<official-title display="yes">To amend the Foreign Assistance Act of 1961 to update and strengthen existing efforts to end violence against children, improve coordination among agencies addressing this violence, and promote the use of evidence-based strategies and critical information gathering capabilities, and for other purposes.</official-title>

<section id="H037FA9DE496E42A89EF4A40036A74723" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Efforts to End Violence Against Children Act of 2023</short-title></quote> . </text></section> <section id="H2C77DF2A2EBD409F98D518516F80C744"><enum>2.</enum><header>Sense of congress regarding violence against children surveys</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
<paragraph id="H008BB4E8504F451B9E7B65B13C3F76A2"><enum>(1)</enum><text>Violence Against Children Surveys (VACS) are critical tools for realizing the objectives of the <quote>Advancing Protection and Care for Children in Adversity: U.S. Government Strategy for International Assistance, 2019–2023</quote> for—</text> <subparagraph id="H67EE5D1908C2442CB99BB41E97698A19"><enum>(A)</enum><text>building strong beginnings for vulnerable children through early childhood development interventions;</text></subparagraph>
<subparagraph id="H0C00FE27FAD44345BC212F6AACE4EEDC"><enum>(B)</enum><text>strengthening families and advancing positive parenting; and</text></subparagraph> <subparagraph id="H08F900C8DE2844348F68B186800714E6"><enum>(C)</enum><text>protecting children from violence; and</text></subparagraph></paragraph>
<paragraph id="H27B504DE495840B8AD3135C5BF5A897B"><enum>(2)</enum><text>when leveraging the findings of a VACS, relevant bureaus and offices should consider whether—</text> <subparagraph id="HDCEAF1167E6C4EFDA86EB7C4CF3E63CC"><enum>(A)</enum><text>governments have fully committed to the process of conducting the survey;</text></subparagraph>
<subparagraph id="H70B3796B3933472387EC8D0A979687A0"><enum>(B)</enum><text>there is presence and capacity amongst partner entities in-country to support implementation of the survey;</text></subparagraph> <subparagraph id="HF473741145E247D98B7F4A32D9F32D69"><enum>(C)</enum><text>there is availability of funding to both implement the survey and support Centers for Disease Control technical assistance for implementation; and</text></subparagraph>
<subparagraph id="H59D705BA8A2D4C518F04A2F86010F148"><enum>(D)</enum><text>governments have expressed support for action in response to survey findings, such as demonstrating the ability to mobilize resources and having funding in place for programs and services.</text></subparagraph></paragraph></section> <section id="HBA589B95861645ED8BECD92AA1E76B17"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States to—</text>
<paragraph id="H9154AD01EB294BDC9A56C06422DF1B63"><enum>(1)</enum><text>promote, fund, and support the protection of children from violence, exploitation, abuse, and neglect by investing in preventative and responsive programming care in relevant foreign assistance programs; and</text></paragraph> <paragraph id="HC0C0F60B6CF640DF9381AC4CEC76CB27"><enum>(2)</enum><text>rely on evidence-based, efficient, and effective interventions in strategies and programs to support vulnerable children, promote permanent family care, and protect children from violence, exploitation, and abuse.</text></paragraph></section>
<section id="H488F71BDD80949718BA9190FABF3EF0F"><enum>4.</enum><header>Assistance for children in adversity</header><text display-inline="no-display-inline">Section 135 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2152f">22 U.S.C. 2152f</external-xref>) is amended—</text> <paragraph id="HFE8BB2F8FA27410AA8B3BC4F801EBC7F"><enum>(1)</enum><text>by adding at the end of subsection (a) the following:</text>
<quoted-block style="OLC" id="H3693FB5386E94962A9BD96D754D15F3F" display-inline="no-display-inline">
<paragraph id="H61A91CDFDABE469DAC6CE5AC7C805226"><enum>(10)</enum><text display-inline="yes-display-inline">Exposure to sexual, physical, and emotional violence, particularly when such exposure is repeated or chronic, can significantly affect a child’s brain development and function and cause life-long consequences, including poor mental health, hindered neurological development, slowed physical development, reduced learning, and risky health behavior, continuing cycles of poverty, and epigenetic consequences.</text></paragraph> <paragraph id="H4F4612303C87444B983B70634F52D283"><enum>(11)</enum><text>Child protection interventions can be lifesaving, especially in such critical circumstances as humanitarian responses, regions experiencing fragility, and conflict areas.</text></paragraph>
