which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Director of the Office of Management and Budget to approve or deny spend plans within a certain amount of time, and for other purposes.</official-title></form><legis-body id="H2119730DB85B46D0AEE7119ABBFD2073" style="OLC"><section id="HDE03071160C14DFC974296FE5E0733DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fishery Improvement to Streamline untimely regulatory Hurdles post Emergency Situation Act</short-title></quote> or the <quote><short-title>FISHES Act</short-title></quote>.</text></section><section id="H4FF2FA93C0964C84B2E28A2FEB4F1EB9" section-type="subsequent-section"><enum>2.</enum><header>Approval or denial of spend plans</header><subsection id="H05CF344EE0CB4E4CB679B66087B0B741"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, in the case of a spend plan submitted to the Director by the Secretary for approval by the Director pursuant to section 312(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)</external-xref>), the Director shall approve or deny such spend plan not later than 30 days after the date on which the Secretary submits such spend plan to the Director for approval.</text></subsection><subsection id="H1C92DF1013F84CB69F89C047DF6F2EE7"><enum>(b)</enum><header>Denial of spend plan</header><paragraph id="H72B6D43D54C047CDBCAF46D6C8B96FB0"><enum>(1)</enum><header>In general</header><text>If the Director denies a spend plan under subsection (a) or paragraph (3) of this subsection, the Director shall, not later than 15 days after the date of such denial, return such denied spend plan to the Secretary with a description of the changes to such denied spend plan that are necessary for the Director to approve such denied spend plan.</text></paragraph><paragraph id="HB7E68874EBE041EC85EE3C8289E127BA"><enum>(2)</enum><header>Resubmission of spend plan</header><text display-inline="yes-display-inline">Upon receipt of a denied spend plan under paragraph (1), the Secretary, in consultation with the relevant requester with an affirmative fishery resource disaster determination of the spend plan, shall make the necessary changes to such spend plan described by the Director under paragraph (1) and resubmit such spend plan to the Director for approval.</text></paragraph><paragraph id="HE9F99A8B82BC4B1B8CB31A84B3561E98"><enum>(3)</enum><header>Review of resubmitted spend plan</header><text>Not later than 15 days after the date of the receipt of a spend plan under paragraph (2), the Director shall approve or deny such spend plan.</text></paragraph></subsection><subsection id="HFA2D6C1C2AF34C8EA52F2D4B31C933A3"><enum>(c)</enum><header>Approval of spend plan</header><text>If the Director approves a spend plan under subsection (a) or subsection (b)(3), the Director shall—</text><paragraph id="HB2E3645CA9CA4827AE89FBCEFA583668"><enum>(1)</enum><text>make such approval publicly available on the website of the Office of Management and Budget; and</text></paragraph><paragraph id="HEC18A850D9DE47558BA81AEFEFBE4E48"><enum>(2)</enum><text display-inline="yes-display-inline">include in such approval—</text><subparagraph id="HFD222C7609544D46AC3788B0C4CB52D4"><enum>(A)</enum><text>the date on which communication regarding such spend plan was initiated between the Director and the Secretary;</text></subparagraph><subparagraph id="H50FDABD9F2514F97ADBA9413C93ED80C"><enum>(B)</enum><text>if applicable—</text><clause id="HCDB2E8E75F5549E6A8A02B509025F6A4"><enum>(i)</enum><text>the date of each denial of such spend plan under subsection (a) and subsection (b)(3); and</text></clause><clause id="HD295A3729FFA4445BC522C994BBF401A"><enum>(ii)</enum><text>the date of each resubmission of such spend plan under subsection (b)(2); and</text></clause></subparagraph><subparagraph id="HD33556798EC74D4689D833C081159407"><enum>(C)</enum><text>the date on which the Director approved such spend plan.</text></subparagraph></paragraph></subsection><subsection id="H3F7AB4D68E2F493C927D915914BB9076"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HCD1A792CBBB342ED9777B84E9B9EE927"><enum>(1)</enum><header>Affirmative fishery resource disaster determination</header><text display-inline="yes-display-inline">The term <quote>affirmative fishery resource disaster determination</quote> means a determination by the Secretary under section 312(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)</external-xref>) that a fishery resource disaster has occurred.</text></paragraph><paragraph id="HEC59BB11663E46BF9BB4A1FD3F976362"><enum>(2)</enum><header>Fishery resource disaster</header><text display-inline="yes-display-inline">The term <quote>fishery resource disaster</quote> has the meaning given the term in section 312(a)(1)(C) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)(1)(C)</external-xref>).</text></paragraph><paragraph id="HAD4C393722CC483AB8ACED5DB5512FE6"><enum>(3)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="H4559872C013A49FCA704630157CBFA61"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Commerce.</text></paragraph><paragraph id="HD0C199DA039D45A29387B8939B8E4ADF"><enum>(5)</enum><header>Spend plan</header><text display-inline="yes-display-inline">The term <quote>spend plan</quote> means a spend plan submitted to the Secretary under section 312(a)(6)(D) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)(6)(D)</external-xref>) by a requester with an affirmative fishery resource disaster determination.</text></paragraph></subsection></section></legis-body></bill>
