which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name>, and in addition to the Committees on <committee-name committee-id="HGO00">Oversight and Accountability</committee-name>, and <committee-name committee-id="HHA00">House Administration</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Family and Medical Leave Act of 1993 to permit additional leave for bone marrow or blood stem cell donation, and for other purposes.</official-title></form><legis-body id="H9258CACCEAFB4CEDBAFCE3C51D3C5AB1" style="OLC"><section id="HEBACFB3FD43F4C82AE349A087EEB4A8A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Life Saving Leave Act</short-title></quote>. </text></section><section id="H2446A0F49BC04551853008FB8536B70A"><enum>2.</enum><header>Entitlement to additional leave for bone marrow or blood stem cell donation</header><subsection id="HF4BD02F21A084EA19AD1FADC857D4515"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 102(a) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)</external-xref>) is amended—</text><paragraph id="H134ECD8E9E5B4F9C8DB29B0A04331C3F"><enum>(1)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></paragraph><paragraph id="HC5953ECD2A874DA3B67CC3F068193A6E"><enum>(2)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="OLC" id="H672771777FCD47A4995A1CDA1AB4D5D6" display-inline="no-display-inline"><paragraph id="HA5BC7DE78F9A4A7D955B5266E6228A7D"><enum>(5)</enum><header>Entitlement to additional leave for bone marrow or blood stem cell donation</header><subparagraph id="H3EA3BD125B4645B89C0A92F3820898DC"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B) and section 103(g), an eligible employee shall be entitled to leave under this paragraph—</text><clause id="HFA6C41FFCEBA4765A96937CFFD180149"><enum>(i)</enum><text display-inline="yes-display-inline">for predonation activities relating to the making of a donation of bone marrow or blood stem cells for transplant;</text></clause><clause id="H58293FCB1F8648228B2ABD3153CFF330"><enum>(ii)</enum><text>for the making of such donation; and</text></clause><clause id="H5A499395B7694AC6A5CC5A32436E4BBD"><enum>(iii)</enum><text>for postdonation activities relating to the making of such donation.</text></clause></subparagraph><subparagraph id="H9146B7DD74E248FDB281D6ECC46F4375"><enum>(B)</enum><header>Limitations</header><clause id="H5B64FAF67D36443A91A39242B9B95D03"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible employee shall be entitled to a total of 40 hours of leave under this paragraph during any 12-month period.</text></clause><clause id="HDF547AB836424E7EA1BEF058D4C47DE7"><enum>(ii)</enum><header>Coordination rule</header><text display-inline="yes-display-inline">Leave under this paragraph shall be in addition to any leave provided under any other paragraph of this subsection.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0089EF08DCC54B8495113F12E1D13118"><enum>(b)</enum><header>Definition of eligible employee</header><text display-inline="yes-display-inline">Section 101(2) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H4775C57DB38949A890BDD927EAA81D9C" display-inline="no-display-inline"><subparagraph id="H13BE02D544384E33B69E55DD367EF1A1"><enum>(F)</enum><header>Employees requesting bone marrow or blood stem cell leave</header><text display-inline="yes-display-inline">The requirements of subparagraphs (A) and (B)(ii) shall not apply with respect to leave under section 102(a)(5).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H070052AF09CF4490AE4C48B77293AFEF"><enum>(c)</enum><header>Schedule</header><text display-inline="yes-display-inline">Section 102(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(1)</external-xref>) is amended by inserting after the third sentence the following: <quote>Subject to subsection (e)(4) and section 103(g), leave under subsection (a)(5) may be taken intermittently or on a reduced leave schedule.</quote>.</text></subsection><subsection id="H010BF964C1014AB78FF55F416C452B20"><enum>(d)</enum><header>Substitution of paid leave</header><text display-inline="yes-display-inline">Section 102(d)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HA0B345C394544896BFB0E4270402DD9C" display-inline="no-display-inline"><subparagraph id="H1F58BF0A56A4451A92594ADF8E37629E" commented="no"><enum>(C)</enum><header>Bone marrow or blood stem cell donation leave</header><text display-inline="yes-display-inline">An eligible employee may elect, but an employer may not require the employee, to substitute any of the accrued paid vacation leave, personal leave, or medical or sick leave of the employee for leave provided under subsection (a)(5) for any part of the 40 hours of such leave under such subsection, except that nothing in this title shall require an employer to provide paid sick leave or paid medical leave in any situation in which such employer would not normally provide any such paid leave.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD3B8282996BB4A5F87EAAE52569989A2"><enum>(e)</enum><header>Notice</header><text display-inline="yes-display-inline">Section 102(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H62177EDF2FE34352B65B48D55313E4AF" display-inline="no-display-inline"><paragraph id="HFB1E2F128B7A4530AB5844FE197A602E"><enum>(4)</enum><header>Notice relating to bone marrow or blood stem cell donation leave</header><text display-inline="yes-display-inline">In any case in which the necessity for leave under subsection (a)(5) is foreseeable based on planned predonation, donation, or postdonation activities, the employee—</text><subparagraph id="HEA09E70DD178408DB6F73957560EA54F"><enum>(A)</enum><text display-inline="yes-display-inline">shall make a reasonable effort to schedule the treatment so as not to disrupt unduly the operations of the employer, subject to the approval of the relevant health care provider; and</text></subparagraph><subparagraph id="H21FFEFAB1BCF4C838B5652FB8574C338"><enum>(B)</enum><text>shall provide the employer with not less than 30 days' notice, before the date the leave is to begin, of the employee's intention to take leave under such subparagraph, except that if the date of the treatment requires leave to begin in less than 30 days, the employee shall provide such notice as is practicable.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA05896610C1A410B8B95AA8C8D43662C"><enum>(f)</enum><header>Certification</header><text display-inline="yes-display-inline">Section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HB348429CAA27483B99518F5A4008F667" display-inline="no-display-inline"><subsection id="H30E9EE680EFE4C9B84EDDC2BB2B3634A"><enum>(g)</enum><header>Certification relating to bone marrow or blood stem cell donation leave</header><text display-inline="yes-display-inline">An employer may require that a request for leave under section 102(a)(5) be supported by a certification issued by a contractor of the registry functions of the C.W. Bill Young Cell Transplantation Program. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