<paragraph id="H48A872574FC94980ABFCF6EBF65B85AB"><enum>(12)</enum><text>The Violence Against Children Surveys are critical tools in partnering with foreign governments to analyze violence against children and in creating action plans to address this violence and protect vulnerable children. </text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H1E9860616E4847D3B724A253769E4A90"><enum>(2)</enum><text>by adding at the end of subsection (b) the following:</text>
<quoted-block style="OLC" id="HF082177210B8445396066CEBCF1F95E4" display-inline="no-display-inline">
<paragraph id="H2C1C537584D948B288C09E2BF9ED830A"><enum>(6)</enum><header>Vulnerable children</header><text display-inline="yes-display-inline">The term <term>vulnerable children</term> means children who are experiencing conditions of serious deprivation and danger, including those who—</text> <subparagraph id="H4EF45F37E3FF4EFBBBB91066C39056A7"><enum>(A)</enum><text>are living outside of family care;</text></subparagraph>
<subparagraph id="HF244FD36349A42A9B05BFF67A87D9984"><enum>(B)</enum><text>have been trafficked;</text></subparagraph> <subparagraph id="H547A66B6956B41B290C487D4C1E9B07C"><enum>(C)</enum><text>are experiencing violence;</text></subparagraph>
<subparagraph id="H7E86A9C5A6D745A0B58045CDD023EF70"><enum>(D)</enum><text>are experiencing labor or sexual exploitation;</text></subparagraph> <subparagraph id="HECA39D84F4004FC79C7419BF79B743FB"><enum>(E)</enum><text>are affected by, or are emerging from, armed conflict or humanitarian crises;</text></subparagraph>
<subparagraph id="HE2F04C5C40844E5E9FBFCAB1E506DCAA"><enum>(F)</enum><text>have disabilities;</text></subparagraph> <subparagraph id="HBDC0E0DE67024113AE6C3F098B3715C9"><enum>(G)</enum><text>are orphans; or</text></subparagraph>
<subparagraph id="H3A9BBBB6A254440289CFD41BDF709A63"><enum>(H)</enum><text>are otherwise vulnerable, including because of HIV/AIDS, acute illness, or having been born prematurely.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H14965D686C5B4F63B8AC158E6BF3E981"><enum>(3)</enum><text>in subsection (c)—</text>
<subparagraph id="HAC3E64E38366486989A38478F8DA8763"><enum>(A)</enum><text>in paragraph (6), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph> <subparagraph id="HD146FC2CB6B149C2B49A0CD3A3C72713"><enum>(B)</enum><text>in paragraph (7), by striking the period at the end and inserting a semicolon; and</text></subparagraph>
<subparagraph id="HB9957EECAA854CB383B42B0B968B1B7D"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HD6DC50407E8649CA95FC54219ECAC6C1" display-inline="no-display-inline"> <paragraph id="H28E2DE35F3D6402696A14ECEDDE66670"><enum>(8)</enum><text display-inline="yes-display-inline">to support nurturing, protective, and permanent family care for vulnerable children and to extend protective services to children living outside of family care; </text></paragraph>
<paragraph id="HC08C53123E7D40F9ABB7C48024550100"><enum>(9)</enum><text>to promote the protection of children from violence, exploitation, abuse, and neglect by investing in preventative and responsive programming built upon evidence-based strategies; and</text></paragraph> <paragraph id="H09A06BF6F76C469A9F01A4A529A5808C"><enum>(10)</enum><text>to provide lifesaving protection and interventions for vulnerable children in emergency settings and fragile contexts.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section>
<section id="HAC03BF774877459381A5645A4A6604BB"><enum>5.</enum><header>Amendments to the Assistance for Orphans and Other Vulnerable Children in Developing Countries Act</header><text display-inline="no-display-inline">The Assistance for Orphans and Other Vulnerable Children in Developing Countries Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/95">Public Law 109–95</external-xref>) is amended as follows:</text> <paragraph id="H871244C463D1406A9336878EAE0BB3B7"><enum>(1)</enum><text>In section 4 (<external-xref legal-doc="usc" parsable-cite="usc/22/2152f">22 U.S.C. 2152f</external-xref> note)—</text>
<subparagraph id="H16FAA65C75A841908EB269F33BEC3D4E"><enum>(A)</enum><text>by amending subsection (a) to read as follows:</text> <quoted-block style="OLC" id="HE25D1285C08F4DC6B99227F838A914EC" display-inline="no-display-inline"> <subsection id="H3837417395AC46578480AEFCB2364E8E"><enum>(a)</enum><header>Requirement for strategy</header> <paragraph id="HF032729E87F749E595F7B857C142AFAE"><enum>(1)</enum><header>Initial submission</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the <short-title>Strengthening Efforts to End Violence Against Children Act of 2023</short-title>, the President shall develop and submit to the appropriate congressional committees a strategy for coordinating, implementing, and monitoring assistance programs for children in adversity under section 135 of the Foreign Assistance Act of 1961.</text></paragraph>
