R. 5086</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230728">July 28, 2023</action-date><action-desc><sponsor name-id="M001160">Ms. Moore of Wisconsin</sponsor> (for herself, <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>, <cosponsor name-id="H001081">Mrs. Hayes</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="J000288">Mr. Johnson of Georgia</cosponsor>, <cosponsor name-id="C001067">Ms. Clarke of New York</cosponsor>, <cosponsor name-id="P000610">Ms. Plaskett</cosponsor>, <cosponsor name-id="T000487">Ms. Tokuda</cosponsor>, <cosponsor name-id="S001185">Ms. Sewell</cosponsor>, <cosponsor name-id="G000551">Mr. Grijalva</cosponsor>, <cosponsor name-id="S001156">Ms. Sánchez</cosponsor>, <cosponsor name-id="E000296">Mr. Evans</cosponsor>, <cosponsor name-id="S000185">Mr. Scott of Virginia</cosponsor>, and <cosponsor name-id="B001281">Mrs. Beatty</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to exclude from income, for the purpose of determining eligibility and benefits, increased income received from cost of living adjustments made under titles II and XVI of the Social Security Act, section 3(a)(1) of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231b">45 U.S.C. 231b(a)(1)</external-xref>), or section 5312 of title 38 of the United States Code, and income received from supplementary payments received under section 1616 of the Social Security Act.</official-title></form><legis-body id="H89C33E700D234ADCB53BFC872CEE6225" style="OLC"><section id="H4D2CF7D7F9B648D085895A46A2672CAC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COLAs Don’t Count Act of 2023</short-title></quote>.</text></section><section id="H0909C33709D94E7391D6AFDCDD4C42DD" section-type="subsequent-section"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Section 5(d) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(d)</external-xref>) is amended—</text><paragraph id="HBF05E51A5F4F415EA8FCEF1ED453061B"><enum>(1)</enum><text> is by amending paragraph (12) to read as follows:</text><quoted-block style="OLC" id="HC7A2F1FBBDE14C41A1225672CFB6179E" display-inline="no-display-inline"><paragraph id="H093549EBA46B4342BB95E2511C6EB51A"><enum>(12) </enum><text display-inline="yes-display-inline">through September 30 of any fiscal year any increase in income attributable to a cost-of-living adjustment made on or after January 1st of such fiscal year under title II or XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>, 1381 et seq.), section 3(a)(1) of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231b">45 U.S.C. 231b(a)(1)</external-xref>), or section 5312 of title 38 of the United States Code, if the household was certified as eligible to participate in the supplemental nutrition assistance program or received an allotment in the month immediately preceding the first month in which the adjustment was effective;</text></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></paragraph><paragraph id="HCD89D6DCE06044788DA3A499EA05E34C"><enum>(2)</enum><text>in paragraph (18) by striking <quote>and</quote> at the end,</text></paragraph><paragraph id="H14F621CF8E6C4B55B028BA3558090A79"><enum>(3)</enum><text>by redesignating paragraph (19) as paragraph (20), and</text></paragraph><paragraph id="H5FD3A4979D3F4078B51648A313293143"><enum>(4)</enum><text> by inserting after paragraph (18) the following:</text><quoted-block style="OLC" id="H74E690C9A6FE4199BD39D6669A029F2A" display-inline="no-display-inline"><paragraph id="H7946B005FB40432894C71B45A1E950C4"><enum>(19)</enum><text display-inline="yes-display-inline"> supplementary payments received under section 1616 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382e">42 U.S.C. 1382e</external-xref>); and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H6E6B3D0636E145DEAB88645FD2F9139B"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on October 1, 2024.</text></section></legis-body></bill>
