<section id="H3E83B8AD6E1D4DC8B0C82B62F44C9241" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Seabed Protection Act</short-title></quote>.</text></section> <section id="HF004981E194E46F5A259AC32A65DF031" section-type="subsequent-section"><enum>2.</enum><header>Prohibition of certain mining activities on deep seabed and Outer Continental Shelf</header> <subsection id="H4613D3811CA048FC9B1C2EEE7C63765D"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph id="H906F9B78DE4D4E899C6CDF28507E0CDE"><enum>(1)</enum><text display-inline="yes-display-inline">As determined by the United Nations, most recently in its Sustainable Development Goals report, our world’s oceans are at great risk from a number of factors, including atmospheric change, resource extraction, and pollution.</text></paragraph> <paragraph id="HF522636750014C83A73E454AB02205EA"><enum>(2)</enum><text display-inline="yes-display-inline">The United Nation’s 2030 Agenda for Sustainable Development, launched by the 2015 UN Summit in New York established Sustainable Development Goal 14 (SDS 14), to conserve and sustainably use the oceans, seas, and marine resources. Target 2 of SDS 14 commits States to sustainably manage marine ecosystems to avoid significant adverse impacts and strengthen their resilience.</text></paragraph> 
<paragraph id="H7BCE582826E347F9AEEE06524981405C"><enum>(3)</enum><text display-inline="yes-display-inline">The international marine scientific and policy consensus is that deep seabed mining presents a major risk to the marine environment, including—</text> <subparagraph id="H7AC92F06784544DB860245B6EC893291"><enum>(A)</enum><text>the direct loss of unique and ecologically important species;</text></subparagraph> 
<subparagraph id="H01D9849827D54269AB4AD81D7D560F40"><enum>(B)</enum><text>large sediment plumes that will negatively affect ecosystems well beyond the actual mining sites;</text></subparagraph> <subparagraph id="HC8EDE0A19BE3458DB3165CC6CFD12104"><enum>(C)</enum><text>noise pollution that will cause physiological and behavioral stress to marine species;</text></subparagraph> 
<subparagraph id="H6903922740954C2B8BAFB5742FF6A141"><enum>(D)</enum><text>likely contamination of commercially important species of food fish; and</text></subparagraph> <subparagraph id="H97D08859987848D0B1C8BEA149AFA3C8"><enum>(E)</enum><text>likely negative impacts on carbon sequestration dynamics and deep-ocean carbon storage.</text></subparagraph></paragraph> 
<paragraph id="H5BCED6A1E520449A86EFA81DCD08F799"><enum>(4)</enum><text display-inline="yes-display-inline">The United Nations Convention on Biological Diversity, 15th Conference of Parties, Decision 15/24 encourages member States to ensure that, before deep seabed mineral exploitation is permitted, the related impacts on the marine environment and biodiversity are sufficiently researched, the risks to the marine ecosystem are sufficiently understood, and sufficient regulation and conditions are imposed to ensure that exploitation does not cause harmful effects to the marine environment and biodiversity.</text></paragraph> <paragraph id="H2E52D7B4551A41E3B6C16CFABFA27586"><enum>(5)</enum><text display-inline="yes-display-inline">The 2022 United Nations Environment Programme Financial Initiative report on deep seabed mining states that the financing of such activities is not consistent with Sustainable Blue Economy Finance Principles.</text></paragraph> 
<paragraph id="H915CA20F637645B2A422ED10B2482B5A"><enum>(6)</enum><text display-inline="yes-display-inline">There is currently insufficient scientific information on the deep sea and related marine ecosystems to fully and accurately assess the risks and impacts of deep seabed mining activities.</text> </paragraph></subsection> <subsection id="H7EBF112BC4D7440CBCE377A785291D7F"><enum>(b)</enum><header>Prohibition of certain mining activities on deep seabed and Outer Continental Shelf</header> <paragraph id="H2D041BD6B4E54D4C8647B7D149C9AACA"><enum>(1)</enum><header>Deep seabed</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Deep Seabed Hard Mineral Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1401">30 U.S.C. 1401 et seq.</external-xref>), no license, permit, or other authorization may be issued for exploration or commercial recovery.</text> </paragraph> 