<paragraph id="H290A997531B34832AD8E3F6C0029C0A4"><enum>(2)</enum><header>Comment and review</header><text>The strategy required by paragraph (1) shall not be implemented before the date that is 90 days after the date of the submission of the strategy. During such 90-day period, the President shall consider and, if appropriate, revise, such strategy in light of any comments provided to the President by the appropriate congressional committees.</text></paragraph> <paragraph id="HC705B923194D4422ADBF5EE66AD05D4A"><enum>(3)</enum><header>Implementation deadline</header><text>Subject to revisions in accordance with paragraph (2), the President shall begin implementation of the strategy required by paragraph (1) not later than 150 days after the date of the submission of the strategy.</text></paragraph>
<paragraph id="HF53CE5FB1CF64E04AC0ABD5875703E5A"><enum>(4)</enum><header>Review of implementation</header><text>Every 4 years, the President shall submit to the appropriate congressional committees—</text> <subparagraph id="HA933D25EE8C04DC0BAD1397C85D0110E"><enum>(A)</enum><text>a review of the manner and extent to which the strategy required by paragraph (1) has been implemented during the preceding 4 years; and</text></subparagraph>
<subparagraph id="H0BEFF48BA3B744979A1758DA3CF7FEC0"><enum>(B)</enum><text>an updated strategy, incorporating the findings of such review, for the subsequent 4 years.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H926B4B5965814D148506DE8250162CFF"><enum>(B)</enum><text>by amending subsection (b) to read as follows:</text>

<subsection id="HD56A90FE991F42E8AE9B45DC249ABA01"><enum>(b)</enum><header>Consultation</header>
<paragraph id="HD537F718324C4BE6A83DD611A45F5CEC"><enum>(1)</enum><header>In general</header><text>The strategy described in subsection (a)(1) shall be developed by the Special Advisor for Assistance to Orphans and Vulnerable Children (appointed pursuant to section 135(e)(1) of the Foreign Assistance Act of 1961), in consultation with the appropriate consulting partners listed in paragraph (2), to ensure that the strategy—</text> <subparagraph id="H5754AC8B7E8B4E7DB48F810D8000042C"><enum>(A)</enum><text>will not impede the efficiency of implementing assistance programs for orphans and vulnerable children;</text></subparagraph>
<subparagraph id="HAF7977D482DD411DA347359E4B5A0CE3"><enum>(B)</enum><text>addresses the specific needs of local populations; and</text></subparagraph> <subparagraph id="HE8731DCCF599446688F99E2712BD9E14"><enum>(C)</enum><text>is fully implemented.</text></subparagraph></paragraph>
<paragraph id="HA3140FDC84B9434A82C134F644B8622F"><enum>(2)</enum><header>Appropriate consulting partners</header><text display-inline="yes-display-inline">The appropriate consulting partners listed in this paragraph are—</text> <subparagraph id="H7FAA6DE7095445B695E0A75279E9AB85"><enum>(A)</enum><text>relevant offices in the Department of Health and Human Services, Department of Labor, Department of State, PEPFAR, and the Peace Corps;</text></subparagraph>
<subparagraph id="H5D9D59C22C6E4DAFB9D44D53EA417A09"><enum>(B)</enum><text>United States civil society stakeholders, including service providers; and</text></subparagraph> <subparagraph id="H304322DE0F604370AC3591EE1EF56AC9"><enum>(C)</enum><text>employees of the field missions of the United States Agency for International Development.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HE5B8029802B043AC98DDC00F169A7598"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" id="H7DB98517A73C4F2B8596DED293DEB5C8" display-inline="no-display-inline"> <subsection id="H74906F800F6B415B9DE7D725173C7FD1"><enum>(c)</enum><header>Publication</header><text display-inline="yes-display-inline">The strategy required by subsection (a)(1) and each review of the implementation of such strategy required by subsection (a)(4) shall be made publicly available.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H8D724F55E027409E935113F5FD7E3231"><enum>(2)</enum><text>In section 5(b) (<external-xref legal-doc="usc" parsable-cite="usc/22/2152g">22 U.S.C. 2152g(b)</external-xref>)—</text> <subparagraph id="H8DA01AD9F172456A8623A34C8EB707CB"><enum>(A)</enum><text>by striking paragraph (1);</text></subparagraph>
<subparagraph id="H5B927A95B1164531ADCDEC5E361556F6"><enum>(B)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (1) through (3), respectively; and</text></subparagraph> <subparagraph id="HBC5193D3B5A448C0AA0B2A34E9829F2A"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="H8C034987D01D4BBE9CBB4ECEEDEF9EB2"><enum>(4)</enum><text display-inline="yes-display-inline">The activities of the United States Agency for International Development, the Department of Health and Human Services, the Department of Labor, the Department of State, PEPFAR, and the Peace Corps that implement INSPIRE strategies for ending violence against children, which include—</text> <subparagraph id="H241BD7F3FE3C4375BFB821B8C46F6CE6"><enum>(A)</enum><text>implementation and enforcement of law;</text></subparagraph>
