which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to strengthen reporting to the CyberTipline related to online sexual exploitation of children, to modernize liabilities for such reports, to preserve the contents of such reports for 1 year, and for other purposes.</official-title></form><legis-body id="H11D59316572D44C5B3DA849C21B4E162" style="OLC"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="H2BC487475D334A0B90707B00521A272E"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Revising Existing Procedures On Reporting via Technology Act</short-title></quote> or the <quote><short-title>REPORT Act</short-title></quote>.</text></section><section display-inline="no-display-inline" commented="no" id="H5D699A360F5E4AB98D77003A2332A1BE"><enum>2.</enum><header>Limited liability modernization</header><subsection display-inline="no-display-inline" commented="no" id="H870485FD23524678BD44C96BBF1A1BD7"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 2258B of title 18, United States Code, is amended—</text><paragraph display-inline="no-display-inline" commented="no" id="H051978D9DAC3429DB816AD4FC40FF6BA"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text style="USC" level="section">providers or domain name registrars</header-in-text></quote> and inserting <quote><header-in-text style="USC" level="section">the reporting, storage, and handling of certain visual depictions of apparent child pornography to the National Center for Missing &amp; Exploited Children</header-in-text></quote>;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H61AF4660CE3D4B06AA7AF51DFC0441F2"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph display-inline="no-display-inline" commented="no" id="H777CB8052C5F48C5965119AD7842BBA4"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting <quote>or charge</quote> after <quote>a claim</quote>; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="H85F5119139C5406D96E0C24188D24CEE"><enum>(B)</enum><text>in paragraph (2)(C), by striking <quote>this section,</quote>; and</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H7BB42CFCB4B24602914CBCFC588887C1"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HDE8C8011C70F49BDB78915E202310B98"><subsection display-inline="no-display-inline" commented="no" id="H2E53C7EA280048018B7DFF9AC06CAF47"><enum>(d)</enum><header>Limited liability for NCMEC-Contracted vendors</header><paragraph id="H3EEAB5DECABC40C8AC72EE28737E327A"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a civil claim or criminal charge may not be brought in any Federal or State court against a vendor contractually retained and designated by NCMEC to support the duties of NCMEC under section 404(b)(1)(K) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)</external-xref>). </text></paragraph><paragraph id="H9662FF66E2104CD0BE7C15B1E05181FD"><enum>(2)</enum><header>Intentional, reckless, or other misconduct</header><text>Paragraph (1) shall not apply to a claim or charge if the vendor—</text><subparagraph id="H84B9389248CF4D4791D19C08C196C142"><enum>(A)</enum><text>engaged in—</text><clause id="H2B07A61C6D3D4C9694950309983D6B4D"><enum>(i)</enum><text>intentional misconduct; or</text></clause><clause id="H33E7CFDAB3BF43E9B75C6D53DED3BB8C"><enum>(ii)</enum><text>negligent conduct; or</text></clause></subparagraph><subparagraph id="H1CBBB0EBFE2B46639FC29E358C7F584B"><enum>(B)</enum><text>acted, or failed to act—</text><clause id="HB85C9378219C41428EC10D9A1319F942"><enum>(i)</enum><text>with actual malice;</text></clause><clause id="HE939CAC94ED642B08C78FAA38374CAB0"><enum>(ii)</enum><text>with reckless disregard to a substantial risk of causing injury without legal justification; or</text></clause><clause id="HF8356BDC4AC84AC689823D28BB308523"><enum>(iii)</enum><text>for a purpose unrelated to the performance of any responsibility or function—</text><subclause id="H81FAFDE92C804C8A904B6336EDA3CE0F"><enum>(I)</enum><text>set forth in paragraph (1); or</text></subclause><subclause id="H34C36D8CCBBA474F9EC8CF0F4D82A929"><enum>(II)</enum><text>pursuant to section 2258A, 2258C, 2702, or 2703.