<section section-type="section-one" id="HFE9F0EDC4EB04A98A629F01AE08689DD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disadvantaged Business Enterprise Supportive Services Expansion Act</short-title></quote>.</text></section> <section id="H4BFA092851F54D808F0BA8381400E097"><enum>2.</enum><header>Increase cap for Federal Highway Administration disadvantaged business enterprise supportive services program</header> <subsection id="H33A3DFB5BF564018A07FB57FAE70F23E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 140(c) of title 23, United States Code, is amended, in the second sentence, by striking <quote>$10,000,000</quote> and inserting <quote>$25,000,000</quote>.</text></subsection> 
<subsection id="HFF5D0689456E4403B60028F2AA38C7F1"><enum>(b)</enum><header>Conforming amendment</header><text>Section 104(a)(1) of title 23, United States Code, is amended by striking subparagraphs (C) through (E) and inserting the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="H626EDB7C12AA46718689E00CAAC3F95F"> <subparagraph id="HDAE15B621DB94DF1879219E236A902D5"><enum>(C)</enum><text>$525,799,671 for fiscal year 2024;</text></subparagraph> 
<subparagraph id="H195855D9A04A4802A38A262E3D18146E"><enum>(D)</enum><text>$536,015,664 for fiscal year 2025; and</text></subparagraph> <subparagraph id="HEA422457B09F46F3888EE48F444A44F7"><enum>(E)</enum><text>$546,435,977 for fiscal year 2026.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H732347F65BC14B2FBA62F33EC26BCA08"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2023.</text></subsection></section> <section id="HC182CC43CF6344C397F172ADD267AF96"><enum>3.</enum><header>Federal Transit Administration disadvantaged business enterprise supportive services program</header> <subsection id="H11EA17A40C7546628F8910515265B07B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5332 of title 49, United States Code, is amended by adding at the end the following: </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H268D52F36B64406585E8BC5892C68D90"> 
<subsection id="H1DDFE8602EF7425AB87B2E2031ADFE7F"><enum>(g)</enum><header>Disadvantaged business enterprise supportive services program</header> 
<paragraph id="H7D70B8BA5257415899D656E9C30C0BFA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Administrator of the Federal Transit Administration, the Associate Administrator for Civil Rights of the Federal Transit Administration, other Federal agencies, State agencies, authorities, associations, institutions, Tribal governments, for profit or nonprofit corporations, and any other organizations or persons, including transit authorities and transit-specific organizations, may develop, conduct, and administer training programs and assistance programs in connection with any program under this chapter so that small business concerns owned and controlled by socially and economically disadvantaged individuals may achieve proficiency to compete, on an equal basis, for contracts and subcontracts.</text></paragraph> <paragraph id="HEED475FA70A541AEADAAE7ECD59AD1EC"><enum>(2)</enum><header>Funding</header><text display-inline="yes-display-inline">Of the amounts made available to carry out section 5314, the Secretary, in coordination with the Administrator of the Federal Transit Administration, the Associate Administrator for Civil Rights of the Federal Transit Administration, shall use not more than $5,000,000 for each fiscal year to carry out this subsection.</text></paragraph> 
<paragraph id="HB9722B91B8644BAC95595D6E66243AE1"><enum>(3)</enum><header>Nonapplicability of certain provisions</header><text display-inline="yes-display-inline">Notwithstanding section 3106 of title 41, section 6101 of that title shall not be applicable to contracts and agreements entered into pursuant to paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HDEB6E2C9B86941F8B30C923136EA4582"><enum>(b)</enum><header>Funding</header><text display-inline="yes-display-inline">Section 5338(a) of title 49, United States Code, is amended—</text> 
<paragraph id="H007DE1F7A82A4CCF95526A453BDF83BA"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking subparagraphs (C), (D), and (E) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H977DED77DB8B46B9B1591F3163FED309"> <subparagraph id="HADA6918F18764FF1B444E5E407612BEC"><enum>(C)</enum><text display-inline="yes-display-inline">$13,995,000,000 for fiscal year 2024;</text></subparagraph> 
