R. 1435</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>September 18, 2023</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Clean Air Act to prevent the elimination of the sale of internal combustion engines.</official-title></form><legis-body id="H9A259116BB4D4194923FA4B7F7AF0D93" style="OLC"><section id="HFEDFC6D0E83F453FACED196A5751A72E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Choice in Vehicle Purchases Act</short-title></quote>. </text></section><section id="HA99C0471B9194921BD940A7EDACD0464"><enum>2.</enum><header>State standards</header><subsection id="HA9DB4525F89B46AD83BF1F625B4EA37E"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 209(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543(b)</external-xref>) is amended—</text><paragraph id="HB2E84D3BD27A4E25B66641A862698E6D"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H735813B311E94CBEB260FD34F14F66F0"><enum>(A)</enum><text>in subparagraph (B), by striking the <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H07AA7D332FAF44D89708DC35F9C7FAB7"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>part.</quote> and inserting <quote>part, or</quote>; and </text></subparagraph><subparagraph id="H1C6220E36CAF4853A53E2F10758273C0"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H486660FD40624A9DAE2778418438E6E6" display-inline="no-display-inline"><subparagraph id="HEA66C9123FD3498AAEF0E3748BD20FDF" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">such State standards directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines, as such term is defined in section 63.9375 of title 40, Code of Federal Regulations, as in effect January 1, 2023.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA7B2ECD130C146399D0BDE63D9D867B1"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HB63CE0378EA4498FAEB3801890ADB5C7" display-inline="no-display-inline"><paragraph id="H8EEF52CCC654418A9BE7283897DD6AD0" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Administrator may not determine that any State standards amended after the date of enactment of this paragraph are within the scope of a waiver granted under paragraph (1) before the date of enactment of this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6D433D59C81348CFA74327E2A4B26214" commented="no"><enum>(b)</enum><header>Effect on certain existing waivers</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall revoke a waiver granted under section 209(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543(b)</external-xref>) during the period that begins on January 1, 2022, and ends on the date of enactment of this Act if the Administrator finds that such waiver does not comply with subparagraph (D) of section 209(b)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543(b)(1)</external-xref>), as added by this Act.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20230914" chamber="House">Passed the House of Representatives September 14, 2023.</attestation-date><attestor display="yes">Kevin F.
