concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Clean Air Act to establish a grant program for supporting local communities in detecting, preparing for, communicating about, or mitigating the environmental and public health impacts of wildfire smoke and extreme heat, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smoke and Heat Ready Communities Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ideb46d11da24b4eeb96da489b4594c97f"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id6b562bd295b34f5889d42191fcfd7009"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means Administrator of the Environmental Protection Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b052488525743c39574b75ddd56039e"><enum>(2)</enum><header display-inline="yes-display-inline">Extreme heat</header><text display-inline="yes-display-inline">The term <term>extreme heat</term> has the meaning given the term through a rulemaking of the Administrator, in consultation with the heads of relevant Federal agencies.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc23d5367b1af416d9350a252d6d2b0e7"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida899a5223bba4268b22fae73fe563f92"><enum>(4)</enum><header>Native Hawaiian organization</header><text>The term <term>Native Hawaiian organization</term> has the meaning given the term in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>).</text></paragraph></section><section id="idDC65C2D5A77E45179366B71DF95DB769"><enum>3.</enum><header>Smoke and extreme heat-ready communities</header><text display-inline="no-display-inline">Part A of title I of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="id7036B13E41C54616B85B027D0451077B" act-name=""><section section-type="subsequent-section" id="idA97E34E7EEC04B11A4D76C88ACDDBEFE"><enum>139.</enum><header>Smoke and extreme heat-ready communities</header><subsection commented="no" display-inline="no-display-inline" id="idde662fd4c0714343b39fe0e71315eb56"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of extreme heat</header><text>The term <term>extreme heat</term> has the meaning given the term in section 2 of the <short-title>Smoke and Heat Ready Communities Act of 2023</short-title>.</text></subsection><subsection id="id5B89B3B4CEBE45E2B8A8DD99EF4A7644"><enum>(b)</enum><header>Establishment</header><text>Subject to the availability of appropriations, the Administrator may make grants under this section to air pollution control agencies to support air pollution control agencies in developing and implementing programs that support local communities in detecting, preparing for, communicating with the public about, or mitigating the environmental and public health aspects of wildfire smoke and extreme heat.</text></subsection><subsection id="id1CA5D29E991D4E8FAB6DDB9225C3B524"><enum>(c)</enum><header>Eligible activities</header><text>In carrying out a program described in subsection (b), an air pollution control agency may use funds from a grant received under this section for—</text><paragraph id="id8CA80F7CD35244A7AE1D2702DFC3DEA5"><enum>(1)</enum><text>activities related to the monitoring of, the interpretation of, and communicating with the public about past, present, and future data related to ambient air quality conditions that are caused by wildfire smoke and extreme heat;</text></paragraph><paragraph id="id4EB0B473D4084DFA85F47C4AA8BC072E"><enum>(2)</enum><text>conducting community outreach in areas that may be prone to poor air quality that is attributable to elevated levels of particulate matter, ozone, and other harmful components of wildfire smoke and extreme heat;</text></paragraph><paragraph id="id677EAC709D614B39BF60E1A80C4880E3"><enum>(3)</enum><text>the deployment of air quality monitoring equipment in a manner that is sufficient to evaluate an increased prevalence of poor air quality that is attributable to elevated levels of particulate matter, ozone, and other harmful components of wildfire smoke and extreme heat;</text></paragraph><paragraph id="idA788CB8CA3C949B5A3557D499761B532"><enum>(4)</enum><text>equipping public buildings with air filtration systems that are capable of removing particulate matter and other harmful components of wildfire smoke and extreme heat from the air so that the public buildings may serve as cleaner air spaces during wildfire smoke events and extreme heat events and other poor air quality events;</text></paragraph><paragraph id="idB09233FEDE794F169A1C751C15883087"><enum>(5)</enum><text>the purchase, storage, and distribution of face masks and personal protective equipment, including N–95 filtering facepiece respirators, portable air filtration systems, and other masks and equipment that are capable of removing or otherwise preventing the inhalation of particulate matter, ozone, and other harmful components of wildfire smoke and extreme heat from the air;</text></paragraph><paragraph id="id619235876932420F89F997545B142ABF"><enum>(6)</enum><text>subgrants or providing other financing to private or other public entities with demonstrated financial need—</text><subparagraph id="idC396A4DC9CD1478A82800124811D95CF"><enum>(A)</enum><text>to acquire protective gear; or</text></subparagraph><subparagraph id="id68EB5350394F47688535CE3FFB13277B"><enum>(B)</enum><text>to carry out weatherization measures to mitigate air infiltration; and</text></subparagraph></paragraph><paragraph id="idB8736A7B10044CE985DA8F4E94501372"><enum>(7)</enum><text>such other activities that the Administrator determines to be necessary to carry out the purposes of this section.