<paragraph id="H38967DEC4E564B1393EC37FE2C4D4DFA"><enum>(2)</enum><header>Outer Continental Shelf</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1301">43 U.S.C. 1301 et seq.</external-xref>), no license, permit, or other authorization may be issued for exploration, development, or production of a hardrock mineral on the Outer Continental Shelf.</text></paragraph> <paragraph id="H9C9C970188434BFAB4329995C1F8C818"><enum>(3)</enum><header>Exception for scientific research</header><text>Paragraphs (1) and (2) shall not apply to the issuance of a license, permit, or other authorization to carry out scientific research activities.</text></paragraph> </subsection> 
<subsection id="H304B278991284A4F8B3844D0B1312402"><enum>(c)</enum><header>Assessment of environmental impacts of mining activities on deep seabed and Outer Continental Shelf</header> 
<paragraph id="HDED46C9A43C14B4AA58DB1D1021E2D66"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this section, the Secretary shall seek to enter into an agreement with the National Academies of Science, Engineering, and Medicine to conduct a comprehensive study of the environmental impacts of mining activities on the deep seabed and Outer Continental Shelf.</text></paragraph> <paragraph id="HB7BF994462FF40FB853AAD61218CF767"><enum>(2)</enum><header>Submission of assessment</header><text>The Secretary shall submit to the appropriate Congressional committees a report regarding the findings of the study described in paragraph (1).</text> </paragraph> 
<paragraph id="H36D598B4DDF8481293CDFA2C6A394903"><enum>(3)</enum><header>Contents</header><text>The study described in paragraph (1) shall include the following:</text> <subparagraph id="HF0A1575EC0864536914D28645E2C4A44"><enum>(A)</enum><text display-inline="yes-display-inline">A characterization of ecosystems—</text> 
<clause id="H64F29FFD01E142CCA2D7D558C2438ED2"><enum>(i)</enum><text>on the deep seabed and Outer Continental Shelf;</text></clause> <clause id="H126A1EDF1EC3465F94326C40B2524BD8"><enum>(ii)</enum><text>in the overlying water columns of the deep seabed and Outer Continental Shelf; and</text></clause> 
<clause id="H3A8E5B36ABBD4A61AC6D16DDC491DAEA"><enum>(iii)</enum><text>on seamounts and hydrothermal vents.</text></clause></subparagraph> <subparagraph id="HF313726063764352BCDF17CF4C626A26"><enum>(B)</enum><text display-inline="yes-display-inline">An assessment of the potential impacts associated with mining activities on the deep seabed and Outer Continental Shelf on—</text> 
<clause id="H0DD763AFCD4A4748898B785AF40A059D"><enum>(i)</enum><text>habitats and species on the deep seabed and Outer Continental Shelf and in the overlying water columns of the deep seabed and Outer Continental Shelf, including—</text> <subclause id="H1B870DE5315C46E2881D489CD5AFCAE6"><enum>(I)</enum><text>an approximate quantification of the spatial extent and timescale of such impacts; and</text></subclause> 
<subclause id="HF01F5B94B2D54FE2BAF420FE8E68A4A9"><enum>(II)</enum><text>the potential for the recovery of such habitats and species from such impacts;</text></subclause></clause> <clause id="H8CFC13DE4D3F4723AF0B554BC16B4FE7"><enum>(ii)</enum><text display-inline="yes-display-inline">the capacity of deep sea and open ocean processes and ecosystems to sequester greenhouse gases;</text></clause> 
<clause id="H3F857964076A423EB93604416596CF87"><enum>(iii)</enum><text display-inline="yes-display-inline">users of the marine environment, including—</text> <subclause id="HE13813DCB4AE46EABD392298484B29AB"><enum>(I)</enum><text>commercial and recreational fisheries;</text></subclause> 
<subclause id="H164CA89D21A246C4968B1FDC95C2B954"><enum>(II)</enum><text>recreational users;</text></subclause> <subclause id="HC2224A34357B489B94B8F1C92B7332F5"><enum>(III)</enum><text>aquaculture operations; and</text></subclause> 
<subclause id="H60E8D3AA96D34F0888818EE3AB0CF5DF"><enum>(IV)</enum><text>developers of subsea infrastructure; and</text></subclause></clause> <clause id="H1177BBE70ADC4A14AE5B75B391BE929A"><enum>(iv)</enum><text display-inline="yes-display-inline">indigenous peoples and cultures linked to marine species and the marine environment.</text></clause></subparagraph> 
<subparagraph id="H5AF172B35AE04C18825747A86D820CEF"><enum>(C)</enum><text>An assessment of the potential impacts of sediment plumes from disturbance of the deep seabed and Outer Continental Shelf and collector vessel discharge on pelagic species and food webs.</text></subparagraph> <subparagraph id="HE28BFEC56F1E4781A3DD8A15F412475D"><enum>(D)</enum><text>An approximate quantification of the greenhouse gas emissions associated with mining activities on the deep seabed and Outer Continental Shelf, including such emissions that may result from the alteration of the biology, geology, or chemistry of the sediment on or the overlying water column of the deep seabed and Outer Continental Shelf.</text></subparagraph> 
