<section id="H77F191D9D6874B5B83239F79D774AC38" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Access to Treatment and Housing Act of 2023</short-title></quote> or the <quote>PATH Act of 2023</quote>.</text></section> <section id="HF018F43A58344B4E8195929685E6C9EE"><enum>2.</enum><header>Center for Unhoused Individuals</header><text display-inline="no-display-inline">Part B of title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb">42 U.S.C. 290bb et seq.</external-xref>) is amended by adding at the end the following: </text>

<subpart id="HF4BBBC167A374464A75D891FB34090B2"><enum>4</enum><header>Center for Unhoused Individuals</header> 
<section id="HE53DAC21E85B4416BB57CE0FADFFD030"><enum>520O.</enum><header>Center for Unhoused Individuals</header> 
<subsection id="HCA8C13BDE7C14B77980B6ECA7E28B404"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Administration a Center for Unhoused Individuals (in this section referred to as the <quote>Center</quote>) to lead Federal efforts to improve and expand access to mental and behavioral health services for unhoused individuals. The Center shall be headed by a director (in this section referred to as the <quote>Director</quote>) appointed by the Secretary from among individuals with extensive experience or academic qualifications in the provision of mental and behavioral health services to unhoused individuals.</text></subsection> <subsection id="HD8A45860CEA04B839058FA5FB8B72312"><enum>(b)</enum><header>Duties</header><text>The Director of the Center shall—</text> 
<paragraph id="H9592AA2A419D425195FD1501D9674AB3"><enum>(1)</enum><text display-inline="yes-display-inline">develop and promote policies that expand access to mental and behavioral health services for unhoused individuals;</text></paragraph> <paragraph id="H91598566AFDF4307AF280E2EB5D04A1B"><enum>(2)</enum><text display-inline="yes-display-inline">develop and promote policies that support housing services for unhoused individuals that have, or likely have, at least one mental and behavioral health condition; </text></paragraph> 
<paragraph id="H751FDF2D0A8042C38C325EF3BD620C87"><enum>(3)</enum><text>facilitate coordination among—</text> <subparagraph id="H48D90C3301C740F79641FE6482504553"><enum>(A)</enum><text display-inline="yes-display-inline">Federal, State, and local entities that serve unhoused individuals; and</text></subparagraph> 
<subparagraph id="H96BD1251716544AF81B0BAAD9D710121"><enum>(B)</enum><text>entities that provide mental and behavioral health services; and</text></subparagraph></paragraph> <paragraph id="HBF824B453A00433A87784D7749044152"><enum>(4)</enum><text display-inline="yes-display-inline">provide technical assistance to entities receiving a grant under section 520O–1 regarding the use of Federal funds to best support mental and behavioral health services for unhoused individuals.</text></paragraph></subsection> 
<subsection id="H2FAB796E8611477C9FEC8F465EFF0DF1"><enum>(c)</enum><header>Grants and cooperative agreements</header><text display-inline="yes-display-inline"><italic></italic>In carrying out the duties under subsection (b), the Director may make grants to and enter into contracts and cooperative agreements with public and nonprofit private entities.</text></subsection> <subsection id="HA9B8E2979F4743849664D3B0A3F1EF6B"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2024 through 2029.</text></subsection></section> 
<section id="H7052002789D844A4A4847BF87C30A9EF"><enum>520O–1.</enum><header>Mental and Behavioral Health Response Grants for Unhoused Individuals</header> 
<subsection id="H4D89785CACAE462E80C95A97B81D64E3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Housing and Urban Development, shall establish a grant program under which the Secretary will award grants to eligible entities to improve mental and behavioral health and housing services for unhoused individuals, including through—</text> <paragraph id="H6D80162D9C77447FB306DBBDF733F077"><enum>(1)</enum><text display-inline="yes-display-inline">the expansion and improvement of mental and behavioral health services for unhoused individuals; and</text></paragraph> 
<paragraph id="H3E3BA2E18AF2496898F5922326EE461A"><enum>(2)</enum><text>the expansion and improvement of housing services for individuals experiencing, or likely experiencing, mental and behavioral health conditions.</text></paragraph></subsection> <subsection id="H309C1D67D235499280FFCC2F22A4E14D"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">An entity is eligible to receive a grant under this section if such entity is—</text> 
<paragraph id="H55368D3D0015467F938F14E47AEA38B3"><enum>(1)</enum><text>a State (as defined in section 534);</text></paragraph> <paragraph id="H40A63981A5C64C3DB970ECB83FC2A614"><enum>(2)</enum><text>a municipality or other unit of local government; or</text></paragraph> 
<paragraph id="H6A5EC12067144A018E27B4579AA0E0F5"><enum>(3)</enum><text display-inline="yes-display-inline">an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act).</text></paragraph></subsection> <subsection id="H98726511E0D94E9DA003EAAB7E5D7363"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An entity may use funds received through a grant under this section to increase access to mental and behavioral health services for unhoused individuals, including through—</text> 
