R. 4668</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231129">November 29, 2023</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Small Business Act to require the Small Business and Agriculture Regulatory Enforcement Ombudsman to publish guidance documents for certain rules, and for other purposes.</official-title></form><legis-body id="H24BA746C262C45AA8643E53DE0DBD83C" style="OLC"><pagebreak></pagebreak><section id="H751D531B145446DAA3AFE54AFE0D4B3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Opportunities to Show Transparency via Information Technology Act of 2023</short-title></quote> or the <quote><short-title>POST IT Act of 2023</short-title></quote> .</text></section><section id="H25C371B2420B4A2793D102F5A381557A"><enum>2.</enum><header>Inclusion of guidance on Ombudsman website</header><subsection id="H74841DC9F7F741F983BE0C87505D40EA"><enum>(a)</enum><header>Website requirement</header><text display-inline="yes-display-inline">Section 30 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657">15 U.S.C. 657</external-xref>) is amended—</text><paragraph id="H130940A235544CB09A55204089515942"><enum>(1)</enum><text>in subsection (e)—</text><subparagraph id="HB4D76F8EDA334479AC36447175B6A643"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H56CCC9013CC5434B84C51C3CD97D7899"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H53514FDB39914DDEA619FB076E20EB89"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H56EDE1CFA79842A7BABACD4E6AFB52FB" display-inline="no-display-inline"><paragraph id="H520882D377A048F599B3A1CA0A0A3E04"><enum>(3)</enum><text display-inline="yes-display-inline">to the extent practicable, hyperlinks for such guidance that is designed to set forth policy on a statutory, regulatory, or technical issue, or an interpretation of such issue, for any rule for which an agency produces a small entity compliance guide.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEC5103E84E8A4783B60FFA618120523D"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H3B617B1D6F224C07985BE1785620D564" display-inline="no-display-inline"><subsection id="H7D22541DD9BF4A6696DA1D1BD1EFCB2B"><enum>(g)</enum><header>Protection of confidential information</header><text display-inline="yes-display-inline">Subsection (e) does not require the public availability of information that is exempt from public disclosure under section 552(b) of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBBB250C8F2AB423EAE0B66F4CB5C4469"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Paragraph (3) of section 30(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657">15 U.S.C. 657</external-xref>), as added by this section, shall apply with respect to guidance on, or interpretation of, a rule for which an agency produces a small entity compliance guide described under section 212(a)(1) of the Small Business Regulatory Enforcement Fairness Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note) on or after the date of the enactment of this Act.</text></subsection></section><section id="HE083816B17F044999B4D3C008FD6B64D"><enum>3.</enum><header>Compliance with CUTGO</header><text display-inline="no-display-inline">No additional amounts are authorized to be appropriated to carry out this Act or the amendments made by this Act. </text></section></legis-body><attestation><attestation-group><attestation-date date="20231128" legis-day="20231128" chamber="House">Passed the House of Representatives November 28, 2023.</attestation-date><attestor display="yes">Kevin F.
