R. 5131</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230801">August 1, 2023</action-date><action-desc><sponsor name-id="T000478">Ms. Tenney</sponsor> (for herself, <cosponsor name-id="L000599">Mr. Lawler</cosponsor>, <cosponsor name-id="S001196">Ms. Stefanik</cosponsor>, <cosponsor name-id="G000597">Mr. Garbarino</cosponsor>, <cosponsor name-id="M001221">Mr. Molinaro</cosponsor>, <cosponsor name-id="H001038">Mr. Higgins of New York</cosponsor>, <cosponsor name-id="L000600">Mr. Langworthy</cosponsor>, <cosponsor name-id="M001206">Mr. Morelle</cosponsor>, and <cosponsor name-id="T000469">Mr. Tonko</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of the Treasury to mint coins in recognition of the bicentennial of the Erie Canal.</official-title></form><legis-body id="HDE7CB382EC054F3EB8C331B10DFA4BCD" style="OLC"><section id="H0087CA2618EF4E5C827AE3236217F342" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Erie Canal Bicentennial Commemorative Coin Act</short-title></quote>.</text></section><section id="H818FD2FA6F0E488B81F6F64E549170C5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H21BF56E4B22648F397020BB23A2B3D70"><enum>(1)</enum><text>Built between 1817 and 1825, the original Erie Canal traversed 363 miles from Albany to Buffalo.</text></paragraph><paragraph id="HA0F5DED1D5874811A5428C8E95B3004B"><enum>(2)</enum><text>The Erie Canal was the longest artificial waterway and the greatest public works project in North America.</text></paragraph><paragraph id="H657AB95E03034005A1EE3AFCE0731657"><enum>(3)</enum><text>The Erie Canal was one of the most important steps in the United States initiating its industrial revolution, rapidly increasing the productivity of agriculture and the spread of machinery and manufactured goods.</text></paragraph><paragraph id="HE862854558CE490199130313823A92C5"><enum>(4)</enum><text>The Erie Canal cut the travel time between Albany and Buffalo in half and reduced freight rates by 90 percent. This allowed midwestern farmers and industry to have new access to distant markets.</text></paragraph><paragraph id="H6E7908C6DE07410FBF96950141A281F0"><enum>(5)</enum><text>The Erie Canal opened up the American interior for settlement and enabled a new flow of people and ideas. This fueled social reform movements such as abolitionism, women’s suffrage, utopian communities, and multiple religious movements along the canal corridor.</text></paragraph><paragraph id="HCE75D1420AA44B6B853190EDA18E6FCB"><enum>(6)</enum><text>The Erie Canal continues to define the geography of upstate New York with 80 percent of the upstate New York population living withing 25 miles of the corridor.</text></paragraph><paragraph id="H8FD6985865774B57B76695A6D07515B6"><enum>(7)</enum><text>After 200 years the Erie Canal is still a resource for its local communities as a close to home recreational destination for boaters, bikers, and walkers.</text></paragraph></section><section id="H6BB2EA9596E24BBBA9889CFE5DB33E3D"><enum>3.</enum><header>Coin specifications</header><subsection id="H59E89D57889146ECA5FFB896B742C34F"><enum>(a)</enum><header>Denominations</header><text>The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coin:</text><paragraph id="H50DF0A75A7A64A8E87D345F567E84237"><enum>(1)</enum><header>$5 gold coins</header><text>Not more than 50,000 $5 coins, which shall—</text><subparagraph id="H8096BAD76CDC4D4EB8344E2E444BB476"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph><subparagraph id="HE6A1AA3841A04778A3837112904E9B68"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph><subparagraph id="HB1604C85C0EA41E490030DE8998068D4"><enum>(C)</enum><text>contain not less than 90 percent gold.</text></subparagraph></paragraph><paragraph id="H5F477EC1E3364AA3B356740FF456A205"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 400,000 $1 coins, which shall—</text><subparagraph id="H3FDBDC2173DF4C81880E1064910082FB"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph><subparagraph id="H3DD5F7B8107247689E5CD58F9790FD22"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph><subparagraph id="HE975A539C41140C7B5EEE405B84C71E0"><enum>(C)</enum><text>contain not less than 90 percent silver.</text></subparagraph></paragraph><paragraph id="H00E44579D0ED4D809712591336FE24B4"><enum>(3)</enum><header>Half-dollar clad coins</header><text>Not more than 750,000 half-dollar coins which shall—</text><subparagraph id="H901F84BB5CDC4E11998B56884F469D65"><enum>(A)</enum><text>weigh 11.34 grams;</text></subparagraph><subparagraph id="H73894D7B8C964CB5A7BA6B2C8B787CCA"><enum>(B)</enum><text>have a diameter of 1.205 inches; and</text></subparagraph><subparagraph id="H09C853C15958423992AFC9775BD78505"><enum>(C)</enum><text>be minted to the specifications for half-dollar coins contained in section 5112(b) of title 31, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H60E23A6820FE449D85F98EB4C1E5C618"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</text></subsection><subsection id="H5306F7B80EE145E096F463F62609A762"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections 5134 and 5136 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section><section id="HC3C5C3DD256146618D48843F649A6506"><enum>4.