 
<paragraph id="HFE6EEE3AFD26431A8C140294A2308257"><enum>(1)</enum><header>Compensation for death</header><text display-inline="yes-display-inline">Section 2115(a)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(a)(2)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="HA1A2B11929C44F528C2EA058F884C6B4" display-inline="no-display-inline"> <paragraph id="HF5D18E998F054DA2BEBF23D7826FACDD"><enum>(2)</enum><text display-inline="yes-display-inline">In the event of a vaccine-related death, an award of—</text> 
<subparagraph id="HE4A1BC5BAC0B47A6BCCE55164EFEA4F3"><enum>(A)</enum><text display-inline="yes-display-inline">if judgment on an award of compensation is entered in calendar year 2021, $600,000; or</text></subparagraph> <subparagraph id="HF2D49944F6384828801D81BAA19B1320"><enum>(B)</enum><text display-inline="yes-display-inline">if judgment on an award of compensation is entered in a subsequent calendar year, the amount equal to the dollar amount applicable under this paragraph for the preceding calendar year, adjusted by the total percentage change that occurred during such preceding calendar year in the Consumer Price Index for all urban consumers (all items; United States city average).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H316777F3323F4894AAA873B80B6BEADE"><enum>(2)</enum><header>Compensation for pain and suffering</header><text>Section 2115(a)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(a)(4)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H31202105F86945829D7D57382A48BE63" display-inline="no-display-inline"> <paragraph id="HD5F244F8A4EB478E9C8EF81E7B4A47B1"><enum>(4)</enum><text display-inline="yes-display-inline">For actual and projected pain and suffering and emotional distress from the vaccine-related injury, an award not to exceed—</text> 
<subparagraph id="HB247051CF8BC4A32B59A4AED95B92DA6"><enum>(A)</enum><text display-inline="yes-display-inline">if judgment on an award of compensation is entered in calendar year 2021, $600,000; or</text></subparagraph> <subparagraph id="HA642122B847E44ADB395289AA92DA01B"><enum>(B)</enum><text display-inline="yes-display-inline">if judgment on an award of compensation is entered in a subsequent calendar year, the amount equal to the dollar amount applicable under this paragraph for the preceding calendar year, adjusted by the total percentage change that occurred during such preceding calendar year in the Consumer Price Index for all urban consumers (all items; United States city average).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6CA13D51022E43D29307F746F1969538"><enum>(d)</enum><header>Increase statute of limitations</header><text display-inline="yes-display-inline">Section 2116(a)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-16">42 U.S.C. 300aa–16(a)(2)</external-xref>) is amended by striking <quote>36 months</quote> and inserting <quote>5 years</quote>.</text></subsection></section> <section id="H4E28C875C6AE4CBD884CA1498D0610E3"><enum>3.</enum><header>Treatment of COVID–19 vaccines</header> <subsection id="H15A1C93F8B5A4BAA82FFB99241673512"><enum>(a)</enum><header>Vaccine injury table</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Health and Human Services shall promulgate regulations to add, in accordance with section 2114(c)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-14">42 U.S.C. 300aa–14(c)(3)</external-xref>) COVID–19 vaccines to the Vaccine Injury Table. In promulgating such regulations, the Secretary shall provide for notice and opportunity for a public hearing and at least 30 days of public comment.</text></subsection> 
<subsection id="HD5C8392B42A5435186655A840E672808"><enum>(b)</enum><header>Transfer to VICP</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the rule promulgated under subsection (a) is finalized, the Secretary of Health and Human Services shall transfer all claims pending, as of such date, under section 319F–4 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6e">42 U.S.C. 247d–6e</external-xref>) with respect to a COVID–19 vaccine to the Vaccine Injury Compensation Program under title XXI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-1">42 U.S.C. 300aa–1 et seq.</external-xref>) finalized. Before such transfer, all claimants with pending claims under such section 319F–4 shall be notified of such transfer via mail, email (if available), and through any legal representative of such claimant for the cause of action involved.</text></subsection></section> <section id="H07218E3AE85344E1886D0081CC272D8C"><enum>4.</enum><header>Professional judgment budget</header> <subsection id="HC56C350FD0D14FC6BA7DDDA9F6FCE5FA" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services—</text> 
<paragraph id="HFCC3493DE67045E098407157F2018086" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in consultation with the Attorney General, shall submit a budget outlining the resource needs for each agency for purposes of carrying out the National Vaccine Injury Compensation Program under subtitle 2 of title XXI of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-10">42 U.S.C. 300aa–10 et seq.</external-xref>) for fiscal years 2024 through 2028; and</text></paragraph> <paragraph id="H32F1922A03594C838731590D411C87E6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">shall submit a budget outlining resource needs for purposes of carrying out the Countermeasures Injury Compensation Program under section 319F–4 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6e">42 U.S.C. 247d–6e</external-xref>) for fiscal years 2024 through 2028. </text></paragraph></subsection> 
<subsection id="HA88BA08E5D1E4060A3270336FC613676" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The budgets described in paragraphs (1) and (1) of subsection (a) shall include estimates of both the resources necessary to process current backlogs and each program’s ability to reduce processing times with respect to such professional judgments.</text></subsection></section> </legis-body></bill>