</text></paragraph></subsection><subsection id="id8F742318250A4DA28E9E4A663BA73733"><enum>(d)</enum><header>Allocation of funds</header><paragraph id="idBD49065CB4CC43C4A3A5B4B7F626DAFB"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Administrator shall establish a formula to distribute grants under this section among air pollution control agencies.</text></paragraph><paragraph id="id42B62F3F014B48DCAD2529287B51041D"><enum>(2)</enum><header>Considerations</header><text>In establishing the formula required under paragraph (1), the Administrator shall consider—</text><subparagraph id="id38FDCCA55AEA426390AE93F9F55057A5"><enum>(A)</enum><text>the vulnerability of communities within a State to wildfire smoke and extreme heat; and</text></subparagraph><subparagraph id="idF4269CBBFBDF46E89204D0DEB1B675ED"><enum>(B)</enum><text>the degree to which a State is prone to poor air quality that is attributable to elevated levels of particulate matter from wildfire smoke and extreme heat.</text></subparagraph></paragraph></subsection><subsection commented="no" id="idA3713A2C1CAB48C6A75EA29E07BD6F28"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id86a95d4ab7644de79cc5f0ba5f1312e5"><enum>4.</enum><header>Research on wildfire smoke and extreme heat</header><subsection id="id284cc51dd0ce496e8a571bcdd125c62d"><enum>(a)</enum><header>Centers of excellence</header><paragraph id="idae9e27e512f64680b5c7fc9a58c26456"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall establish at institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)) 4 centers, each of which shall be known as a <quote>Center of Excellence for Wildfire Smoke and Extreme Heat</quote>, to carry out research relating to—</text><subparagraph id="idf8c818755818434b8d00b670b2672f75"><enum>(A)</enum><text>the effects on public health, including the health of outdoor workers, of—</text><clause commented="no" display-inline="no-display-inline" id="ide0f958b30db443008ce9eb54f7283419"><enum>(i)</enum><text display-inline="yes-display-inline">smoke emissions from wildland fires; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddb62ecfa2dbc457cb9a9d7a23cf84cf0"><enum>(ii)</enum><text display-inline="yes-display-inline">extreme heat; and</text></clause></subparagraph><subparagraph id="id2c88fc5e716547af948fff138f78dd22"><enum>(B)</enum><text>means by which communities can better respond to the impacts of—</text><clause commented="no" display-inline="no-display-inline" id="idfa667976d4ca4d28ae435d02db27fddd"><enum>(i)</enum><text display-inline="yes-display-inline">emissions from wildland fires; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide5925c990a034524bbc5f95eb4916c09"><enum>(ii)</enum><text display-inline="yes-display-inline">extreme heat events.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3358dd352d9143cea1196a92616fe58e"><enum>(2)</enum><header>Priority</header><text>In selecting institutions of higher education (as so defined) at which to establish a center under paragraph (1), the Administrator shall give priority to institutions of higher education (as so defined) that—</text><subparagraph id="id771bb25bc87f4d0cbb1db2180630df9c"><enum>(A)</enum><text>have established expertise with respect to air quality or dedicated centers of air quality research;</text></subparagraph><subparagraph id="id3c674bd1b0ad47aeb2d5ec7fd78637e5"><enum>(B)</enum><text>have experience with relevant outreach and extension work;</text></subparagraph><subparagraph id="ida37724aa690d4d0fafbac831f4608508"><enum>(C)</enum><text>have established relationships with relevant Federal, State, and local agencies, community organizations, Native Hawaiian organizations, and Indian Tribes; and</text></subparagraph><subparagraph id="id01ef167df46f4ceaa1f6bb07265f8c97"><enum>(D)</enum><text>are located in an area that is economically or environmentally impacted by wildfire smoke or extreme heat. </text></subparagraph></paragraph><paragraph id="ided34ceadedb749dfbbd06b15f43cf293"><enum>(3)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator to carry out this subsection $10,000,000 for fiscal year 2024 and each fiscal year thereafter.