R. 4666</legis-num><associated-doc role="report" display="yes">[Report No. 118–182]</associated-doc><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230717">July 17, 2023</action-date><action-desc><sponsor name-id="B001314">Mr. Bean of Florida</sponsor> (for himself and <cosponsor name-id="M000687">Mr. Mfume</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><action display="yes"><action-date date="20230901">September 1, 2023</action-date><action-desc>Additional sponsors: <cosponsor name-id="L000598">Mr. LaLota</cosponsor> and <cosponsor name-id="P000616">Mr. Phillips</cosponsor></action-desc></action><action display="yes"><action-date date="20230901">September 1, 2023</action-date><action-desc>Reported from the <committee-name committee-id="HSM00">Committee on Small Business</committee-name>; committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Inspector General of the Small Business Administration to submit a quarterly report on fraud relating to certain COVID–19 loans.<pagebreak></pagebreak></official-title></form><legis-body id="H908C1EDACC9D44F199CED17C2DFFEA26" style="OLC"><section id="HE70CBBCD821A468997E3F9B807772FD0" section-type="section-one"><enum>1.</enum><header>Report on fraud relating to certain COVID–19 loans</header><subsection id="H48FD316485984128B8D92A631455D0BE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, and every 3 months thereafter, the Inspector General of the Small Business Administration shall submit to the Committee on Small Business of the House of Representatives and the Committee on Small Business and Entrepreneurship of the Senate a report on the number of borrowers engaged in fraud with respect to a covered loan.</text></subsection><subsection id="HDBA1881897F84DDB80D91C0E79EA3822"><enum>(b)</enum><header>Elements</header><text>The report required under subsection (a) shall include, with respect to the period covered by such report—</text><paragraph id="H435ECF98A8BF445DB9828B90E095568D"><enum>(1)</enum><text>the number and total dollar amount of all covered loans made;</text></paragraph><paragraph id="H24E516C8536A4DE4BA4E228B965BEE72"><enum>(2)</enum><text>the number of new cases of fraud and suspected fraud;</text></paragraph><paragraph id="H62E9E90A06B04E91B4F2390772D3AAE8"><enum>(3)</enum><text>the number of fraud cases resolved; and</text></paragraph><paragraph id="H96A08B2C3DF24EBA8CE4A64DFE0450E0"><enum>(4)</enum><text>the types of fraud cases described in paragraphs (2) and (3).</text></paragraph></subsection><subsection id="H2EA3A27B84614CD0B5CC6738FB380170"><enum>(c)</enum><header>Covered loan defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered loan</term> means—</text><paragraph id="HDFF590DFFBCF4C67B83867199E3497FA"><enum>(1)</enum><text>a loan made under paragraphs (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>); or</text></paragraph><paragraph id="H5945D5E2BB5C4AFB976CE6E650FE30A2"><enum>(2)</enum><text display-inline="yes-display-inline">a loan made under section 7(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) in response to COVID–19 during the covered period (as defined in section 1110(a) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>)).</text></paragraph></subsection><subsection id="H8777A89BF56D4AF5B210AC18C3F69579"><enum>(d)</enum><header>Termination</header><text>This Act and the requirements of this Act shall terminate on the date that is two years after the date of the enactment of this Act.</text></subsection></section><section id="HD398BB056DD94831AF1A3D74BD5F946A"><enum>2.</enum><header>Compliance with CUTGO</header><text display-inline="no-display-inline">No additional amounts are authorized to be appropriated to carry out this Act. Such Act shall be carried out using amounts otherwise appropriated to the Administrator of the Small Business Administration or the Inspector General of the Small Business Administration.</text></section></legis-body><endorsement display="yes"><action-date date="20230901">September 1, 2023</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
