<section id="H3F190C889C284607B6FC46029E290747" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Patriot Spouses Act</short-title></quote>. </text></section> <section id="HE7C22049064A47E2A297AE5CF1FEB624"><enum>2.</enum><header>Adjustment of status for certain military spouses</header><text display-inline="no-display-inline">Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="traditional" id="H3496FDD0E147443992FFB4D0CC6512C4" display-inline="no-display-inline"> 
<subsection id="H4E5C9191EC494E569F3370423F46798E"><enum>(o)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HE7D3024ADCE641B9830ED43F31D4748D"><enum>(1)</enum><text>In applying this section to an alien described in paragraph (2)—</text> <subparagraph id="H2653BA09F3974CD1919A2A218EC14A3F" indent="up1"><enum>(A)</enum><text>such alien shall be deemed, for purposes of subsection (a), to have been inspected and admitted into the United States; and</text></subparagraph> 
<subparagraph id="HF187327B2A07498D9FE0B028191E0FF8" indent="up1"><enum>(B)</enum><text>in determining the alien’s admissibility as an immigrant—</text> <clause id="HC3650D58B2644C1D9238444D83D6E701"><enum>(i)</enum><text>paragraphs (6)(A), (7)(A), and (9)(B) of section 212(a) shall not apply; and</text></clause> 
<clause id="HF78E141DF98541EFB3754FF65A537A37" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security, in the discretion of the Secretary, may waive the application of paragraphs (6)(C), (9)(A), and (9)(C) of section 212(a) if the alien establishes to the satisfaction of the Secretary that the alien does not pose a threat to the public and has not committed any criminal offenses in violation of Federal or State law unrelated to the alien’s status.</text></clause></subparagraph></paragraph> <paragraph id="HACF0344A25B24CA29D6EE22DE8C6A45C" indent="up1"><enum>(2)</enum><text>An alien is described in this paragraph if the alien—</text> 
<subparagraph id="H23743FAD11B942C98624A200329D7A33"><enum>(A)</enum><text display-inline="yes-display-inline">is or was the spouse of a United States citizen who—</text> <clause id="HEE9C35CF46BA424E82A971335B6CB819"><enum>(i)</enum><text display-inline="yes-display-inline">is or was serving on active duty in the United States Armed Forces or in a reserve component of the United States Armed Forces; and</text></clause> 
<clause id="HF2E13E8E88074503AC22BBFFFB4E6C57"><enum>(ii)</enum><text display-inline="yes-display-inline">if discharged or released from service in the Armed Forces, was discharged or released under honorable conditions; and</text></clause></subparagraph> <subparagraph id="H0A59B4CD36424F4D9282A98AB1254A64"><enum>(B)</enum><text display-inline="yes-display-inline">is the beneficiary of a petition for classification under section 204(a)(1)(A) as an immediate relative (as defined in section 201(b)) by reason of the marriage to such citizen.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4E936AC669DF40CB90FBFDF72AED76B9"><enum>3.</enum><header>Treatment of certain grounds for inadmissibility for certain military spouses</header><text display-inline="no-display-inline">Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended by inserting after subsection (b) the following:</text> <quoted-block style="traditional" id="HCE474C44382A4C89BA007D72B28E6095" display-inline="no-display-inline"> <subsection id="H997455AC01C84CFE98EB08329900DC00" display-inline="no-display-inline"><enum>(c)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="HDBBD349D42EA41E28656582E75E8F400"><enum>(1)</enum><text>In determining the admissibility as an immigrant of an alien described in paragraph (2)—</text> 
<subparagraph id="HC9FBA1E3DB29438893454F86618709E8" indent="up1"><enum>(A)</enum><text>subsection (a)(9)(B) shall not apply; and</text></subparagraph> <subparagraph id="HA8D2DD59E2F94C448D5D685B005FA13B" indent="up1"><enum>(B)</enum><text>the Secretary of Homeland Security, in the discretion of the Secretary, may waive the application of paragraphs (6)(C), (9)(A), and (9)(C) of subsection (a) if the alien establishes to the satisfaction of the Secretary that the alien does not pose a threat to the public and has not committed any criminal offenses in violation of Federal or State law unrelated to the alien’s status.</text></subparagraph></paragraph> 
<paragraph id="H2A71C365FF3A4068A0E30CD1C120CC74" indent="up1"><enum>(2)</enum><text>An alien is described in this paragraph if the alien—</text> <subparagraph id="H03C0B7672DC144919F5DA31F6B57E21C"><enum>(A)</enum><text display-inline="yes-display-inline">is or was the spouse of a United States citizen who—</text> 
<clause id="H1A24D36ED0C54C488B9E64127C25688E"><enum>(i)</enum><text display-inline="yes-display-inline">is or was serving on active duty in the United States Armed Forces or in a reserve component of the United States Armed Forces; and</text></clause> <clause id="H7E390E3DE90B45D9B11584D8683C3EC5"><enum>(ii)</enum><text display-inline="yes-display-inline">if discharged or released from service in the Armed Forces, was discharged or released under honorable conditions; and</text></clause></subparagraph> 
<subparagraph id="H2FFC45BA8DCC44D48D8B91250AA93CE3" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is the beneficiary of a petition for classification under section 204(a)(1)(A) as an immediate relative (as defined in section 201(b)) by reason of the marriage to such citizen.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HBEE48B8DBEB4478099C5559CBC515E2A"><enum>4.</enum><header>Eligibility of removed or voluntarily departed aliens</header> <subsection id="HC5742C4C0B404B408A9270257C9A8761"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security and the Secretary of State shall take such steps as may be necessary to ensure that eligible aliens who were removed or permitted to depart voluntarily from the United States before the date of the enactment of this Act may apply from abroad for an immigrant visa pursuant to the amendment made by section 3.</text></subsection> 
<subsection id="H0C13604D0DC749198DBA8E27B281AA0B"><enum>(b)</enum><header>Nonimmigrant admission pending adjudication</header><text display-inline="yes-display-inline">The Secretary of Homeland Security and the Secretary of State shall establish a program under which an eligible alien with a pending application made under subsection (a) may be authorized to enter the United States as a nonimmigrant to reunite with their United States citizen spouse during the period in which such application, and an associated application for adjustment of status, remain pending. In determining whether an alien is eligible to be admitted to the United States as a nonimmigrant under this subsection, the Secretary of Homeland Security and the Secretary of State shall require the alien to establish to the satisfaction of each Secretary that the alien does not pose a threat to the public or to national security. In determining the admissibility as a nonimmigrant of an alien described in this subsection, the Secretary of Homeland Security, in the discretion of the Secretary, may waive the application of paragraphs (6)(C) and (9) of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>).</text></subsection></section> </legis-body></bill>
