committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to require the Small Business and Agriculture Regulatory Enforcement Ombudsman to publish guidance documents for certain rules, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H24BA746C262C45AA8643E53DE0DBD83C" style="OLC"><section id="HE50DA61133E549BEBBAA77482AF4C6D5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Opportunities to Show Transparency via Information Technology Act of 2023</short-title></quote> or the <quote><short-title>POST IT Act of 2023</short-title></quote> .</text></section><section id="H996EC2866405448A95C6C648482370F4"><enum>2.</enum><header>Inclusion of guidance on Ombudsman website</header><subsection id="H11B0852370B643D082C4F3A53D8FC8F4"><enum>(a)</enum><header>Website requirement</header><text display-inline="yes-display-inline">Section 30 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657">15 U.S.C. 657</external-xref>) is amended—</text><paragraph id="HCB724E02B2DE462082C122AE18EDCBD7"><enum>(1)</enum><text>in subsection (e)—</text><subparagraph id="H5C87C8EEB02F48A4A467AC2E96717535"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H23388C071F0946089D7A620D2E6A68C9"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HA0988F85EAE642E5AA20DB25CD3CD98B"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H39FB74F4B5D841B7B3B6A32A01B59E93" display-inline="no-display-inline"><paragraph id="H2606B287396342A1AB6F56E8B1BCB8D8"><enum>(3)</enum><text display-inline="yes-display-inline">to the extent practicable, hyperlinks for such guidance that is designed to set forth policy on a statutory, regulatory, or technical issue, or an interpretation of such issue, for any rule for which an agency produces a small entity compliance guide.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0371037336904375A0C11E67106C54A4"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HC62C9F5CB3924C28956933AFC6D0CCEC" display-inline="no-display-inline"><subsection id="H5EAC5DC21C0540B49DFA4868A5FA24D5"><enum>(g)</enum><header>Protection of confidential information</header><text display-inline="yes-display-inline">Subsection (e) does not require the public availability of information that is exempt from public disclosure under section 552(b) of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB4D66B2DD93349FFBB57A86C87A0EDC1"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Paragraph (3) of section 30(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657">15 U.S.C. 657</external-xref>), as added by this section, shall apply with respect to guidance on, or interpretation of, a rule for which an agency produces a small entity compliance guide described under section 212(a)(1) of the Small Business Regulatory Enforcement Fairness Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note) on or after the date of the enactment of this Act.</text></subsection></section><section id="H1E49AE691FBB488D9A666BFAC9116BE4"><enum>3.</enum><header>Compliance with CUTGO</header><text display-inline="no-display-inline">No additional amounts are authorized to be appropriated to carry out this Act or the amendments made by this Act. Such Act and amendments shall be carried out using amounts otherwise appropriated.</text></section></legis-body><endorsement display="yes"><action-date date="20230901">September 1, 2023</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