<subparagraph id="H9045B2D2726543299949363FC88FEA17"><enum>(B)</enum><text>norms and values;</text></subparagraph> <subparagraph id="H46036CFA77694B679525C066834C53C9"><enum>(C)</enum><text>safe environments;</text></subparagraph>
<subparagraph id="H2B6B332CE04449F48B06032113E09C9D"><enum>(D)</enum><text>parent and caregiver support;</text></subparagraph> <subparagraph id="HAFE78266878E45E4A6711CD2691226BD"><enum>(E)</enum><text>income and economic strengthening;</text></subparagraph>
<subparagraph id="HA9CBED42F7F445A88042F6F5D86B6879"><enum>(F)</enum><text>response and support services; and</text></subparagraph> <subparagraph id="HA62111E622634AB2A70239C240D38DC4"><enum>(G)</enum><text>education and life skills.</text></subparagraph></paragraph>
<paragraph id="HC750291CA330416BAE623CA3A15203DF"><enum>(5)</enum><text display-inline="yes-display-inline">The manner and extent to which Federal departments and agencies and partner organizations have used findings from Violence Against Children Surveys to inform programming to support, care for, and protect children in adversity.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> <section id="H32B5CAFD5E57488899005E4F05181C0D"><enum>6.</enum><header>Impact of COVID–19 Pandemic on Children in Adversity</header> <subsection id="H3994D7310C584B978CF9363788D742DD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the United States Agency for International Development, acting through the Special Advisor for Children in Adversity, shall include in the first report submitted pursuant to section 5 of the Assistance for Orphans and Other Vulnerable Children in Developing Countries Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/22/2152g">22 U.S.C. 2152g</external-xref>) after the date of the enactment of this Act a report on the impact of the COVID–19 pandemic on violence against children globally.</text></subsection>
<subsection id="H4453F10921A04D2D83A58537359D96CE"><enum>(b)</enum><header>Matters To be included</header><text>The report required under subsection (a) shall also include the following elements:</text> <paragraph id="HECECC3D71F8F48EA9BCDA9D5ACE9EB24"><enum>(1)</enum><text>An assessment of the impact of the COVID–19 pandemic on violence against children and child protection risks, including domestic violence, child trafficking, child marriage, female genital mutilation/cutting, and sexual exploitation, especially as these forms of violence affect marginalized children and youth, such as girls, LGBTQ children and youth, children with disabilities, and other minority populations.</text></paragraph>
<paragraph id="H3A3451533E654265B119B86A2951DD73"><enum>(2)</enum><text>An overview of programs being carried out by participants in the Advancing Protection and Care for Children in Adversity Interagency Working Group to continue investments in child protection, child safeguarding, social-service workforce strengthening, positive parenting, and family strengthening programming during the COVID–19 pandemic, including existing data on funding and programmatic focus disaggregated by gender, country, income level, and disability.</text></paragraph> <paragraph id="H8BE10495189B476BA045044302C584B5"><enum>(3)</enum><text>Descriptions of the effectiveness, cost, and accessibility of the tools and strategies most commonly used to minimize child protection risks and mitigate service disruptions during the COVID–19 pandemic.</text></paragraph>
<paragraph id="H9040522D5C4B4280AFB73B97A2BFAE6D"><enum>(4)</enum><text>Identification of any gaps in reaching marginalized populations with child protection information and services during the COVID–19 pandemic, such as girls, children with disabilities, or children affected by conflict and crisis.</text></paragraph> <paragraph id="HADDC7C3196824BB0B02D7D70133F9AA4"><enum>(5)</enum><text>Descriptions of the tools and resources needed for the Agency to contribute to long-term recovery of children’s protection and well-being in the wake of COVID–19 including distance learning interventions, safe school reopening guidelines, and reenrollment campaigns for out-of-school children and youth.</text></paragraph></subsection>
<subsection id="H4327D5DEE65346A7998C34C2BA31BD43"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form and made available to the public.</text></subsection></section> </legis-body> </bill>
