which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to allow for blended workforces to carry out the supplemental nutrition assistance program under certain conditions, and for other purposes.</official-title></form><legis-body id="H224244B9F59F4C7AB08B90B07A2B6751" style="OLC"><section id="HC3F9B8272541499C8C1166C2EF0980A6" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SNAP Staffing Flexibility Act of 2023</short-title></quote>.</text></section><section id="HB1FA540F973949DB8EC1A545E5B788DC"><enum>2.</enum><header>SNAP staffing flexibility</header><subsection id="HAEFEF5F950A2401A93F1A50A2A45BE31"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 11(e)(6)(B) of the Food and Nutrition Act of 2008, a State agency (as defined in section 3 of the Food and Nutrition Act of 2008) may, by contract with the State agency at a reasonable cost in accordance with the State agency’s standard contracting rules, hire a contractor to undertake supplemental nutrition assistance program certification or carry out any other function of the State agency under the supplemental nutrition assistance program so long as—</text><paragraph id="H2D05AC902BC346E0A9F8CB90CEEBDA94"><enum>(1)</enum><text>the contract does not provide incentives for the agency or contractor to delay eligibility determinations or to deny eligibility for individuals other wise eligible for supplemental nutrition assistance program benefits, and</text></paragraph><paragraph id="H2917CBB3C8934A7492F0D2B9A9DEB8C3"><enum>(2)</enum><text display-inline="yes-display-inline"> the contractor has no direct or indirect financial interest in an approved retail store.</text></paragraph></subsection><subsection id="H3BAD6048441149719590159639BBC632"><enum>(b)</enum><header>Use</header><text display-inline="yes-display-inline">A State agency may use the authority provided in subsection (a) when the State experiences increases in supplemental nutrition assistance program applications or an inability to timely process such applications from causes that include but are not limited to—</text><paragraph id="H7049B9AE6BC54D8588B4E2A2D2A709AF"><enum>(1)</enum><text>pandemics and other health emergencies,</text></paragraph><paragraph id="HD3DB3DEF652A4E56AB2B820212A6D601"><enum>(2)</enum><text>seasonal workforce cycles,</text></paragraph><paragraph id="HA35B881BD31440EFA46FDD488A0C2730"><enum>(3)</enum><text>temporary staffing shortages, and</text></paragraph><paragraph id="HCB41E45A4825425F81C108C544692D18"><enum>(4)</enum><text>weather or other natural disasters.</text></paragraph></subsection><subsection id="H88ECF17D8FAC4B099DE887D26D67024C"><enum>(c)</enum><header>Requirements</header><text>A State agency that hires a contractor under subsection (a) shall ensure such action—</text><paragraph id="H48B4DA38B3F64277B4AC04A7E82AD900"><enum>(1)</enum><text>is consistent with all principles under section 900.603 of title 5 of the Code of Federal Regulations; and</text></paragraph><paragraph id="HE5ED210F4C4D4F9EA474CA92C7E89079"><enum>(2)</enum><text display-inline="yes-display-inline">is part of a blended workforce and does not supplant existing merit-based personnel in the State.</text></paragraph></subsection><subsection id="H72ABA2F3DBE147A89D3323900F140C42"><enum>(d)</enum><header>Notification</header><text display-inline="yes-display-inline">A State agency shall notify the Secretary of Agriculture of the intent to use the authority provided in this section and shall provide any information or data supporting State agency increases in supplemental nutrition assistance program applications or inability to timely process such applications.</text></subsection><subsection id="H5B890844C3134DF2BA2284B3D7696CCC"><enum>(e)</enum><header>Program design</header><text>Any action taken by a State agency under subsection (a) shall not be—</text><paragraph id="H56967E5974D241AB85D1AFDD30A879C6"><enum>(1)</enum><text>considered to be a major change in the operations of such State agency for the purposes of section 11(a)(4) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(a)(4)</external-xref>), or</text></paragraph><paragraph id="H31356767D61C40268F060396A4B23A68"><enum>(2)</enum><text>subject to any requirement specified in such section.</text></paragraph></subsection><subsection id="H199FCCF747504449B0C459C5FD85AE21"><enum>(f)</enum><header>Blended workforce</header><text>For purposes of this section, the term <quote>blended workforce</quote> means a government workforce that combines—</text><paragraph id="HEFC6C8FEBB6C426DA79F8D9CC162896F"><enum>(1)</enum><text>employees of the State or of a local government of such State, and</text></paragraph><paragraph id="H455F2637CB8A42AE93EEFCA67B8F0E0D"><enum>(2)</enum><text>employees of a for-profit, or private nonprofit, employer with whom a contract is made under the authority provided in this section.</text></paragraph></subsection><subsection id="HF8D6F151283C419DB6433A0D013D9921"><enum>(g)</enum><header>State agency notifications</header><text display-inline="yes-display-inline">Not later than 10 days after the date of the receipt of a notification submitted by a State agency under subsection (d), the Secretary of Agriculture shall make publicly available on the website of the Department of Agriculture the notification submitted by such State agency and any accompanying information or data supporting such notification so submitted.</text></subsection><subsection id="H62CBC9BC11C2496ABB894510FE25D8B7"><enum>(h)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall submit to the Agriculture Committee of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, an annual report that contains a description of the measures taken to address the increases in supplemental nutrition assistance program applications, any inability to timely process such applications, any information or data supporting State agency requests and recommendations for changes to the Secretary’s authority under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) to assist the Secretary, and States and local governments of State, in preparations for any future increases in supplemental nutrition assistance program applications or inability to timely process such applications.</text></subsection><subsection id="HD9025D66C6534507BB7BE49BE5E2EC43"><enum>(i)</enum><header>Temporary staffing shortages</header><text display-inline="yes-display-inline">In cases of temporary staffing shortages, the authority provided to State agencies under subsection (a)—</text><paragraph id="H1057826572794768AE46CF3BF8B39ADA"><enum>(1)</enum><text> shall expire when the backlog of supplemental nutrition assistance program applications has been eliminated, and</text></paragraph><paragraph id="H472A98F3523846378934FFBD602DAF0D"><enum>(2)</enum><text display-inline="yes-display-inline"> shall not impact any collective bargaining agreement or memorandum of understanding in effect between the State and employees of the State or of a local government of such State.</text></paragraph></subsection></section></legis-body></bill>
