R. 4996</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230727">July 27, 2023</action-date><action-desc><sponsor name-id="F000454">Mr. Foster</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a Critical Materials Processing Technology Testbed Capability, and for other purposes.</official-title></form><legis-body id="H370CE28E7A3D4B7EA247530DC299E329" style="OLC"><section id="H6BBA549921154A3DB41C16702023B843" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Materials Processing Technology Testbed Act</short-title></quote>. </text></section><section id="H89CA9EED447B4458B30F5719569F9DCA"><enum>2.</enum><header>Critical Materials Processing Technology Testbed</header><subsection id="H575832D7A0DA495AA76DF1E251167B66" commented="no"><enum>(a)</enum><header>Establishment</header><paragraph id="HFD41B3BEC39E49F2B8C4F9BBFC7AA2E0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with other appropriate Federal agencies, shall administer a competitive, merit reviewed process to establish a Critical Materials Processing Technology Testbed Capability (referred to in this section as the <quote>Testbed</quote>) that allows for—</text><subparagraph id="H74E567E5A53B4FF189BD4A8C5F1D3890" commented="no"><enum>(A)</enum><text>research, development, and demonstration of novel critical materials processing technologies; and</text></subparagraph><subparagraph id="HE5860F3F682143BD969D617D5D24F3AA" commented="no"><enum>(B)</enum><text>scalable performance testing to be conducted on feedstock materials.</text></subparagraph></paragraph><paragraph id="HE0308CB6EE24444BBC9856CC0F9A93FE"><enum>(2)</enum><header>Selection</header><text>In administering the process referred to in paragraph (1), the Secretary shall consider applications from National Laboratories, institutions of higher education, private companies, multi-institutional collaborations, and other entities the Secretary determines appropriate. The Secretary may implement the Testbed as a single site or more than one site as necessary to carry out the mission of the Testbed as described in subsections (a) and (b).</text></paragraph></subsection><subsection id="H90975C65290349BD9F729C8A72BEE277" commented="no"><enum>(b)</enum><header>Focus areas</header><text>The Testbed shall include a focus on substantive and innovative improvements to critical materials processing technologies, including relating to the following:</text><paragraph id="H76B250CC4BCC4577BD9C03F8418FBDD4" commented="no"><enum>(1)</enum><text>Reduced energy intensity.</text></paragraph><paragraph id="HD80E30167273449AA034F6BE29181F9A" commented="no"><enum>(2)</enum><text>Reduced pollutants.</text></paragraph><paragraph id="H118F0AE80C694034923CD4446120FD5A" commented="no"><enum>(3)</enum><text>Reduced water consumption.</text></paragraph><paragraph id="H2D19D98D73C24A8FA689B84D1DC6E329"><enum>(4)</enum><text display-inline="yes-display-inline">Lower environmental and societal impacts.</text></paragraph><paragraph id="H89056BFDE22A4D15890427FFDB41B978" commented="no"><enum>(5)</enum><text>Lower lifecycle costs.</text></paragraph><paragraph id="H4CBC5CA9FD4242DABEDC81EBE1ACBEAD" commented="no"><enum>(6)</enum><text>Improved recovery efficiencies.</text></paragraph><paragraph id="H39F0627BD095414B855A7397B01FC232" commented="no"><enum>(7)</enum><text>Process improvement beyond traditional thermal or pyro chemical techniques.</text></paragraph><paragraph id="H9183B6A3388641029800D48077DFDFB2" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">Reduced volumes and toxicity of waste.</text></paragraph><paragraph id="HE19B831416FC48EA8616556F19428412" commented="no"><enum>(9)</enum><text>Noise reduction.</text></paragraph><paragraph id="HD625C9E5D01945E1B8436E9C6592E906" commented="no"><enum>(10)</enum><text>Worker safety.</text></paragraph><paragraph id="H728FE089902649198206F52BB37109AC" commented="no"><enum>(11)</enum><text>Processing techniques and technologies which have applicability to a wide range of material sources.</text></paragraph></subsection><subsection id="H6E7B4E61AA544694A9F9C5F08C3131FC"><enum>(c)</enum><header>Duration</header><paragraph id="HE482CD7C15AF41668E0E7B7191578986"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Testbed shall receive support for a period of not more than five years, subject to the availability of appropriations.</text></paragraph><paragraph id="HF42DAB949B25411D95C4B0267D0280E5"><enum>(2)</enum><header>Renewal</header><text>Upon the expiration of any period of support of the Testbed, the Secretary may renew support for the Testbed, on a merit-reviewed process, for a period of not more than five years.