<subparagraph id="H8A236E33000F4C46BF61F572B363F315"><enum>(D)</enum><text display-inline="yes-display-inline">$14,284,000,000 for fiscal year 2025; and</text></subparagraph> <subparagraph id="HA99A14F94284462BA3D8FFD95EE1215E"><enum>(E)</enum><text display-inline="yes-display-inline">$14,647,000,000 for fiscal year 2026.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HECDB5F2990224BDC9CCCBA638C277DDD" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>in paragraph (2)(H), by striking <quote>$12,404,500 for fiscal year 2024, $12,660,748 for fiscal year 2025, and $12,982,608 for fiscal year 2026</quote> and inserting <quote>$17,404,500 for fiscal year 2024, $17,660,748 for fiscal year 2025, and $17,982,608 for fiscal year 2026</quote>. </text></paragraph></subsection> <subsection display-inline="no-display-inline" commented="no" id="HEBE44C308C4341B38EAAC9163598D076"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2023.</text></subsection></section> 
<section id="H7A3635A1E0244B5AB0FEC3A1D8921DAB"><enum>4.</enum><header>Federal Aviation Administration socially and economically disadvantaged business participation supportive services program</header> 
<subsection id="H3E7C36DFA0BA47A38B9EFAFE4DAF4A26"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 47113 of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H705D2072186F4FD4878C8B5F445E2435"> <subsection id="HD57AC4966D214E36801CD55B54B196D9"><enum>(f)</enum><header>Socially and economically disadvantaged business participation supportive services program</header> <paragraph id="HAB47A409964C40D7AFE1F53D8CA51B45"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with the Assistant Administrator of the Office of Civil Rights of the Federal Aviation Administration, may make agreements to provide assistance to an eligible entity described in paragraph (2) to develop, conduct, and administer training programs and assistance programs in connection with any project to be carried out under a grant agreement under this subchapter in order that small business concerns owned and controlled by socially and economically disadvantaged individuals may achieve proficiency to compete, on an equal basis, for contracts and subcontracts related to such projects, and for Small Business Innovation Research contracts.</text></paragraph> 
<paragraph id="HE06FEC2890B14759934D0FA66E462BBF"><enum>(2)</enum><header>Eligible entities described</header><text>An eligible entity described in this paragraph is any of the following:</text> <subparagraph id="H1BCE9C2169554D4A96C55D6A5029D96C"><enum>(A)</enum><text>A State or territory.</text></subparagraph> 
<subparagraph id="H9A7D37D3CE7E4031A8A37E9BFF1C330D"><enum>(B)</enum><text>A political subdivision of a State or local government.</text></subparagraph> <subparagraph id="HEFFD7D47A597455F99ABE40E2DA37444"><enum>(C)</enum><text>A Tribal government.</text></subparagraph> 
<subparagraph id="H8A43ECB5E7AB40EE8F80C6B8A078B73D"><enum>(D)</enum><text>A special purpose district or public authority with an aviation function.</text></subparagraph> <subparagraph id="H537F428A05FC4E82A221AFE14DE3DFAA"><enum>(E)</enum><text>A port authority.</text></subparagraph> 
<subparagraph id="HBCECC1C4066A4A77934CBB742BB989D2"><enum>(F)</enum><text>A metropolitan planning organization.</text></subparagraph> <subparagraph id="H630666C575F143EC8F44FFE18E9A2617"><enum>(G)</enum><text>A group of entities described in any of subparagraphs (A) through (F).</text></subparagraph> 
<subparagraph id="HFB26E2774D704A2D938617776EE333B5"><enum>(H)</enum><text>Any other profit or non-profit organization or group of organizations deemed appropriate by the Secretary.</text></subparagraph></paragraph> <paragraph id="H5E3029D46669431286E5C4D1EA10813B"><enum>(3)</enum><header>Funding</header><text>From amounts available in the Airport and Airways Trust Fund established under <external-xref legal-doc="usc" parsable-cite="usc/26/9502">section 9502</external-xref> of the Internal Revenue Code of 1986, the Secretary, in cooperation with the Assistant Administrator of the Office of Civil Rights of the Federal Aviation Administration, may use such sums as necessary, not to exceed $5,000,000 per fiscal year, for the administration of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H214B441EA4CD4A32872A10EF3554185E" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Expenditure authority from airport and airway trust fund</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9502">Section 9502(d)(1)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>or section 47113(f) of title 49, United States Code</quote> before the semicolon at the end. </text></subsection> <subsection display-inline="no-display-inline" commented="no" id="H9A514B878E3841ABB85FFE8215EF3793"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2023.</text></subsection></section>
