R. 5076</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230728">July 28, 2023</action-date><action-desc><sponsor name-id="C001053">Mr. Cole</sponsor> (for himself, <cosponsor name-id="B000740">Mrs. Bice</cosponsor>, <cosponsor name-id="B001317">Mr. Brecheen</cosponsor>, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="W000812">Mrs. Wagner</cosponsor>, <cosponsor name-id="L000569">Mr. Luetkemeyer</cosponsor>, <cosponsor name-id="H001082">Mr. Hern</cosponsor>, <cosponsor name-id="L000266">Mr. LaTurner</cosponsor>, <cosponsor name-id="O000175">Mr. Ogles</cosponsor>, <cosponsor name-id="B001309">Mr. Burchett</cosponsor>, and <cosponsor name-id="R000609">Mr. Rutherford</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To clarify that, in awarding funding under title X of the Public Health Service Act, the Secretary of Health and Human Services may not discriminate against eligible States, individuals, or other entities for refusing to counsel or refer for abortions.</official-title></form><legis-body id="H21936D5726494132BC5092921B3DF290" style="OLC"><section id="H74A2141367274D0E80A0F2FDC688BCE0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Discrimination in Title X Act</short-title></quote>.</text></section><section id="H514F4B8516D0433AA54C9666515ACDC3"><enum>2.</enum><header>Prohibition on discrimination</header><text display-inline="no-display-inline">Section 1006 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300a-4">42 U.S.C. 300a–4</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6A7DB9E7920B44E29C186814827969BF"><subsection id="H4482419C5E62446E8C1734A3B83ED879"><enum>(e)</enum><text>Notwithstanding any other provision of law, the Secretary may not require any State, individual, or other entity to counsel or refer for abortions as a condition for receiving funding under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