</text></subclause></clause></subparagraph></paragraph><paragraph id="HA3BF189CF812499190482AED654C7634"><enum>(3)</enum><header>Minimizing access by vendor</header><text>With respect to any visual depiction provided pursuant to the duties of NCMEC under section 404(b)(1)(K) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)</external-xref>) that is stored or transferred by a vendor contractually retained and designated by NCMEC to support such duties of NCMEC, a vendor shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC24ECA5373AB48BB9B3BF618BF7C9115"><enum>(A)</enum><text display-inline="yes-display-inline">minimize the number of employees that may be able to obtain access to such visual depiction; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8ECDFEB4C0AE468A9B53DD845F9D2BA9"><enum>(B)</enum><text display-inline="yes-display-inline">employ end-to-end encryption for data storage and transfer functions, or an equivalent technological standard. </text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="HAC358160724E4F85BD1767A27B80D949"><enum>(e)</enum><header>Limited liability for reporting apparent child pornography by an individual depicted in the child pornography as a minor, or a representative of such individual</header><paragraph id="H2153FF7959B5491DB84D81833CDE063F"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a civil claim or criminal charge may not be brought in any Federal or State court against an individual depicted in child pornography as a minor, or a representative of such individual, arising from a report to the NCMEC CyberTipline by the individual, or the representative of such individual, of information that relates to the child pornography in which the individual is depicted as a minor, including a copy of the child pornography.</text></paragraph><paragraph id="H3065A4A7E10541A2AB3BC01EA4FE7A77"><enum>(2)</enum><header>Intentional, reckless, or other misconduct</header><text>Paragraph (1) shall not apply to a claim or charge if the individual, or the representative of such individual—</text><subparagraph id="H5511468956EA4B8DAFE247F8A4FB4566"><enum>(A)</enum><text>engaged in—</text><clause id="H873097E2150246F89AA93919459BAF3C"><enum>(i)</enum><text>intentional misconduct;</text></clause><clause id="H130A323D479B401B83B5C073CA193C20"><enum>(ii)</enum><text>negligent conduct; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HB2E9DBB3EF714F3FBE7D8CFE79173556"><enum>(iii)</enum><text>any activity which constitutes a violation of section 2251; or</text></clause></subparagraph><subparagraph id="HE94AB7662B7E41BC8D0EFC246AE3963C"><enum>(B)</enum><text>acted, or failed to act—</text><clause id="H036F21F4E6EC42AFB88DD4618C8A3EE6"><enum>(i)</enum><text>with actual malice; or</text></clause><clause id="H1F2ED2CF17F843A1B6F55FAA1BA8DCD3"><enum>(ii)</enum><text>with reckless disregard to a substantial risk of causing injury without legal justification.</text></clause></subparagraph></paragraph><paragraph id="HAD9044EA63AA44C79D9A7F5C5CAE1087"><enum>(3)</enum><header>Minimizing access</header><text>With respect to any child pornography reported to the NCMEC CyberTipline by an individual depicted in the child pornography as a minor, or a representative of such individual, NCMEC shall minimize access to the child pornography and ensure the appropriate deletion of the child pornography, as set forth in section 2258D.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B8B3509B4D242FA937D88214C2F7DE9"><enum>(4)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>representative</term>, with respect to an individual depicted in child pornography—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5E143AF671914BD7BED691EA53C2A9E8"><enum>(A)</enum><text>means—</text><clause commented="no" display-inline="no-display-inline" id="HB74F013D98B8440387D4075A5295DC42"><enum>(i)</enum><text display-inline="yes-display-inline">the parent or legal guardian of the individual, if the individual is under 18 years of age;</text></clause><clause commented="no" display-inline="no-display-inline" id="H7D5F7AFC9AB14646A397059697B8F83B"><enum>(ii)</enum><text display-inline="yes-display-inline">the legal guardian or other person appointed by a court to represent the individual;</text></clause><clause commented="no" display-inline="no-display-inline" id="H157448F471744655BFBE425D5B86BF1E"><enum>(iii)</enum><text display-inline="yes-display-inline">a legal representative retained by the individual;</text></clause><clause commented="no" display-inline="no-display-inline" id="HD3C7B315959B42FC9F01521E69C5A41B"><enum>(iv)</enum><text display-inline="yes-display-inline">a representative of the estate of the individual; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H65D94CEA27C340CE9FD4B7747D91E9BC"><enum>(v)</enum><text display-inline="yes-display-inline">a person who is a mandated reporter under section 226(a)(1) of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20341">34 U.S.C. 20341(a)(1)</external-xref>); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H55052950216140289490BE65672016AC"><enum>(B)</enum><text display-inline="yes-display-inline">does not include a person who engaged in any activity which constitutes a violation of section 2251.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HEC39B1B198E547668AA8C97A016D47AD" commented="no"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply with respect to a civil claim or criminal charge that is filed on or after the date of enactment of this Act.