which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Water Pollution Control Act and direct the Secretary of the Interior to conduct a study with respect to stormwater runoff from oil and gas operations, and for other purposes.</official-title></form><legis-body id="HDC9CCA5EA530448F93F8CC3F6FDAADB2" style="OLC"><section id="H3BFA98EFCF2C492589F0AB199800210D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Focused Reduction of Effluence and Stormwater runoff through Hydrofracking Environmental Regulation Act of 2023</short-title></quote> or the <quote><short-title>FRESHER Act of 2023</short-title></quote>.</text></section><section id="H197DC2E2A5C1491DB2850851CB45E21D"><enum>2.</enum><header>Stormwater runoff from oil, gas, and mining operations</header><subsection id="HB67865344C0242AEA50C4B3DAA331DF2"><enum>(a)</enum><header>Limitation on permit requirement</header><text display-inline="yes-display-inline">Section 402(l) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by striking paragraph (2) and redesignating paragraph (3) as paragraph (2).</text></subsection><subsection id="HB3564D29CB6149448320549F401BC7F0"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>) is amended—</text><paragraph id="H26A71EF7D8DC4C86A84D3609D0F0EEB2"><enum>(1)</enum><text>by striking paragraph (24); and</text></paragraph><paragraph id="H1C58C60ABA574E5AB9AF00973C89AF66"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (25) through (27) as paragraphs (24) through (26), respectively.</text></paragraph></subsection><subsection id="H3CB2DE1C644D4143AD32224F1FA4F82F"><enum>(c)</enum><header>Study</header><paragraph id="H8CF4C223786345329A004234F93A7FD4"><enum>(1)</enum><header>In general</header><text>The Secretary of the Interior shall conduct a study of stormwater impacts with respect to any area that the Secretary determines may be contaminated by stormwater runoff associated with oil or gas operations, which shall include—</text><subparagraph id="H18E702284A804B1781039A27E92A149F"><enum>(A)</enum><text>an analysis of measurable contamination in such area;</text></subparagraph><subparagraph id="H45314C7D306549219E194BED64F33F2A"><enum>(B)</enum><text>an analysis of ground water resources in such area; and</text></subparagraph><subparagraph id="H06800294E6104517A4B184374B4545AA"><enum>(C)</enum><text>an analysis of the susceptibility of aquifers in such area to contamination from stormwater runoff associated with such operations.</text></subparagraph></paragraph><paragraph id="HFD8C3BFD8F13410E97C89B49132A4A10"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall submit to Congress a report on the results of studies conducted under paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