<paragraph id="HAE3274187D554CB08BFE10B14851E2BA"><enum>(1)</enum><text display-inline="yes-display-inline">expanding access to evidence-based substance use disorder treatment and recovery activities and services for unhoused individuals;</text></paragraph> <paragraph id="HE7984C1108054B6D943DCF13FA6AA9EE"><enum>(2)</enum><text display-inline="yes-display-inline">increasing access to medication-assisted treatment for unhoused individuals who are also experiencing opioid use disorder;</text></paragraph> 
<paragraph id="HDF1D63787249478DBE0285803C5D7AE5"><enum>(3)</enum><text display-inline="yes-display-inline">implementing and expanding harm reduction strategies and services through programs that serve unhoused individuals;</text></paragraph> <paragraph id="H754EE5C8E18841CDA8595C258DA5CA14"><enum>(4)</enum><text display-inline="yes-display-inline">reducing opioid and synthetic opioid or fentanyl overdose deaths among unhoused individuals;</text></paragraph> 
<paragraph id="H8CEB75128A9547E69BD9F606DB2C4F1C"><enum>(5)</enum><text display-inline="yes-display-inline">implementing and expanding evidence-based substance use disorder prevention strategies among unhoused individuals;</text></paragraph> <paragraph id="HB85AF61E92604B2CB9F2026843719C19"><enum>(6)</enum><text display-inline="yes-display-inline">expanding and increasing care coordination for unhoused individuals experiencing a mental and behavioral health condition;</text></paragraph> 
<paragraph id="HD3D5472CD3C6450BB431EA9AE897B7C5"><enum>(7)</enum><text display-inline="yes-display-inline">expanding access to and increasing the number of health care professionals who treat unhoused individuals experiencing at least one mental and behavioral health condition;</text></paragraph> <paragraph id="HC4686AB70B434E08A5700F230EE9B082"><enum>(8)</enum><text display-inline="yes-display-inline">establishing and expanding housing programs targeting unhoused individuals experiencing mental and behavioral health conditions;</text></paragraph> 
<paragraph id="HBCDD217AF5684BF49B97179425360C29"><enum>(9)</enum><text display-inline="yes-display-inline">expanding access to mental and behavioral health diagnostic services for unhoused individuals;</text></paragraph> <paragraph id="H9F45757730D74272A7B4949F8CC39243"><enum>(10)</enum><text display-inline="yes-display-inline">supporting and expanding the mental and behavioral health care workforce that treats unhoused individuals; and</text></paragraph> 
<paragraph id="H2A5E83393E0B438F869C0D0C58829DAE"><enum>(11)</enum><text display-inline="yes-display-inline">supporting and expanding evidence-based mental health training for non-health care professionals that interface frequently with unhoused individuals, such as law enforcement personnel and first responders.</text></paragraph> </subsection> <subsection id="H3005CA9565364CF7AB29BBB4F7F9AFB6"><enum>(d)</enum><header>Allocation</header> <paragraph id="H12D90913625C421FB4A66F142DBFCA4B"><enum>(1)</enum><header>In general</header><text>Of the amount made available to carry out this section for a fiscal year, the Secretary shall distribute a portion of such amount to eligible entities selected to receive a grant under this section on the basis of a formula developed by the Secretary.</text></paragraph> 
<paragraph id="H70B3C061EC1447D1816DEC63715C666E"><enum>(2)</enum><header>Prioritization</header><text display-inline="yes-display-inline">The formula developed by the Secretary under paragraph (1) shall prioritize eligible entities located in regions that—</text> <subparagraph id="H5C14A6F22ADC45CBB377DFE9707809FA"><enum>(A)</enum><text>experience high rates of homelessness and housing instability; and</text></subparagraph> 
<subparagraph id="H842398ABAB474B17BF3F08632A51BBF3"><enum>(B)</enum><text>experience above-average housing costs.</text></subparagraph></paragraph></subsection> <subsection id="H56A7C9BC977B4AF5A72EB898689C11DA"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $2,000,000,000 for each of fiscal years 2024 through 2029.</text></subsection></section> 
<section id="H588E65D1A9C94B7A90978D9182BDB7A8"><enum>520O–2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subpart:</text> <paragraph id="H61A36846D9A7420B8215BE40C11B6FEC" commented="no"><enum>(1)</enum><header>Mental and behavioral health</header><text>The term <term>mental and behavioral health</term> means the health of an individual as it pertains to mental illness, drug abuse, alcohol abuse, and substance use disorders.</text></paragraph> 
<paragraph id="HD0D42995C1264DB09C27B183004A369E" commented="no"><enum>(2)</enum><header>Unhoused individual</header><text display-inline="yes-display-inline">The term <term>unhoused individual</term> has the meaning given the term <term>homeless individual</term> in section 103(a) of the McKinney-Vento Homeless Assistance Act.</text> </paragraph></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block> </section> </legis-body></bill>