</text></subsection><subsection display-inline="no-display-inline" commented="no" id="HBE77D84652BC41C2AF5FADF69EA0943C"><enum>(c)</enum><header>Table of sections amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by striking the item relating to section 2258B and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H1707227DE54E4D958DFBF847EA3F5BC4"><toc><toc-entry level="section" bold="off">2258B. Limited liability for the reporting, storage, and handling of certain visual depictions of apparent child pornography to the National Center for Missing &amp; Exploited Children.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="HA1A05AE108174B0DA325C6BA7394FE0D"><enum>3.</enum><header display-inline="yes-display-inline">Preservation of reports to CyberTipline related to online sexual exploitation of children</header><text display-inline="no-display-inline">Section 2258A(h) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H7CD0A78A52B445408FFE30BFF831773C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>90 days</quote> and inserting <quote>1 year</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7D814C50FA5E4264B5FE31175BB98A56"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H4E684633660C487D86A1DF699C260B4C"><paragraph commented="no" display-inline="no-display-inline" id="H82D26679E7994E38B53C26A68AD8A484"><enum>(5)</enum><header display-inline="yes-display-inline">Extension of preservation</header><text display-inline="yes-display-inline">A provider of a report to the CyberTipline under subsection (a)(1) may voluntarily preserve the contents provided in the report (including any comingled content described in paragraph (2)) for longer than 1 year after the submission to the CyberTipline for the purpose of reducing the proliferation of online child sexual exploitation or preventing the online sexual exploitation of children. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD4C85F170CD14E47B28AFED4C635FA32"><enum>(6)</enum><header display-inline="yes-display-inline">Method of preservation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this paragraph, a provider of a report to the CyberTipline under subsection (a)(1) shall preserve materials under this subsection in a manner that is consistent with the most recent version of the Cybersecurity Framework developed by the National Institute of Standards and Technology, or any successor thereto.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section display-inline="no-display-inline" commented="no" id="H65776984069B470CA54F7FE733EEB214"><enum>4.</enum><header>Strengthening of duty to report apparent violations to CyberTipline related to online exploitation of children</header><subsection display-inline="no-display-inline" commented="no" id="HD58AF64F0AED47D4A5A4165185978481"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 2258A of title 18, United States Code, is amended—</text><paragraph display-inline="no-display-inline" commented="no" id="HB82E9D59CC85404C92A3BE50012A1F56"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2)(A), by inserting <quote>, of section 1591 (if the violation involves a minor), or of 2422(b)</quote> after <quote>child pornography</quote>; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HCD4FDF3DFBCE40FE995629AB9C3EFC2C"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph display-inline="no-display-inline" commented="no" id="H9A62239B44C84272B269550307F020D7"><enum>(A)</enum><text>in paragraph (1), by striking <quote>$150,000</quote> and inserting <quote>$850,000 in the case of a provider with not less than 100,000,000 monthly active users or $600,000 in the case of a provider with less than 100,000,000 monthly active users</quote>; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="H6D422B0F1AA5463082F300050219663F"><enum>(B)</enum><text>in paragraph (2), by striking <quote>$300,000</quote> and inserting <quote>$1,000,000 in the case of a provider with not less than 100,000,000 monthly active users or $850,000 in the case of a provider with less than 100,000,000 monthly active users</quote>.</text></subparagraph></paragraph></subsection><subsection id="H03C455A7651E4C74B5884969BB989AC5" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Guidelines</header><text>Not later than 180 days after the date of enactment of this Act, the National Center for Missing &amp; Exploited Children may issue guidelines, as appropriate, to providers required or permitted to take actions described in section 2258A(a)(1)(B) of title 18, United States Code, on the relevant identifiers for content that may indicate sex trafficking of children, as described in section 1591 of that title, or enticement, as described in section 2422(b) of that title.</text></subsection></section></legis-body></bill>