</text></paragraph></subsection><subsection id="H35B1BAA45B7746779350B9EE1B0AEFD5" commented="no"><enum>(d)</enum><header>Technology transfer</header><text>The Secretary, in coordination with the Director of the Office of Technology Transitions of the Department, shall facilitate the translation and secure transfer to industry of research results produced at the Testbed.</text></subsection><subsection id="H3BF3ED1B85AB4F758970BCA671F26D82" commented="no"><enum>(e)</enum><header>Intellectual property</header><text>The Secretary shall ensure the intellectual property and value proposition generated by research, development, and demonstration activities at the Testbed are retained within the United States.</text></subsection><subsection id="H05A33A021BCA4C0FAE16BA7001C5D788"><enum>(f)</enum><header>Interagency engagement</header><text>In carrying out this section, the Secretary shall—</text><paragraph id="H322F342074614466AFA7FD84EF1E6261"><enum>(1)</enum><text>consult with the Administrator of the Environmental Protection Agency to ensure the goals and objectives of the Testbed align with applicable laws and regulations and environmental justice priorities; and</text></paragraph><paragraph id="H442A962D0A674ECE8137C51934EC1E16"><enum>(2)</enum><text display-inline="yes-display-inline">ensure appropriate cooperation with, and avoid unnecessary duplication of, the activities of the Testbed with the activities of—</text><subparagraph id="H6F13AE9F65E74DDEBA3B59D3BF5B2E98"><enum>(A)</enum><text>other research entities of the Department;</text></subparagraph><subparagraph id="H0F9954DCF3C9489297C2F70D09F0C25E"><enum>(B)</enum><text>the National Laboratories;</text></subparagraph><subparagraph id="H4262BFD092114CCFB2053F5652393387"><enum>(C)</enum><text>other Federal agencies;</text></subparagraph><subparagraph id="HD26B118AA2904EB88DB3EF209ABD19BC"><enum>(D)</enum><text>institutions of higher education;</text></subparagraph><subparagraph id="H8651BB0409054461BA37D13BC9930A03"><enum>(E)</enum><text>United States industry;</text></subparagraph><subparagraph id="HB5DCE0A71BF148D29C803BFD786D7046"><enum>(F)</enum><text>nongovernmental organizations; and</text></subparagraph><subparagraph id="H20438A1A46A84B8A87CD741A36D0A103"><enum>(G)</enum><text display-inline="yes-display-inline">other relevant individuals or entities.</text></subparagraph></paragraph></subsection><subsection id="H83BDAAB36FD34CE58AD4F0B56B00C2D8"><enum>(g)</enum><header>Authorization of appropriations</header><paragraph id="H0C61402AF29E400B8EEAA16C3ABB29DA"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary—</text><subparagraph id="H772C52C2FFD14A2D96EFCACC68022145"><enum>(A)</enum><text>$150,000,000 for fiscal year 2024 to establish the Testbed; and</text></subparagraph><subparagraph id="HBF0F699C79824E5DBE2763972F7E4FA1"><enum>(B)</enum><text>$25,000,000 for each of fiscal years 2025 through 2028 to carry out the activities of the Testbed.</text></subparagraph></paragraph><paragraph id="H8B858C6803B34529B22AEAD8CD1671FA" commented="no"><enum>(2)</enum><header>Cost share</header><text>The Secretary may require that funds made available pursuant to the authorization under paragraph (1)(B) be cost-shared by entities other than a National Laboratory seeking to conduct research, development, or demonstration activities at the Testbed.</text></paragraph></subsection><subsection id="HC6A739F7164B40C78BF651D7F0C0DCA6"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4D7F85235E374E09B142D57A735FD84C"><enum>(1)</enum><header>Critical material</header><text display-inline="yes-display-inline">The term <quote>critical material</quote> means any of the following:</text><subparagraph id="HF507B8A9F14B4E728C23D9DE7BB1DBF1" commented="no"><enum>(A)</enum><text>A critical material, as such term is defined in section 7002(a)(2) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)(2)</external-xref>; enacted as division Z of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>)).</text></subparagraph><subparagraph id="HDEF55A4029A5495E89A45797F96CBFE9"><enum>(B)</enum><text>A strategic mineral as determined by the Secretary of Defense pursuant to Presidential Determination 2022–11.</text></subparagraph></paragraph><paragraph id="H4270F27343E84EBAB243D6C0C71E7C30"><enum>(2)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Energy.</text></paragraph><paragraph id="H353E141948274847A01ECCF9F122B5AC"><enum>(3)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="HB34D22404FAC4391AE806D635F6A1AB8"><enum>(4)</enum><header>National Laboratory</header><text>The term <quote>National Laboratory</quote> has the meaning given such term in section 3 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801(3)</external-xref>).</text></paragraph><paragraph id="HDBFDA558CD854A389E962A991BDCA851"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text></paragraph></subsection></section></legis-body></bill>
