<section id="H20780FA3804F4FB4A009DA546EA21823" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cease Animal Research Grants Overseas Act of 2023</short-title></quote> or the <quote><short-title>CARGO Act of 2023</short-title></quote>.</text></section> <section id="H4FF4FB71ED6A4CC69C31900E82895119"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="HCB7AA8867F284D7E9C099BA9178A3D5B"><enum>(1)</enum><text>From fiscal year 2011 through fiscal year 2021, the National Institutes of Health provided approximately $2.2 billion to foreign organizations for research projects involving animals.</text></paragraph> <paragraph id="H7938DEDFEC444F17BDFFAD796C0925E4"><enum>(2)</enum><text>The National Institutes of Health does not conduct inspections of foreign organizations, and these organizations self-report information pertaining to animal welfare creating a risk that information will be misrepresented.</text></paragraph> 
<paragraph id="HE519B67BF6EE455CA860ECEBD8F0F35D"><enum>(3)</enum><text>This lack of oversight has resulted in the mistreatment of animals used in research projects performed outside the United States and funded by the American public.</text></paragraph></section> <section id="H929395C93EA04D68A7E3A4F42EA4C039"><enum>3.</enum><header>No NIH support for use of live animals in research by persons outside of the United States</header><text display-inline="no-display-inline">Section 495 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/289d">42 U.S.C. 289d</external-xref>) is amended—</text> 
<paragraph id="HAF18D9795A594CD78BAFCCB189A5FB6B"><enum>(1)</enum><text>in subsections (a)(3) and (c)(1)(A), by striking <quote>subsection (b)</quote> each place it appears and inserting <quote>subsection (a)</quote>;</text></paragraph> <paragraph id="H71D18E75FC9240239D618408912E2D89"><enum>(2)</enum><text>in subsection (b)(1) by striking <quote>subsection (a)(3)</quote> and inserting <quote>subsection (b)(3)</quote>;</text></paragraph> 
<paragraph id="HCE951DD875DA4AE09D352E55EBA1DB14"><enum>(3)</enum><text>in subsections (b)(1), (b)(3)(A), (b)(3)(C), (c)(1)(A), and (d)(1), by striking <quote>subsection (a)</quote> each place it appears and inserting <quote>subsection (b)</quote>;</text></paragraph> <paragraph id="HBA437427FF504104897AC8F0BDD1E7F1"><enum>(4)</enum><text>in subsection (c), by striking <quote>Notwithstanding subsection (a)(2)</quote> and inserting <quote>Notwithstanding subsection (b)(2)</quote>;</text></paragraph> 
<paragraph id="H21A72DA0F4B44BEC9BB580062C1C7F94"><enum>(5)</enum><text>in subsection (e), by striking <quote>subsections (a) or (c)</quote> and inserting <quote>subsection (b) or (d)</quote>;</text></paragraph> <paragraph id="H51190A95DA0B4EB9935128682389E91F"><enum>(6)</enum><text>by redesignating subsections (a) through (e), as amended, as subsections (b) through (f), respectively; and</text></paragraph> 
<paragraph id="HF5238E8AF18145EE86B0C137E625F41C"><enum>(7)</enum><text>by inserting before subsection (b), as redesignated, the following:</text> <quoted-block style="traditional" id="H4E6C589B5677450BA9653D52B9C98D62" display-inline="no-display-inline"> <subsection id="H950A90B647344DAD9241E5290C4B922B"><enum>(a)</enum> <paragraph id="H41ADFBEFFA8D44AF877A0A8C864B88B4" display-inline="yes-display-inline"><enum>(1)</enum><text>Notwithstanding any other provision of this Act, the National Institutes of Health may not award any support (including any grant, contract, cooperative agreement, or technical assistance) for any activity or program that uses live animals for research unless the research occurs in the United States.</text></paragraph> 
<paragraph id="H2B799975437D44309F358C6AE75EC2C2" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the term <term>United States</term> includes, in addition to the several States, the District of Columbia and any territory or possession of the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> </legis-body></bill>