<subparagraph id="H27B9574F2B4F45C58BD8E584445D9F5D"><enum>(E)</enum><text>An assessment of the viability of alternatives to the use of minerals found on the deep seabed and Outer Continental Shelf, including—</text> <clause id="H0A1D3B35F95D41AB9D312F3390803F36"><enum>(i)</enum><text>developing a greater capacity for and promoting the reuse and recycling of such minerals in circulation;</text></clause> 
<clause id="H51FBFC196AF1473BAF0ABB42E49C07F7"><enum>(ii)</enum><text>developing and promoting the use of substitute minerals and materials that have fewer or less severe environmental impacts associated with such use; and</text></clause> <clause id="H70CF8FB75B83402BAD9BA383C116C448"><enum>(iii)</enum><text>developing methods to reduce the environmental impacts of terrestrial mining practices and other similar initiatives.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H540EFFB9C52B428B969D00DB16A3E083"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H2FD51D1653F740149F148630AFCA2C07"><enum>(1)</enum><header>Appropriate Congressional committees</header><text>The term <term>appropriate Congressional committees</term> means—</text> 
<subparagraph id="HCF086E35225D47E58769207B99A087BD"><enum>(A)</enum><text>with respect to the House of Representatives—</text> <clause id="H3C3C25ECC0274B1985B2D9B0D33437E1"><enum>(i)</enum><text>the Committee on Foreign Affairs; and</text></clause> 
<clause id="H3A377771A477473193BAFBC5E150BFE8"><enum>(ii)</enum><text>the Committee on Natural Resources; and</text></clause></subparagraph> <subparagraph id="HF7FBD27757894E998F27BD3E0955CA43"><enum>(B)</enum><text>with respect to the Senate—</text> 
<clause id="H95FAC4F541074E66B1A3850B62D70B75"><enum>(i)</enum><text>the Committee on Commerce, Science, and Transportation;</text></clause> <clause id="H8FC0E4AD95724E1C836086879AF20C32"><enum>(ii)</enum><text>the Committee on Energy and Natural Resources; and</text></clause> 
<clause id="HE735E76B56D04845B9743B8D4D6EED66"><enum>(iii)</enum><text>the Committee on Foreign Relations.</text> </clause></subparagraph></paragraph> <paragraph id="HABE4B9FE7AE24D65B6294FD0F69F6552"><enum>(2)</enum><header>Commercial recovery</header><text display-inline="yes-display-inline">The term <term>commercial recovery</term> has the meaning given the term in section 4 of the Deep Seabed Hard Mineral Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1403">30 U.S.C. 1403</external-xref>).</text></paragraph> 
<paragraph id="H4896970AA4EE42E88CCD4240BC86783C"><enum>(3)</enum><header>Deep seabed</header><text display-inline="yes-display-inline">The term <term>deep seabed</term> has the meaning given the term in section 4 of the Deep Seabed Hard Mineral Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1403">30 U.S.C. 1403</external-xref>).</text></paragraph> <paragraph id="HB89343B8DB304500AB0E62AF10F1AB58"><enum>(4)</enum><header>Development</header><text display-inline="yes-display-inline">The term <term>development</term> has the meaning given the term in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>).</text></paragraph> 
<paragraph id="H9F2EC231824E490EAAE338C89C0DEFF6"><enum>(5)</enum><header>Exploration</header><text display-inline="yes-display-inline">The term <term>exploration</term>—</text> <subparagraph id="H8DF7CCD0200242AE97E50841EF82F655"><enum>(A)</enum><text>when used with respect to the deep seabed, has the meaning given the term in section 4 of the Deep Seabed Hard Mineral Resources Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1403">30 U.S.C. 1403</external-xref>); and</text></subparagraph> 
<subparagraph id="HB04E307B2FE34665AF5C2C1445CA66EC"><enum>(B)</enum><text display-inline="yes-display-inline">when used with respect to the Outer Continental Shelf, has the meaning given the term in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>).</text></subparagraph></paragraph> <paragraph id="H92DAB7FA02F047189D43A5D8A103DB3C"><enum>(6)</enum><header>Outer Continental Shelf</header><text display-inline="yes-display-inline">The term <term>Outer Continental Shelf</term> has the meaning given the term <term>outer Continental Shelf</term> in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>).</text></paragraph> 
<paragraph id="HAF39A13F146941AD8A68924064EDA9CC"><enum>(7)</enum><header>Production</header><text display-inline="yes-display-inline">The term <term>production</term> has the meaning given the term in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>).</text> </paragraph> <paragraph id="H566B2457B2614FA8B7D388C8D97654D3"><enum>(8)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph></subsection></section>
