which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to prohibit discrimination in the Armed Forces.</official-title></form><legis-body id="H1F13E08AD8E948CBAA363F0BCF954B78" style="OLC"><section id="H41B9DB91CA3E4E1998E27859153B87B1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equal and Uniform Treatment in the Military Act</short-title></quote> or the <quote>EQUITY Act</quote>.</text></section><section id="H06D7A900F48644F2A51C0EDA791B98BC" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HAAED6F49181241C0B4F0F9FC27D3EBA3"><enum>(1)</enum><text display-inline="yes-display-inline">Women, Black, Native American, and LGBTQIA+ Americans have served in the Armed Forces since the Revolutionary War.</text></paragraph><paragraph id="H270934005DFD4E5A95813797DFB1BE2E"><enum>(2)</enum><text display-inline="yes-display-inline">In 1948, 16 years before the enactment of the Civil Rights Act (<external-xref legal-doc="public-law" parsable-cite="pl/88/352">Public Law 88–352</external-xref>; 78 Stat. 241), which desegrated civilian spaces, President Truman issued Executive Order 9981, which allowed Black members of the Armed Forces to serve side-by-side with white members.</text></paragraph><paragraph id="HB2C3AFCCDBF24B87ADA96B24B03A2410"><enum>(3)</enum><text display-inline="yes-display-inline">In 1948, President Truman signed the Women’s Armed Services Integration Act (<external-xref legal-doc="public-law" parsable-cite="pl/80/625">Public Law 80–625</external-xref>; 62 Stat. 356) into law, officially allowing women to serve as full, permanent members of each Armed Force.</text></paragraph><paragraph id="H4C28BDCA991B41F4B66178F935E72EDC"><enum>(4)</enum><text display-inline="yes-display-inline">In 1967, President Johnson signed into law <external-xref legal-doc="public-law" parsable-cite="pl/90/130">Public Law 90–130</external-xref>, which authorized the promotion of women to the ranks of general and flag officers.</text></paragraph><paragraph id="HCF7F43F789E644F5B460D55A30C96602"><enum>(5)</enum><text>In 1972, women were allowed to command units that included men.</text></paragraph><paragraph id="H3FEFF2BED44946CDA315D02480E73AA5"><enum>(6)</enum><text display-inline="yes-display-inline">In 1982, the Department of Defense Instruction 1332.14, <quote>Enlisted Administrative Separations</quote>, banned homosexual individuals from serving in the Armed Forces.</text></paragraph><paragraph id="H4D53388F0248401D826727027CDD3F6F"><enum>(7)</enum><text display-inline="yes-display-inline">In 1993, President Clinton signed into law the National Defense Authorization Act for Fiscal Year 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/16">Public Law 103–16</external-xref>), which enacted section 654 of title 10, United States Code, <quote>Policy concerning homosexuality in the armed forces</quote>, commonly known as <quote>Don’t Ask, Don’t Tell</quote>.</text></paragraph><paragraph id="H8F192557E48D41698D31E1A5480D6C43"><enum>(8)</enum><text display-inline="yes-display-inline">In 2011, President Obama signed into law the <quote>Don’t Ask, Don’t Tell Repeal Act of 2010</quote>, allowing homosexual members to openly serve in the Armed Forces.</text></paragraph><paragraph id="HCE1A6E6C942C4DD4AFBF187CA279EA3C"><enum>(9)</enum><text display-inline="yes-display-inline">In 2015, the last remaining policy restrictions on women serving in direct combat roles were removed.</text></paragraph><paragraph id="H99A98DCDAF7C47FAAFD89092DE607D6E"><enum>(10)</enum><text display-inline="yes-display-inline">In 2021, President Biden issued Executive Order 13988, which rescinded the policy that prohibited transgender individuals from serving in the Armed Forces.</text></paragraph><paragraph id="HC477119D2FD0483BACB3554DC4A0DB79"><enum>(11)</enum><text display-inline="yes-display-inline">It should be the policy of the United States that every member of the Armed Forces has the right to serve, advance, and be evaluated based on only individual merit, fitness, capability, and performance, in an environment free of discrimination on the basis of race, color, national origin, religion, sex, gender identity, or sexual orientation.</text></paragraph></section><section id="H4195996BAAA945619AA168B81905E0F5"><enum>3.</enum><header>Nondiscrimination in the Armed Forces</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/49">Chapter 49</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/985">section 985</external-xref> the following new section:</text><quoted-block style="USC" id="H40E43FFA77344DE991363B5FDE7E31B0" display-inline="no-display-inline"><section id="H51E53BB85D114337949853CF26633299"><enum>986.</enum><header>Prohibition on discrimination</header><subsection id="H49E3D95DC86B48C59D309A4C2AC8EAEB"><enum>(a)</enum><header>Prohibition</header><paragraph commented="no" display-inline="yes-display-inline" id="HA420CBBD4E974956ACFA7093A4F64B70"><enum>(1)</enum><text>Subject to paragraph (2), discrimination within the Department of Defense against an individual on the basis of race, color, religion, sex, national origin, gender identity, or sexual orientation, is prohibited.</text></paragraph><paragraph id="H71B7EE324DE34624A5E115D81972F5EF" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A qualification established or applied regarding eligibility for service in an armed force shall take into account only the ability of an individual to meet—</text><subparagraph id="H3B7CE2867ED8460B85888E5D432EE2C5"><enum>(A)</enum><text>general occupational standards for military service; and</text></subparagraph><subparagraph id="H374AC4DA474542DDA56E8EAAA8C04EE9"><enum>(B)</enum><text>the particular military occupational specialty.</text></subparagraph></paragraph></subsection><subsection id="H78E78C43ACEF454DA128A28891F4032C"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD1AF773D5FA9481DAB1C81A0DBDC6A9B"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>gender identity</quote> means the gender-related identity, appearance, mannerisms, or other gender-related characteristics of an individual, regardless of the individual’s designated sex at birth.</text></paragraph><paragraph id="H81346BABDAEE4AA8BEF98257D18094DB"><enum>(2)</enum><text>The term <quote>sex</quote> includes—</text><subparagraph id="H565F3111575B40ADB62FB6EC04E6D924"><enum>(A)</enum><text>a sex stereotype;</text></subparagraph><subparagraph id="HAA28E7F1529F4359AA724E38359E5F27"><enum>(B)</enum><text>pregnancy, childbirth, or a related medical condition; and</text></subparagraph><subparagraph id="HA80A8D63CF644EC885321D996DE017D5"><enum>(C)</enum><text>sex characteristics, including intersex traits.</text></subparagraph></paragraph><paragraph id="H2A489AC5269740F4922D3B5355C8055B"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>sex stereotype</quote> includes—</text><subparagraph id="H552BC1CAE3624513935F8DF56C8EB741"><enum>(A)</enum><text>stereotypical notions of masculinity or femininity;</text></subparagraph><subparagraph id="H700055F872FC4923BB90EA8F82562219"><enum>(B)</enum><text>an expectation of how an individual represents or communicates their gender to others through behavior, clothing, hairstyle, activity, voice, mannerism, or body characteristic;</text></subparagraph><subparagraph id="HB883B17BCB73481CA24C377B2937E83C"><enum>(C)</enum><text>the expectation that an individual will consistently identify with only one gender; and</text></subparagraph><subparagraph id="HDBF1DAF4CE5C4A00BC68B7CD7FCB9DE3"><enum>(D)</enum><text display-inline="yes-display-inline">an expectation regarding the appropriateness of a role for a certain sex.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
