which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 to provide that COPS grant funds may be used for local law enforcement recruits to attend schools or academies if the recruits agree to serve in precincts of law enforcement agencies in their communities.</official-title></form><legis-body id="H873BD8E2607B45839E8AFB6488570226" style="OLC"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="HB9AB7C8042D04BCE97DD7EB37BD32122"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strong Communities Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HFE0120B73B6947379026A5599FC4519F"><enum>2.</enum><header>Strong Communities Program</header><text display-inline="no-display-inline">Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB239650097FC4817A9B75202454779C1"><subsection commented="no" display-inline="no-display-inline" id="H6CA83417F2BB42778FDA0439191E7B07"><enum>(o)</enum><header display-inline="yes-display-inline">COPS Strong Communities Program</header><paragraph commented="no" display-inline="no-display-inline" id="H09365E31CD254AAD913A886D9DFAB464"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="H0234C96F1C0E4980A6A82800CC436A16"><enum>(A)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><clause commented="no" display-inline="no-display-inline" id="H250A0C35E9B54DFD9FE51485C0E07D13"><enum>(i)</enum><text display-inline="yes-display-inline">an institution of higher education, as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>), that, in coordination or through an agreement with a local law enforcement agency, offers a law enforcement training program; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H639B01B66247454591A35146184F4A49"><enum>(ii)</enum><text display-inline="yes-display-inline">a local law enforcement agency that offers a law enforcement training program.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H74D19CD65EA943008F288ADB9345B8F6"><enum>(B)</enum><header display-inline="yes-display-inline">Local law enforcement agency</header><text display-inline="yes-display-inline">The term <term>local law enforcement agency</term> means an agency of a State, unit of local government, or Indian Tribe that is authorized by law or by a government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25D9EFA8557E4BFEB203027BCA5C8170"><enum>(2)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">The Attorney General may use amounts otherwise appropriated to carry out this section for a fiscal year (beginning with fiscal year 2023) to make competitive grants to local law enforcement agencies to be used for officers and recruits to attend law enforcement training programs at eligible entities if the officers and recruits agree to serve in law enforcement agencies in their communities. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB5DDAC7733FB4D06A1D8A56258E9CE12"><enum>(3)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">To be eligible for a grant through a local law enforcement agency under this subsection, each officer or recruit described in paragraph (2) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H89AC295798EF42AAB685611E10C1A817"><enum>(A)</enum><text display-inline="yes-display-inline">serve as a full-time law enforcement officer for a total of not fewer than 4 years during the 8-year period beginning on the date on which the officer or recruit completes a law enforcement training program for which the officer or recruit receives benefits;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB7A63BA75B344E77B901D2151FF41AC6"><enum>(B)</enum><text display-inline="yes-display-inline">complete the service described in subparagraph (A) in a local law enforcement agency located within—</text><clause commented="no" display-inline="no-display-inline" id="H2C665B9ECE3048E691CE20A0D2A4D81D"><enum>(i)</enum><text display-inline="yes-display-inline">7 miles of the residence of the officer or recruit where the officer or recruit has resided for not fewer than 5 years; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HD4951AACCAB54481A5FBEE52B3612007"><enum>(ii)</enum><text display-inline="yes-display-inline">if the officer or recruit resides in a county with fewer than 150,000 residents, within 20 miles of the residence of the officer or recruit where the officer or recruit has resided for not fewer than 5 years; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC5E98E0E88834630942CC0594EEFE9E9"><enum>(C)</enum><text display-inline="yes-display-inline">submit to the eligible entity providing a law enforcement training program to the officer or recruit evidence of employment of the officer or recruit in the form of a certification by the chief administrative officer of the local law enforcement agency where the officer or recruit is employed.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9ECA07D21F834A778B84168AE3D259E1"><enum>(4)</enum><header display-inline="yes-display-inline">Repayment</header><subparagraph commented="no" display-inline="no-display-inline" id="H85988396B7994B14B3E03BD356B1F929"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If an officer or recruit does not complete the service described in paragraph (3), the officer or recruit shall submit to the local law enforcement agency an amount equal to any benefits the officer or recruit received through the local law enforcement agency under this subsection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCAAA8A5A40E641CC8D2C6D2FA37FEE5E"><enum>(B)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Attorney General shall promulgate regulations that establish categories of extenuating circumstances under which an officer or recruit may be excused from repayment under subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section></legis-body></bill>