</enum><header>Design of coins</header><subsection id="H8BEC16FE20A24A1FAFE46BF75B64A067"><enum>(a)</enum><header>Design requirements</header><paragraph id="H1987FB948B344852A35483056A2CBCFE"><enum>(1)</enum><header>In general</header><text>The designs of the coins minted under this Act shall be emblematic of the Erie Canal and its impact on the development of the United States and New York State.</text></paragraph><paragraph id="HFB172E79899D4C92B9C54AF2628BA259"><enum>(2)</enum><header>Designation and inscriptions</header><text display-inline="yes-display-inline">On each coin minted under this Act there shall be—</text><subparagraph id="H0921D776B5104EAF8BEEF97ABF0F13AF"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph><subparagraph id="HE5C60FBEC5464CA7912B25F05E6CB42A"><enum>(B)</enum><text display-inline="yes-display-inline">an inscription of the year <quote>2026</quote>; and </text></subparagraph><subparagraph id="HB283D5BEAD1C426382B2C7242B3E653D"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection><subsection id="HBC8ADC19DA644D7DA3A5C3A38F40E601"><enum>(b)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text><paragraph id="H2576746DFD3B4A2FB2A2780E164F69DB"><enum>(1)</enum><text>selected by the Secretary after consultation with—</text><subparagraph id="H187B858B91C2435AA5F79D31CEEDD3EA"><enum>(A)</enum><text>the Commission of Fine Arts; and</text></subparagraph><subparagraph id="H91A99221502F4532A4751FB7A90809BB" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Erie Canalway Heritage Fund, Inc.; and</text></subparagraph></paragraph><paragraph id="HDE3CF0EB8A4B4EDCAE88F314BEEE1E04"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section><section id="HE35B61988E4648D3A98D39BB64DB37DE"><enum>5.</enum><header>Issuance of coins</header><subsection id="H204155C32AD148AFADF181BAD45D8C8B"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection><subsection id="H1A2071B8BD714E3C810B2FCC5538731A" commented="no"><enum>(b)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2026.</text></subsection></section><section id="H6048259217004229902A5166024D7A6B"><enum>6.</enum><header>Sale of coins</header><subsection id="HF3325B5E81CD4F3A963DE356ADC01B7E"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text><paragraph id="H192DB8187E3D4BCAB4401E74C97CFD70"><enum>(1)</enum><text>the face value of the coins;</text></paragraph><paragraph id="H1F7C39F83762448CA08E7EA45152669A"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph><paragraph id="H971DBAA5602D48729DA044CC44B6C144"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection><subsection id="HE611C4B5CF6C4B4A948EC1B3618EF2D1"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection><subsection id="H4281D558F4B14801BDCD05A9E45CD60E"><enum>(c)</enum><header>Prepaid orders</header><paragraph id="H04C661BE94F848A2BFD4A10BB7E1C71F"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph><paragraph id="HAE8B46EC86CC44B1AE101CDCE8820C51"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section><section id="H7496B345F8124BFEBC6D513C1A85812E"><enum>7.</enum><header>Surcharges</header><subsection id="H91C457F2994E46FB9751FBB5856DEB71"><enum>(a)</enum><header>In general</header><text>All sales of coins issued under this Act shall include a surcharge of—</text><paragraph id="HFAFF016BF28E4A71B029CC98700D4750"><enum>(1)</enum><text>$35 per coin for the $5 coin;</text></paragraph><paragraph id="H2603699FE13F4DC8A70BC5F6B0366226"><enum>(2)</enum><text>$10 per coin for the $1 coin; and</text></paragraph><paragraph id="HFDC696F5A2A54043BBE614378D08EEC2"><enum>(3)</enum><text>$5 per coin for the half-dollar coin.</text></paragraph></subsection><subsection id="H953675F82C5447E48F3873BDE4B56795" commented="no"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Subject to section 5134(f) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the Erie Canalway Heritage Fund, Inc., to support the historic preservation, conservation, recreation, interpretation, tourism, and community development of the Erie Canalway National Heritage Corridor and for educational and commemorative programs of the Erie Canal’s history and impact on our Nation’s history.</text></subsection><subsection id="H83D51716BBEA47BF91C24D6895E6EB4A"><enum>(c)</enum><header>Audits</header><text>The recipient of surcharges under this Act shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</text></subsection><subsection id="HB786A8773AF046B785BB996803E38C57"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under section 5112(m)(1) of title 31, United States Code (as in effect on the date of the enactment of this Act). The Secretary may issue guidance to carry out this subsection.</text></subsection></section><section id="H7BC4E84909DB4199917A508446A57F29"><enum>8.</enum><header>Financial assurances</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to ensure that—</text><paragraph id="H00768986A6E54C08B27477246959336A"><enum>(1)</enum><text>minting and issuing coins under this Act will not result in any net cost to the United States Government; and</text></paragraph><paragraph id="H1BD0981CA29149B3A56B62406DF0F1D5"><enum>(2)</enum><text>no funds, including applicable surcharges, shall be disbursed to any recipient designated in section 7 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</text></paragraph></section></legis-body></bill>