</text></paragraph></subsection><subsection id="id14d7c78353be4b0db266abd548f35b61"><enum>(b)</enum><header>Research</header><paragraph id="id2ad4afbf4083477b85be3ed40221ef10"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall begin to carry out research—</text><subparagraph id="idfefbd323e18d41e8a37de81fbbcf11a6"><enum>(A)</enum><text>to study the health effects of—</text><clause commented="no" display-inline="no-display-inline" id="ida8e25efdf70648cc8ed15b77a52926fb"><enum>(i)</enum><text display-inline="yes-display-inline">smoke emissions from wildland fires; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2368d55d200a41e28ebff5ea3917d606"><enum>(ii)</enum><text>extreme heat;</text></clause></subparagraph><subparagraph id="id87c97aafb02a449e924b4e354f9a1062"><enum>(B)</enum><text>to develop and disseminate personal and community-based interventions to reduce exposure to and adverse health effects of—</text><clause commented="no" display-inline="no-display-inline" id="id97e8ce6a5a374d0db181b5bc2258e099"><enum>(i)</enum><text display-inline="yes-display-inline">smoke emissions from wildland fires; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb254b6dc3f2246dca7a6a208cac41772"><enum>(ii)</enum><text>extreme heat;</text></clause></subparagraph><subparagraph id="idb7764202db2348228ce0223b80c01800"><enum>(C)</enum><text>to increase the quality of smoke and extreme heat monitoring and prediction tools and techniques; and</text></subparagraph><subparagraph id="id74cbc5bfb36b4095925fe84039c419e9"><enum>(D)</enum><text>to develop implementation and communication strategies.</text></subparagraph></paragraph><paragraph id="idec948eb3a89c4c7a8c4802bf03fb85d6"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator to carry out this subsection $20,000,000 for fiscal year 2024 and each fiscal year thereafter.</text></paragraph></subsection></section><section id="id4a0a0dba241a4c299918874896554fb2"><enum>5.</enum><header>Community smoke and extreme heat planning</header><subsection id="id04b255f5bc9a4f4b83a0a0d51b4f5d98"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall establish a competitive grant program to assist eligible entities described in subsection (b) in developing and implementing collaborative community plans for mitigating the impacts of smoke emissions from wildland fires and extreme heat.</text></subsection><subsection id="idd8dc1bd031204360b45b9594d1e56aa6"><enum>(b)</enum><header>Eligible entities</header><text>An entity that is eligible to submit an application for a grant under subsection (a) is—</text><paragraph id="ide226568f7f50456c80fbf19a52816e30"><enum>(1)</enum><text>a State;</text></paragraph><paragraph id="idef4e1e6d9c924c6c90c5f89c93aa397a"><enum>(2)</enum><text>a unit of local government (including any special district, such as an air quality management district or a school district);</text></paragraph><paragraph id="id8d59f431ecde4a4c830174438a03d05a"><enum>(3)</enum><text>an Indian Tribe; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6983145da6d24652841ae3392b3ab290"><enum>(4)</enum><text>a Native Hawaiian organization.</text></paragraph></subsection><subsection id="id69484f2a3be64e63a64d9475ecdf1baf"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under subsection (a), an eligible entity described in subsection (b) shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, which shall include a plan to collaborate with a public institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)) or other research institution that—</text><paragraph id="idfd097eb8dfdd4261be6745807e6d3335"><enum>(1)</enum><text>has established expertise with respect to air quality or dedicated centers of air quality research;</text></paragraph><paragraph id="idd043b7e078d44b5d8a805e03dfc2ac9b"><enum>(2)</enum><text>has experience with relevant outreach and extension work;</text></paragraph><paragraph id="idf0e01f04bb004a15895e786acea3a323"><enum>(3)</enum><text>has established relationships with relevant Federal, State, and local agencies, community organizations, Native Hawaiian organizations, and Indian Tribes; and</text></paragraph><paragraph id="id8f6cf614e30140aab2bebde21ecc488b"><enum>(4)</enum><text>is located in an area that is economically or environmentally impacted by wildfire smoke or extreme heat. </text></paragraph></subsection><subsection id="ide5a45e3ce8bb4faaa9ea2cf064c95dda"><enum>(d)</enum><header>Technical assistance</header><text>The Administrator may use amounts made available to carry out this section to provide to eligible entities described in subsection (b) technical assistance in—</text><paragraph id="id76464ad77a8f4e18bd0e5afe316406d9"><enum>(1)</enum><text>submitting grant applications under subsection (c); or</text></paragraph><paragraph id="idf42dec9a0196435b8f39ec80556ec58e"><enum>(2)</enum><text>carrying out projects using a grant under this section.</text></paragraph></subsection><subsection id="idef1dedafd12a4adda0b3a3464f01541a"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator to carry out this section $50,000,000 for fiscal year 2024 and each fiscal year thereafter.</text></subsection></section></legis-body></bill>
