<section id="HEDA09BE3696147D581FBB885922B3D10" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Country of Origin Labeling Enforcement Act of 2023</short-title></quote>. </text></section> <section id="HDA80E8D534DB43D5B63779B1B3FAD889"><enum>2.</enum><header>Country of origin labeling for beef</header> <subsection id="H84AA7061AC1C4724A42B8477936474F7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 281 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638">7 U.S.C. 1638</external-xref>) is amended—</text> 
<paragraph id="HF78D262E30D1499CB9334B08858EEDAC"><enum>(1)</enum><text>by redesignating paragraphs (1) through (7) as paragraphs (2) through (8), respectively;</text></paragraph> <paragraph id="H65FE0A6EC8104BDFAF9E5B98B5388E3F"><enum>(2)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text> 
<quoted-block style="OLC" id="H7E399DEEF04E4F3EAEC5BCDCFD772F99" display-inline="no-display-inline"> 
<paragraph id="HED915A56D95B4B22BAD61C9ED14CC833"><enum>(1)</enum><header>Beef</header><text display-inline="yes-display-inline">The term <term>beef</term> means meat produced from cattle (including veal). </text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HE348AF7FEAAA44E6B7F201F3040DF5D7"><enum>(3)</enum><text>in paragraph (2)(A)(i) (as so redesignated), by striking <quote>lamb and venison</quote> and inserting <quote>beef, lamb, and venison</quote>; and</text></paragraph> 
<paragraph id="H3CB0DBF1A62446EEB9797AC07501EE84"><enum>(4)</enum><text>in paragraph (2)(A)(ii) (as so redesignated), by striking <quote>ground lamb and ground venison</quote> and inserting <quote>ground beef, ground lamb, and ground venison</quote>.</text></paragraph></subsection> <subsection id="H32570C6A16DB4AE485EAD5BDC516019D" commented="no"><enum>(b)</enum><header>Notice of country of origin</header><text>Section 282(a) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638a">7 U.S.C. 1638a(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H24E2D14F3D104EE2A38AF27A323BBB18"><enum>(5)</enum><header>Designation of country of origin for beef</header><text display-inline="yes-display-inline">A retailer of a covered commodity that is beef may designate the covered commodity as exclusively having a United States country of origin only if the covered commodity is derived from an animal that was exclusively born, raised, slaughtered, and packaged in the United States.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block> </subsection> <subsection id="H0F9600D1144E431A86F3D8E48289F038"><enum>(c)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 283(b) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638b">7 U.S.C. 1638b(b)</external-xref>) is amended by striking <quote>$1,000 for each violation</quote> and inserting <quote>$1,000 for each violation (or in the case of a covered commodity that is beef, $5,000 for each pound of beef not in compliance with the requirements of section 282)</quote>.</text></subsection> 
<subsection id="H906234712B1F4A9198D910B42359CE59" commented="no"><enum>(d)</enum><header>Rule of construction</header><text>No ruling by the World Trade Organization or by any other international organization of which the United States is a member that is established before, on, or after the date of enactment of this Act may be construed to limit, alter, or affect the authority of the Secretary of Agriculture to require country of origin labeling in accordance with the amendments made by this section.</text></subsection></section> <section id="H60E1A109264841B7AFCBC67915B01F67"><enum>3.</enum><header>Report on false labeling of foreign beef as originating in the United States</header> <subsection id="H71F79DD9664A443FB4EB0C01B2E106C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Secretary of Agriculture shall submit to Congress a report on the false labeling of foreign beef as originating in the United States.</text></subsection> 
<subsection id="H596A2E08034648D0A22A23355EC2D415"><enum>(b)</enum><header>Elements</header><text>The report referred to in subsection (a) shall include the following:</text> <paragraph id="H1B496FAB54BF4B06883CFD66266502E2"><enum>(1)</enum><text display-inline="yes-display-inline">An assessment of how much beef was sold in the United States during the 10-year period beginning on January 1, 2013, that was falsely labeled as having a country of origin of the United States.</text></paragraph> 
<paragraph id="H158D271ED6CE4CED9ED807C00964CA08"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to the 10-year period beginning on January 1, 2013, an assessment of—</text> <subparagraph id="HA8DC98AA3B514448A466FF5A33A37D3F"><enum>(A)</enum><text display-inline="yes-display-inline">which packers falsely labeled beef as originating in the United States; and</text></subparagraph> 
<subparagraph id="HFA12F00193E24F96BE6CF6C432EC4DCD"><enum>(B)</enum><text>in the case of beef so falsely labeled, the correct country of origin.</text></subparagraph></paragraph> <paragraph id="H96DBA6A8392D4C358CE87C88956B6EE1"><enum>(3)</enum><text display-inline="yes-display-inline">An assessment of the extent of economic losses sustained by United States ranchers during the 10-year period beginning on January 1, 2013, because consumers unknowingly purchased beef with a foreign country of origin under the assumption that such beef originated in the United States.</text></paragraph></subsection> 
<subsection id="HFC8EE86E8EF64FF5AA002374325C1C83"><enum>(c)</enum><header>False labeling defined</header><text display-inline="yes-display-inline">In this section, the terms <quote>false labeling</quote> and <quote>falsely labeled</quote> mean, with respect to the labeling of beef, labeling such beef as exclusively having a United States country of origin in a manner that does not meet the criteria specified in paragraph (5) of section 282(a) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638a">7 U.S.C. 1638a(a)</external-xref>) (as added by section 2(b) of this Act).</text> </subsection></section> </legis-body></bill>
